    • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

as posted earlier the POC was fairly poor. BUT as B-card acknowledged and did NOT defend old man got letter from MCOL wanting FULL POC's. so mr Brown got sent full POC as in post 45,

 

i do get impression it's just not what you put in POC's it's HOW you put your POC's

 

am waiting for paul to look at my full POC to see if i got any clout over mercers, hopefully there is, when i get response from PT i'll start knocking "Threat-O-Matic" letters off

Yes, defendant was B-card. as to injunction, will it only be relevant to b-card contacting me or can they be stopped from passing/selling the debt on aswell?

well he would get paid buy the farmer the friday and then the wages were paid the friday just before we got on the bus home. if he had done it any other way it would have been the following week we got it

nope BUT old man got a letter today from mercers telling to pay up account in full in next 7 days. SO I decided to phone them :lol:

 

1st thing they said "do you have a contact number" I laughed so hard down the phone at him, i asked why you writing to me, said aboutr court and i want the £175 in 7 days or i'll send the bailiffs in/ he started going on about something and repeated baliffs, and there refusal to compy with the credit act blah blah blah.

 

he said are you going to pay, i said pay what, i don't owe you anything, he said so you never used the card then i say no (which is TRUE coz it my old mans account not mine :D )

 

he then said we will sell this debt, i said so your quite have to break s13.6 of the banking code and make multiple breaches of the Data Protection Act, he said were not breaking thew DPA, i laughed again and started gabbling on.

 

I said "god you lot like talking out your a$$, goodbye" and hung up.

 

2 letters going tomoz, 1 to mercers with copy's of court papers and |I'll threaten them with court action if they dont vanish into thin air along with a copy of letter that be sent to barclays, same stuff to barclays with copy of letter sent to mercers.

 

I''ll be very happy to take em to court again :lol:

 

ooooooooooooooo my finger is just itching to press the button on MCOL, i wont tho coz court will say no as it too soon after judgement

 

As it has now come to my attention that Mercers is owned by Caldec Finance, they are gonna get a letter from me this week.

 

I have decided to LBA them for same thing i did barclays for.

REASON: They have NOT responded to ANY of my letters and have made NO notes on their computers and they just keep on pounding you.

 

I'll try for £250 this time plus costs if they continue and/or pass/sell debt off.

 

I'm peed at the way they can just keep doing what they do,

i think the best bit is (i'll find it and post later) i said that pay now AND I reserve the rights to take legal action against them again (yawn)

they played me around over SAR so I took em to court for non-disclosure, the papers soon turned up :D

 

TBH I don't care anymore, i'm fed up of being screwed all the time, as in other theads I helping family and friends out. I give fair warning to them of what WILL happen covered by recorded delivery, they choose to ignore it calling my bluff, BAD mistake,

there will be more court action against b-card that relates to MY b-card, £300 credit limit, current amount owed £950 odd, now remove all charges and interest and they owe me about £150, i'm letting it ride at the mo so when I do take court action against them i'll cash in on the 8% interest i can charge them :D

ere ya go, this is last letter i sent dated 17th march.

You have been contacted by CCCS at Northampton County Court regarding the above claim, you failed to file a defence in the permitted time and as a result have defaulted. You have been ordered to pay £175 including costs forthwith. This letter is notification that I require FULL payment by cheque within 14 days; failing this a warrant of execution will be obtained adding further costs. I will then make a request to my local County Court Bailiffs to visit the nearest Barclays Branch (Christchurch) to seize goods to the value of £175 plus any additional costs incurred by the Bailiffs.

As you have passed this account onto your in-house DCA, Mercers, I am demanding that you retrieve this account back from them as they are sending letters out demanding payments without the legal rights as you failed in your obligation to provide a properly executed credit agreement for which I paid the statutory £1 fee for.

I warned you from the beginning of your non-law abiding off handed tactics and as per usual just because you are a BIG bank and I an individual person does not give you any more legal rights than I have.

Should you refuse to cease all collection activity on this account I reserve the right to start further legal proceedings against Barclays Bank Plc including any agents acting of their behalf.

A copy of this letter has been sent to Mercers head office.

I await a cheque for £175 within the next fourteen days.

in case i didnt post it, here is my LBA:

As of yet all you have provided is an “application form”. As in your letter you clearly show that you have enclosed a copy of your current terms and conditions. I did not ask for this. I asked for a properly executed credit agreement and as of yet you have failed to provide it and you are over the 12 working day response, you have no legal right to ask/demand ANY form of payment.

Based on this I am legally entitled to withhold all future payments until such time you provide a properly executed credit agreement.

I can only assume you do not have what I requested as you have provided a copy of your current terms and conditions not a copy of the original Credit Agreement.

You will now cease on charging this account with interest and charges. Should you decide to even attempt to call my bluff and ignore this letter I will quite happily issue you with a S10 under the CCA. Please note that as you have failed to provide the agreement I am now placing this account into dispute as you have no legal right to charge interest and place unlawful charges on this account, As this account is now in dispute you are not allowed to pass ANY information to a third party, doing so will be a breach of the Data Protection Act.

I am now also requesting that you no longer process my information automatically. ALL further information MUST be carried out manually. Please confirm in writing that you will comply.

Further more This is now the THIRD and FINAL letter you will be sent requesting that you cease ALL telephone calls to 01202 ******. IF ANY telephone calls are received after 12 noon on Monday 3rd December 2007 you will leave me no choice to take legal action against you as you are REFUSING to comply with my reasonable request to cease calling me on the above number. I will of course be seeking compensation through the courts.

This is your final warning, ignoring this a summons action WILL be taken against you by 1.pm Monday 3rd December 2007

PLC means Public Limited company so i am thinking u may be rite.

 

If tthat turns out to be true maybe you should have been informed of this before u tried to sue them.

If your confused then i defently am.lol.

 

Mr M got the forms threw on page 3 and i said about what PLC stands for and he asked what section it falls under.

 

Me not known and you being very knowladgable i thought you may no the answer to it.

When did you receive the stuff from Barclays which you posted above?

 

If today, then the only reason I ask is because the letter is dated 1st March 2008. Could they have made a mistake or is something underhand occurring?

old man got phone call at work TODAY from barclays asking if he got letter from them yet and their (we think offer) old man ripped bloke to peices and told him to cough up or we send bailiffs in, where he got home tonight the above was on his door mat.

 

I have no written a FO letter and told them if they abided by the law in first instance and actually responded to letters Court action would not of taken place.

 

IF no chequed received by Friday 11th April I click the button and send the bailiffs on :D

another thing to point out is:

 

the typo where are is crossed out and replaced by is that was how i received the letter, other is look in top right corner of 1st page at telephone number: 0207 116 and look at fax number underneath hmmmm there sommt missing, ah thats it the last 4 digits of number,

 

some 1 has picked up on the date, as prev post default entered 8th march this letter dated 1st march, also they say didnt receive full POC so why did he put my POC dated 15th feb (correct) so must of got court letter saying so and court would of enclosed copy of my full POC

 

any others to rip it apart????????????????

 

i have done rough response and will post official response tomorrow night.

corect me if wrong plz but my impression of THEIR legal executive don't have a frigging clue reguarding the law

AND FYO the signature in 3rd page (1 they want to send to court) is by andy ruffhead of which is identical to signatue i received from the Court that they intennd to fully defend the claim.

i hopefully think that by this thread I have now opened a can of worms so to speak, my post with response 2moz will confirm this FACT

 

 

summary to Barclays should they read this "Eat my shorts" as Bart Simpson would say. I know when i first startd out on this thread is was indeed a little dodgey BUT as time progressed and it come to the crunch this thread could well be good for heck loads of Caggers, see my response to them 2moz and we shall see what comes through my old mans letter box from them next :D
