    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, everyone.

 

A colleague of mine pointed me at the Consumer Action Group. I'm not

sure how the topic came up but I mentioned to him that I had been

initially declined for a loan by AA Financial Services but the person I spoke

to said she would pass it on to the underwriters and see what they could

do. When she called back she told me that they had agreed but only if

I would take out the Payment Protection Insurance. I agreed because

I was desperate for a loan - I wanted to consolidate some debts and it

would make things a lot easier for me to manage. I didn't want to have to

phone another loan company and go through the whole routine again (giving

all my details, etc..). So, I agreed. I can prove it's out of character, I have

had many loans (from other companies) and it's always my policy NOT to

take out PPI so why would I in this case ?!?!

 

I thought that this practise of forcing people into PPI had only recently

become illegal so I wouldn't have a case to claim back the payments (on

a loan of £10k the insurance was over £1k).

 

I would recommend AA Financial Services. I was receiving

loan junk mail (i.e. sales leaflets) from them every couple of weeks.

I phoned them and wrote to them many times telling them I wanted them

to stop and in the end I told them I would take legal action if they kept

sending stuff. They finally stopped.

 

I'm so grateful that there's a consumer action forum, it's nice to see that

there are other people making successful claims in similar circumstances.

It has been a couple of months since I wrote to AA Financial Services

(part of Halifax/Bank of Scotland) . Today I received a cheque for full

refund of the PPI which I had been told was a condition of getting the

loan - Total repaid £2650

 

At the time I took out the loan I thought I 'smelled a rat' when I was told

I had to have the PPI. I should have just refused at the time but at least

the Halifax / Bank of Scotland did the right thing in the end.

 

Thankyou to ukaviator and the Consumer Action Group for all the useful

information. Without reading other success stories I might not have even

tried to get the refund.

Excellent news. My friends got a letter this morning saying the mis-sold PPI and interest etc of £20K is being refunded to their account. Seems the PPI wheels are well and truly turning:p

Which bank was that with Goldlady? .. That is a good amount to get back on PPI.

First Plus. The PPI was 13K on a 50K loan but only valid for the first five years of the loan. As soon as I saw the paperwork I smelt a rat:p
