Ananya - please don't panic - we are all here to support you and you have a good case for a further suspended possession - although you may not feel it - you are in a better position than some people who are facing repossession without income of any way out of it.

 

You are among hundreds of people who face this every day and most of them don't know where to turn,(I know that doesn't make your situation any better, but it might help to know that this is more common than you think) you have made a good decision in coming on this forum and you will get all the help and support we can possibly give.

 

I'm sure there will be times when you feel despondent, but that's what we are here for - to give you hope and support.

I know what you feel panic horror scared but dont if you follow the advice im sure things will work ou firstly get the application in you need it heard at least a week before the eviction date but give yourself time to prepare your case we are hear to help and Ive been there so know what you are going through

You need to send into the court the day before a witnes statement explaining how and why you want him to suspend the possession I am in court all day on Friday but will be around over the weekend if you need help

I am not sure if this will help at your stage but there is a good guidance section on arrears and re-possession on website direct.gov.uk

 

there are certain proceedures that have to be adhered to.

I cannot believe that there are so many people in the same boat as we are with Kensington Mortgages.

 

We have applied to the courts for a N244, which entitles you to sit down with a judge previous to the eviction date. Take advice from either CAB or Emergency Housing, as they have a wealth of experience would you believe with Kensington.

 

It may be worth while contacting CAB, or better still your local council and tell them you are on the verge of being evicted. You may find they could pay your arreas until you can sort out a repayment plan.

 

The emrgency housing people would prefer to keep you in your exisitng premisses, particularly if you have any dependents, as it is a cheaper short solution for the emergency housing people, as there is a severe shortage of properties.

 

Ultimately, albeit virutally impossible Kensington must be fought by a majority as opposed to a minority.

 

I can further add, that on investigation of Kensington Mortgages, they are in financial difficulty themselves, and were recently purchased by Investec (South African Company). This would explain Kensingtons eagerness to reposess.

 

I truly hope this advice helps you. Please let me know how you get on, as I am in the same boat as you with a reposession order looming.

Well, we got the eviction suspended! With some incredibly kind help from this forum, we put together a good application and statement which impressed the District Judge.

 

Kensington sent a solicitor's assistant, who didn't have all our paperwork and was working from a faxed letter from Kensington's legal people. She didn't have all the facts of our case and was left a little tongue tied at one point, which I found quite hard not to have a little giggle at!

 

I'm more than just a little bit relieved and extremely grateful for the help I've received :)

I agree with you entirely, but this would be the second time that Kensington have done this in as little as four months.

 

I am just hopeful that I may be able to use the opportunity to get the DJ to rule against Kensington, and furthermore prevent them from levying un-warrantable charges on my account.

One word about the charges, fighting the unfair charges while you're still tied to them is probably not a wise idea, wait until you can remortgage and then sting them for everything you can, it's what we plan to do.

Yet again, Kensington are taking us to court for repossession in ten days, despite all our best efforts to come to a payment arrangement beforehand.

 

In May 2010, hubby lost his job and we found ourselves unable to make payments, we told Kensington who, because I am disabled, put our account with their special needs team, whoever they are, to try and come to an arrangement, which didn't work. We even tried to convert the mortgage to interest only to reduce the arrears piling up, they refused. They only converted it when we asked for the third time and hubby had the promise of some work (which fell through), in September 2011. From when hubby became unemployed until a couple of months back, we have paid them what we can, when we can and have always kept them informed of our situation, including when we tried to sell the property, but found that we are in negative equity and so it would be fruitless.

 

However, in January, hubby started a permanent, full time job, with his first salary payment coming at the end of February. I wrote to Kensington, told them this and than ked them for their understanding. Little did I know what they had planned. It seemed as soon as they knew hubby was back in work, they instructed solicitors to start repossession proceedings.

 

When I rang them in February to make the first full payment, they told me that if we could come to an arrangement before the hearing date, we would not have to attend and the hearing would be postponed. We then went through the whole income and expenditure process, including providing copies of bank statements, and I was told over the phone that what we were offering (£100 extra) was affordable, it just had to be approved by head office.

 

Today we've had a letter telling us that they've declined the offer. When I rang them, their reasoning is that we can't afford what we have offered, saying there is a £7 shortfall. I argued that seeing as how we have made 2 full payments plus an extra £100 since hubby has been back in work, we can obviously afford it. In their letter they also have been quite rude, saying that we have a lack of commitment to make payments and that it would be in our best interest to resume payments. What do they think the 2 payments we've made already are?!!

 

Anyway, the upside is we are in court, again, in 10 days. We've replied to the court papers and have exhausted attempts with Kensington to make an arrangement, so I could really do with some help as to how to prepare for the hearing.
