      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My partner and I have recently stumbled across a problem. We bought a computer for the kids 3 years ago. . .an apple emac. At the time we took out the 5 year extended warranty (foolishly I hasten to add)

 

Anyway we've been doing a clean up and cleaning up old receipts in drawers and came across the receipt (which is the warranty) and recognised a problem.

 

The computer we bought or at least paid for was an emac with a combo burner i.e. burns CD's, reads DVD's. The computer they have actually given us, contains a "superdrive" i.e. burns CD's and DVD's therefore the product code on the receipt I assume would be different from the machine.

 

As things stand there's no issue, however as there's still almost 2 years left on the guarantee what are our rights should something happen to the computer in this period.

 

Would we lose our rights to claim under the warranty as we've had the benefit of a "better" machine or what.

 

Fingers crossed nothing happens and this is all immaterial however I thought I'd get some thoughts on this.

Yeh, I'd go with that. Ring or write just to confirm what product is covered.

If the OP writes and gets a written response, then either the OP will be aware that the warranty is inoperative, or s/he will have evidence to use at a later time. If s/he only rings, then there is no evidence.

Thanks folks I guess I'll go down that route.

 

I guess it's an unusual case was just looking for any extra ammo, as my gut feeling is they'll tell me I should have spotted well before this.

 

Given how much these products cost, I'd hate to think it was worthless and I could have cancelled 3 years ago and saved a few hundred pound!

 

I guess there's a lesson here to read things rather than dump things in drawers

Yes, indeed. I always check paperwork when I get it to make sure it's as I expect, which can be difficult if you don't know really the form it should take.

 

I suppose if it's their mistake they should rectify it but it's also feasible they might view the time scale as too long.

I guess in essence the fault isn't with the policy, it's the fact PC world gave us the wrong computer, admittedly a slightly better one (burns DVD's as opposed to CDs, if you do that sort of thing)

 

I'll speak to them soon see what they say, you would think this wouldn't be the first time this has ever happened.

You can always call them up and they'll refund the value of the rest of the agreement to you.

 

However, with an eMac, you might want to hang onto it. They have an extremely high rate of logic board failure, caused by capacitors on the board going 'pop'.

 

Even better, sell it (it'll be worth a lot more with the warranty) and get a newer mac.
