Bouncing pay cheque's

My current boss has a habit of bouncing the weekly pay cheque.

I collect my weekly pay off him on Mondays, I deposit in the bank same day,

By Friday, it is returned to branch.

This is happening almost every other week.

On the Friday that I find it is bounced, he then pay's me cash to cover the rubber cheque that he gave me on the Monday.

 

It has ruined my banking schedule, as I have d.d's to cover.

 

I have had two bank charges applied, which he has paid for me, but it has messed up my good record.

 

I am a bit miffed-off, my wife is fuming, and is almost demanding that i tell him I will only accept cash on Monday's instead of a cheque, until he sorts out his banking.

 

the weekly rubber cheques are around £400.00

 

What should I do, is it against the law to issue rubber cheques?

I would be looking for another job....

I'm sure it is against the law to issue a cheque when you know there are insufficient funds but I can't remember which law...have you told him you want cash not cheques in future?

I would also suggest you look for another job. Think of the future when there is no cash to give you on a Friday, and it will happen, you are really going to have your good record messed up then.

 

This is not about him 'sorting out' his banking, it is also costing him money to bounce cheques, but he obviously hasn't the cash to deposit into the bank or to give to you.

 

Be wary, be very wary. Employers exist for their own benefit not for the employees.

Normally when the boss starts bouncing cheques on his staff its a sure sign of the company going under.

It is against the law in the states to bounce cheques, but dont think it is here...civil matter I think. I wish they would make it an offense.

I would be at the jobcentre by now.

Changing jobs is quite a drastic move, a polite one to one chat with the boss, mentioning that the cheques are bouncing come pay date, hence to save embrassment to the company and yourself, could payment be made on thurs or fri in cash, this approach might not work but its worth a shot, and meaning you leaving the job when its not required...

You do-not state if this is happening with just you, or other employees aswell ? How big is the company, how many employees and is there a HR dept that this matter can be discussed with....

 

Writing cheques knowing the funds are not in the said account is against the law, but saying that, if the boss is expecting payments to cover the said cheques and he gets let down, then he isnt writing them unlawfully, as he has been let down aswell as yourself...

 

Don't leave your job just discuss the matter with him/her, this might solve the matter....

If its happening almost every week as you have mentioned..... I would at least be looking in the jobs section of my local paper.

 

Its not a situation I would like to be in but you have to be firm and approach the boss, explain it cant go on like this.

I wouldnt give my notice in untill at least you have another job to go to as the boss may be looking for peeps to fire just to help keep the outgoings down. one poster said the boss will be looking after his ass first..I agree...now start looking after your own ass.

There are 4 of us plus the boss, so quite a small company.

 

He seems genuine guy, but who can tell.

 

Well, I have made up my mind to leave.

I am not due back in work until Monday 7th, so I will just work a week or two, then give him a weeks notice.

 

I have booked a holiday for almost 4 weeks in Cape Town, from mid January, so when I get back I will look for another job.

 

I might have a job in the offering, so all is not lost, it is with a client that I worked for when I worked for the guy I work for now.

They said, (prospective employers) I have to leave where I am now, before they will employ me, leaving a gap, as it will look "head hunted"

So this holiday will be the "gap".

 

I just can't carry on in the current job with all the uncertainty of getting paid,

 

I also know that we are on "stop" with our 2 biggest wholesalers where we buy 99% of our material.

Now I am worried !

Good luck Firebird, I'm sure it will have worked out in your favour. In hindsight the boss may have done you a favour by involentarty forcing you to leave.

Hi all

{sorry to jump on your post m8}but the same is happening to me and others where i work,some people havent had there money for 3 weeks,as cheques keep bouncing..this is very stressful and i have bills to pay and did have a almost perfect credit rating,but its hard to keep juggling money about so bills get paid etc when u int got anything coming in...

 

 

we have spoke to the boss,and his first answer was if u want to work somewhere where u get paid on time u know what u can do..

 

he second answer was if u want to be made redundant then just say ;-( none of which any of us can afford to do,we just want to do are work and get paid for it...i am looking for another job,but i get paid well here{when i get my money}and i am not qualifed to do anything really,so making it very hard to find another job full stop let a lone one with similar pay,but will keep trying of course...

 

i just wondered if there is anything at all i can do??as there seem to be no talking to the boss,there are about 15 of us in this company we dont have a manager,union rep or hr dept ;-(

By the number of employees I take it this is a limited company.

 

Have you noticed any downturn in the amount of work you are doing? this will give you an indication if the company is struggling.

 

The pay cheques, are they proper bank cheques or are you just calling your pay chit a cheque.

A proper bank cheque is a promisary note and cannot be backed out of, even by a court, so look after them if that is what you are meaning.
