It's to late to defend, but a set aside should be more than possible as it sounds that you didn't receive any paperwork from the court.

You need to get all the relevant information from the court and make a start on this.

Be VERY careful whose advice you listen too

Where's DCA?

Arrow Global/MBNA - Discontinued and paid costs

HSBC - Discontinued and paid costs

Nationwide - Ran for cover of stay pending OFT case 3 yrs ago

RBS/Mint - Nothing for 4 yrs after S78 request

HFO need to be reported to Trading Standards and the OFT for this, they should not be doing it at all - if they are now using Croydon instead of Wimbledon County Court the people at Croydon will soon be fed up with them clogging up their system.

Report them pronto without informing them of anything, after all they haven't sent you paperwork or replied to your CCA so that is another reason to report them.

Sillygirl,

I think we might try another way. get HFO declard a 'vexatious litigant'. I'll look up the rules and post a new thread and invite contributions.

13. Bremer Vulcan v South India Shipping Corporation Ltd [1981] AC 909 per Lord Diplock at 917: “Every civilised system of government requires that the state make available to all its citizens a means for the just and peaceful settlement of disputes between them as to their respective legal rights. The means provided are courts of justice to which every citizen has a constitutional right of access in the role of plaintiff to obtain the remedy to which he claims to be entitled in consequence of an alleged breach of his legal or equitable rights by some other citizen, the defendant.”
