      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, this is going to sound like a strange question but here goes.

 

I've got a medtronic kappa DR 703 pacemaker, it's less than a month old. Recently there's been some concern over its healing, it was thought there was an infection in the scar and swabs have been taken. Last night I noticed a bump above the scar, woke up today with a 2cm loop of wire sticking out of the wound. I went straight to the GP at 9 this morning and she agreed I'd need a specialist to look at it. As my specialist is on the other side of the country she phoned his sectretary. Turns out he's in theatre so GP took my number and sent me home to await a phone call telling me what to do.

 

Me being me, and slightly paranoid about infection I've read and reread the manual which quite clearly states that this is an A&E case, problem is A&E on this side of the country refuses to take anything to do with pacemakers not registered to their own pacemaker clinic. I've waited 3 hours on the doctor calling and by the time she calls and I know what's happening, travel to Glasgow and the rest I wont see the dr before he goes home. Is it worth taking myself to A&E at the glasgow hospital and asking that someone sees me?

I know it's late, but I really hope you went to A&E.

 

I suspect the pacemaker issue concerns the actual workings of the device, wheras this is now an open wound that needs dressing and infection control.

 

No A&E dept can refuse to look at this, and I seriously doubt you will find any resistance.

Went to A&E here and they turned me away saying I was a glasgow case! went to glasgow and was put on antibiotics, they've changed the wire and i'm home to recover, bed rest for a few days :)

Nothing to worry about HC, this is my first pacemaker but i've had a few implantables, it's old news to me really, the idea of infection is scary as this is the first implant with wires going direct to the heart.

 

Was stuck on a ward with a load of pensioners then doctors wonder why I feel like a wee old lady lol.

awww no fair, ok fine not sure how the other half will react at my window shopping anyway. Yeah, guys make a better night than girls, in general girls spew too easy, I never throw up so how come that always makes me delegated hair holder??? Guys are also more laid back on nights out, can't stand bitchy girl tension. Give me a few pints down the tavern any day.

Spewing is just wrong. Sleeping on the sofa - never, i'm a guest so i get the bed! Dancing down buchannan street pole dancing with the lamp posts is about as drunk as i get. oh wait, there was that time walking down the high street in edinburgh and those bloody cobbles snapped off my heels so i started arguing with them (the cobbles)

LOL - I've been carried down Byres Road singing "I've got 3 legs" - while the two folk carrying me hopped and occasionally let one of my legs down to the ground to add veracity to the song. And when we all fell over it didn't even hurt.

ma mammy loves it when i go home to see her, she thinks it's brilliant to have the whole family at home - fruitcake that she is! A night out it is then the minute I can drink again, the hospital has me in again on christmas eve :eek: i don't care if the pacemaker is walking on a lead they're not keeping me in hospital over christmas!

Quite right! I'm going home to me ma's for Xmas as she likes to count her chicks and check they're all where she wants them. But after that I'll be well up for a party - as me dad is a preacher Xmas is nice, but not exactly kicking.

My mum loves having us all there 5 kids and 2 grandkids (both under 5, both holy terrors i kid you not). We're all catholic so we get to go to midnight mass (boyfriend included poor soul) and we go to morning mass and stuff but I couldn't imagine having my parents work at christmas, mums supposed to cook and dad has to help us assemble stuff then wrestle with the DVD player to get the game he always gets working, we've got him deal or no deal this year.

 

I'm hoping to be back in action early into the new year (just in time for exams yay!) and there's the court date for the first hearing then (i think i'll sign myself off sick). After that we should be grand for a drink. Just finished filling in 4 mitigating circumstances forms, uni are going to love me!
