Pay Review in Re Contract but Company not giving it to me - What do I Do?

I had a new contract drawn up for one reason or another and in it I had a clause that said that I would receive a pay review in October 2007

 

It is now December 2007 and I still have not received it - despite me reminding them and getting fob offs everytime.

 

I know that they are holding out for Jan when we receive our anual 2% increase and then say that was my pay review.

 

How can I enforce this review with them now?

Raise a formal written greivance reminding them that ultimately you could go to a Tribunal for breach of contract.

Does anybody know how I start a tribunal claim?

 

 

You can not start a claim in a ET until you have exhausted the grievance procedure.

 

Put the letter in and in the meeting point out their contractual Obligations. I’m sure they will see sense.

Be aware of any time constraints on going to ET (sorry don't have these handy at the moment) and make sure your company stick to any time scales in your companies grievance procedure. Be flexible but don't let them fob you off. If they don't allow you to go to the next stage in a reasonable time, ex. from stage 1 to stage 2, take it to stage 3 etc.

 

If you are a Union member seek their support.

Breach of contract can also be brought in the County Court as well as the ET, in which case you have 6 years to bring a case.
