Can anyone help please.. bought bed from Dreams bedstore but divan base will not fit up staircase in new house. All packaging intact etc but Dreams refused outright to swap for a different style, tried calling three times and pleaded with them but they have a no returns policy and I have a 5 foot bed in my lounge which cost £800 and chance of changing it. Be warned DREAMS are NOT going to help you if you have this problem. Any suggestions gratefully recieved.

Was this ordered by a distance (over the phone, internet) or was it instore?

 

If over the internet, you have rights of cancellation regardless of whether there is a problem or not, and should have no problem in obtaining a refund.

 

If it was ordered in store, then I would suggest that there is little that you can do. You have entered a contract to buy goods, and the company has supplied those goods. If there is not actually anything wrong with the item (ie, it is of the size, quality etc described), then the seller has no reason to issue you a refund. It is not their fault that your staircase isnot wide enough.

 

Your only chances are

1. To show that there is something wrong with what you have bought

2. that there was some midescription applied (for example, someone acting for the seller measured the item, measured your house and determined that it would be definitely possible to get the item upstairs)

3. some other loophole - e.g, that a credit agreement used to obtain the goods is unenforceable, or a clause in a contract allowing cancellation.

 

Don't mean to say "told you so", but the best way to protect yourself is to make sure that you will be happy with what you want to buy before buying it. I hope you manage to get it sorted, but I cannot see any blame attributable to the seller.

I have an ongoing problem with Dreams plc at the moment (like plenty of other people I understand) - including the fact I have been waiting for 10 weeks on a 14-28 day delivery. Dreams don't call you back or reply to emails. However I now have the email address of their MD as well as the home address of all of their directors. I have decided if I can't get a response from anyone else I will try the man at the top. I will keep you posted about what reaction I get and pass on contact details. Sorry, but I dont consider that Dreams are actually at fault here from the info given. The fact taht it is to big for a house is not their problem - it should have been determined that tha item was of a suitable size before ordering. If you have a shelf that can only support 10 kg and you order a vase weighing 50 g to go on it, it is not the sellers fault unless they said it weighed 10 kg.

 

I do extol the virtues of consumer rights, but there is responsibility to be taken as well.
