      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have sent away my SAR but I also sent a letter requesting they cancel my PPI and inform me of my new monthly payment. This letter was sent 2 weeks ago and I still have not had a response from them - how long should I give them? My next payment is due a week today - should I allow this payment to go through as normal?

Hello Fabio,

 

Did you give them any time limits when you asking that the ppi was cancelled.

 

I would maybe give them a nudge, and informing that your the cancellation started from the date of the letter that you sent, so therefore all further payments should be taken into consideration. Even if this payment does go through, you will still be able to reclaim it back with all the other payments that you have made:D

I didn't give them any timescales in regards to the cancellation so I will send them another letter. Thanks for the help.

 

I'll keep you all updated on how things progress. My PPI on this current loan is over £800 - this one started in February so near enough all my payments so far have gone to only paying this off!

Hi there, Welcome Finance are a nightmare - they apparently have a policy of not replying to letters!! When you write to them, make sure you send recorded delivery and then check it has been signed for on Royal Mail website (print off confirmation - you'll probably need it!). I ended up emailing copies of letters and recorded delivery receipts to the Chief Executive of their parent company Cattles - they soon moved then - the branch staff were falling over themselves to be helpful and the cheque for the PPI was received within 2 weeks.

 

If you get no reply to your letter please let me know and I'll give you the Cattles contact details. Also, be careful when they re-write your agreement, again let us know when that is imminent.

 

Are you writing to their head office or branch address? I have the contact details for the Compliance Officer at HO in Ruddington if you want it.

I didnt send my letter Recorded Delivery but I did send my SARS letter recorded delivery. I sent the cancellation letter to my local branch who deal with my loan. I will send them another letter by Recorded Delivery asking them to confirm the cancellation and also my new monthly payment. I will also put in the letter that if they fail to respond within 5 days then I will be forwarding all the details onto Cattles. After I have cancelled do I then send my request for my refund? Is it as simple as that?!?

Hi, You should ask for the return of all premiums paid to date when you send your letter of cancellation. If they don't respond (and the branch are unlikely to!) then send a letter to head office with copies of all your letters to branch and also copies of the royal mail signed for receipts. In all probability the branch will say they never received your letters so you need proof!

Hello Fabio,

 

As Ell-en suggested, do all letter now by recorded delivery.

After they have given you confirmation of cancellation then send you preliminary letter to them asking them to refund the ppi payments you have made to them. You have to quote your reasoning behind your reasons why it was mis-sold to you.

 

Now as for you asking is it as simple as that, yes it is, but you must be prepared to fight a bit for it and persist with it. They will more than likely deny it. So keep at them. Then comes your letter before action and if still nothing from them, ACTION, which is reporting them to the FOS (if it within their time restraints) or court.

Hi,

In a similar situation here, wrote to Welcome last month as I was sold ppi despite having existing medical condition (clinical depression which has recurred twice.)

Also told them to cancel my insurance immediately. I only got the loan in March of this year so haven't paid too much off so far but the ppi was of no use to me yet i was told i had to have it etc and from what i've read on here i am definitely not alone.

Anyhow, got letter back last week basically telling me to get knotted and that it was their final response etc. but no mention of the insurance being cancelled and they still took the full amount on my last payment nearly 3 weeks after receiving my letter.

Am really not sure what to do now any help would be greatly appreciated!

Hi there, what did you put in the letter you sent asking for cancellation? Did you use one of the CAG templates?
