Hi everyone

 

I have a question for my first post on here, regarding where I stand legally.

 

Myself and my partner are leaving our flat and to put it bluntly we simply don't trust our letting agency.

Our flat is old, musty and damp and the fixtures are falling apart. It requires real attention, not just maintenance, and the agency know this.

We just don't see them giving us our full deposit back.

 

So we'd like to just bugger off, frankly, leaving them the deposit. We live cleanly and have caused absolutely no damage to the property in any way, we are fully intending to pay off all bills before leaving and give the place a damn good clean too.

 

But we are a bit scared of the agency taking us to court over this - one quick google search and they can easily find where we are.

 

I have read our Tenancy Agreement and cannot find anything relating to the Tenant promising not to use the deposit as the last month's rent.

 

Does anyone think the agency is at all likely to bother with legal proceedings?
