Hi,

I'm new to the PPI board, I have just become aware about the miss selling of PPIs and would like to try to claim back the ppi charges I have been paying on my Debenhams store card.

I sent off a S.A.R letter back in May asking for a list of transactions and charges on my account as I wanted to claim back charges made on my account, all they sent was statements going back to Oct 2001.

Now my query is I opened the store card long before that but do not have a copy of the PPI insurance that I signed nor can I remember the date that I opened the account, do I need to send off for another S.A.R requesting all details that have on me including the agreement I signed.

or

can I just go ahead and make a claim for the monthly charges of PPI that are on my statements that I have.

I believe that I was miss sold the insurance as I was unemployed at the time and still am as I am a full time carer, I don't even remember agreeing to the insurance at the time I just thought it was part of the store card charges.

Thanks a lot

Hello Shar,

Hello and welcome, If you have sent them a S.A.R - (Subject Access Request) and they took the money, they have to by law provide you will ALL information that they hold on you. If you look on the bank template letter thread on the main page you will find a letter regarding non-compliance of the Data Protection Act. Amend it any tell them that you want all information which means statement from when the account was open, information regarding ppi and the credit agreement. Do not send anymore money as you have already paid them for this.

Data Protection Act - Non-Compliance - Template Letters

Now to get a copy of your credit agreement you can sent a request under the consumer credit act in costs £1 and again there are time limits on this for them to respond

There is no reason to rush on this, wait till you know the figures that you are going to reclaim and then send your prelimary request.

If you need help just ask.

If any of my posts are helpful, please feel free to click my scales. All information is given as my opinion only, based on my own personal experiences. I have no legal training, but have educated myself in aspects of consumer legislation. My motto "NEVER GIVE IN, NEVER SURRENDER", THERE IS A WAR ON YOU KNOW
