Hi,

 

Wonder if some of you clever people could help me with a suitable reply to a CCA request I sent to Link. I am in a DMP but they sent the letter requesting we allowed them to put a volountary charge on our house (as they say they know NR are trying to and they need to protect their interests ) so to cut along story short we CCA'd them on the 5th Nov .using the template on this site (saying only to use the postal order for the cca request ect) I cant copy and paste but here is how the letter reads:

You recently made a request under Section 77/78 for copies of various documents.

 

As you are aware Asset Link Capital purchased your debt from GE Capital 0n 29 March 2007and as such we do not always hold this documentation. We have requested a copy of he agreement and the most recent terms and conditions your account was operated under from GE and look forward to sending this to you in the near future, however please be advised that this can take upto 30 days to provide.

In order for us to progress your request for copies of statments we require some additional information from you. Please can you either write or fax the calander months you would like to see and we will proceed to order them from the original creditor.

 

No administration charge has been applied to your account at this time and therefore the payment made with your request has been applied to reduce your outstanding balance. However when cost is incurred by link for the provision of any statments by the Vendor we will pas these charges on to you.

 

Your account has been put on hold for he next 14days for you to contact this office with furher details as requested above

You don't really need to reply. You have sent them a legal request and it is up to them to deal with it in the statutory timescales.

HAVE YOU BEEN TREATED UNFAIRLY BY CREDITORS OR DCA's?

 

BEWARE OF CLAIMS MANAGEMENT COMPANIES OFFERING TO WRITE OFF YOUR DEBTS.

Yes. After the 12 working days from receipt they are in default and can't lawfully pursue the debt. After a further month they commit a summary criminal offence. The timescales are determined by statute.
