i sent capital one a sar.

date on cheque 21/july/07 for £10.00 sar.

the cheque was cashed 10/aug/07.

this was taken of my balance as it shows on my statement.

i still have not recieved my statements that i requested.

they have gone well past the 40 days.

:confused:

If it has reached the 40 days and you still havnt recieved the statements, then you need to send the non compliance letter.

This gives them an additional 7 days.

gone well over the limit aint they. if i was you i'd send the letter before the lba.

i think thats what your supposed to do, or wait to see if someone else pops along to tell you what to do.

 

 

You can't send the preliminary as you don't know how much they have charged you, hence sending the SAR in the first place :confused:

 

As SeasideLady said, send them the non-compliance letter.

NatWest - WON! £3350 Paid back

Vodafone - Default removed

Citicards - Judgement awarded for £1898, default remains though...for now....

Capital One- WON! Settled out of Court £392 + Default Removal!

could someone advise, sent of the non-compliance letter as we have not recieved statements as capital one way past deadline.

 

they have recieved non-compliance letter but not still sent anything and their 7 days are up.

 

what do i do now? as i have never gone this far with my other debts.

would be grateful for advice. thanks.

Are you sending everything signed for?

NatWest - WON! £3350 Paid back

Vodafone - Default removed

You could try a call to see when they intend to send them, stating you are prepared to file at court. Failing that, you can file at court for them. Here is what you need.

You do claim this fee back aswell, but if you are claiming certain benefits you will be exempt.

what do i do?

print out the n1 form and fill it in?

do i take it to the courts and hand it over to them or do i send it to capital 1?

 

sorry to be a pain but never made a claim before and never filled one of these in / hence newbie.

Yes you can print out the form and fill it in, But if you fill it in on line, remember it wont save it, so make copies.

 

Yes take it to your local COUNTY court.

 

You can also put a complaint in to FOS.

You are not a pain, ;) If you get stuck it is easier if you ask, as mistakes are harder to fix.
