Having completed all my personal account, I decided to go after Natwest for the business account. I have completed the letter sending stage, the filing, beat thier Solicitors in thier attempt to obtain a stay and am now in the process of compiling the bundle. The amount claimed is just shy of £50k. Once I am successful with this one, I intend to reclaim the previous 11 years for which I have the statements for.:-D

Way to go. It's no wonder that British industry is on its knees with banks so intent on destroying businesses! I am after 2k from Natwest and 2k from LTSB on business accounts but you have just reminded me to look at our old partnership accounts to see how much we should be reclaiming from them.:D Best of luck.

Just make sure your claim is airtight. They will try to pull it to pieces. I was sucessful with Nat West with my business claim which came in at £25. Don't be scared to ask anything however trivial it may seem. Good luck.

I have the the T&C's for 2002 but not 2001, and Natwest kindley sent me a copy of the current ones when they offered £8k F&F which I chose not to accept.

Hi lula,

 

I have gone for Stat interest. Although I have gone for contractual on my personal claims on the grounds of Custom or Usage I didnt have the courage to go for contractual on this amount. I did input it onto a contractual spreadsheet and it came out at £120k which scared the living daylights out of me. Has anyone any experience of the witness statement for the bundle?

Oh bugger. just re-read the court directions. Bundle due on by 4pm 8th not 26th as i had previously read. The 26th is the date on which the negotiation period ends. Any help with what must be in my statement will be gratefully appreciated. It looks like it will be a long night.

You will need

 

1. the basic court bundle from the templates thread (minus all the consumer stuff naturally)

2. Your schedule of charges

3. All the statements which are referenced in the schedule

4. Bank T&Cs

5. A statement of evidence - a basic outline of the case:

 

a) that you had/have an account (details) with defendant (between dates)

b) that they levied charges in respect of purported breaches of contract (unauthorised OD, referred DDs etc) listed in the schedule

c) that the T&Cs they believed entitled them to do this are such and such - quote T&Cs

d) the charges levied are far in excess of any damages they incurred as a result of your breach of contract (list evidence from court bundle)

e) the charges are therefore unlawful penalties at common law (quote cases - Dunlop, etc)

Hi Ed, we got our charges back from Natwest yesterday - well the offer letter anyway. Limited company account, but only £1800 and nothing like the amount you are after. They said they would respond within 8 weeks and they did - if you add on an extra day or so for weekends. They would not pay the interest we claimed but we needed the money so were quite happy with just getting the charges back.:D Keep on trucking.
