    • Thats because this claim has not been allocated as yet hence the above hearing *Case Management " to determine the directions (N157 Notice of allocation) which will follow after this hearing. You are not requested to submit a statement but have all the details with you (claim form defence CPR CCA etc etc)   Andy
    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Although you say you didn't sign any ageement you should have and you should still request a copy of this from your card company this agreement also will state your request for PPI. There is a standared letter you can print off but you must send £1 to make it a legal binding request plus also send it recorded delivery this document is very important to your case.

 

I would do this ASAP.

I can see that Lizzy has given you great advise and support . I agree you need to get all of the information to pursue this claim if you are going to do it properly.

 

Sent the SAR and get all the info they hold on you and the ca request. This will cost you a Total of £10 for the SAR and £1 for a copy of the origingal credit agreement, but money well spent. Your have to speculate to accumulate, if you know what I mean.

 

This does unfortunately take time, but we have all the time in the world. This will not happen overnight, so preparation is the key word in these matters.

 

You will get lots of help, and support on here, so take the plunge.

Ok, I sent my CCA request on the 7th Nov (dated 6th Nov) and today should be the 12th day. So if i get home tonight and they haven't provided a signed copy of the CCS then what do i do?

 

i can't really proceed with a claim detailing an exact figure of how much is owed because I have also sent off for the SAR and I know that can take up to 40 days to receive that, so what do i do?

Yes I am here,

 

Ok so the 12 days are up, so they are in default, therefore the account is in dispute, and you would be within your legal rights to stop any payment to them, until they come up with it. This may not be without repercussions though. They have a further 30days +2(postage) to supply it or they will be in criminal default and you would need to report them to the OFT and trading standards.

 

So I would just allow the time to tick bye now.

Ok, so 31 days after I sent my CCA I received the full S.A.R - (Subject Access Request) batch of statements.

 

I've sat down and calculated that they owe me £628.23 (without Interest) or £805.05 (with the interest added)

 

So, what's the next stage now?

Do I need to provide a schedule of the charges like you do when claiming for bank charges ?

Ok... sent the letter on the 17th, with a schedule of charges and then received a letter just thanking me and saying they had received my letter and would look into it.

 

Then a few days ago I received another letter from customer services representative who said they are investigating my case and will get back to me in 4 weeks time.

 

It's well over the 14 day period that I initially gave them but they HAVE acknowledged my letter. So what's the next stage? What should i do?

Personally, I like to be in control of my claims so I would go down the court route. However, the court route inevitably costs money, and does expose the litigant to costs being awarded if the claim is unsuccessful - whilst the FOS route is free - but may take longer.

 

It has to be your call.

I received a letter from Lloyds TSB today which basically contests my previous letters sent to them.

 

The basic contents of the letter state that I was sent a policy document, monthly statements and I was well within my rights to cancel the policy within the grace period. Therefore they are NOT going to refund my payments.

 

They have also magically produced a signed agreement form dated 24th Jan 2001, but stamped 30th Jan 2002?? Furthermore, the form has quite clearly not been completed by me (the handwriting is totally different) although my signature DOES appear at the bottom. The income information is totally wrong (way ABOVE my actual income at that time).

 

I'm really suspicious of when this agreement was signed as I don't remember signing anything for the payment protection, but I DO remember being sold it over the phone.

 

I have most of my old payslips which cover this period time whilst I was paying for the protection cover and I wasn't working the minimum required 16hrs so thats gotta help right?

 

So what do i do, should I reply to this letter or just file a claim with the courts now?
