Okay, I need some advice from anyone in the know.

 

A year ago Virgin Atlantic were meant to fly me to New York, and there I was to catch a flight with American Airlines to Miami for a wedding.

 

In the departure lounge a Virgin rep told us we were going to be delayed. I approached this lady and asked her what would happen to me as my flight to Miami left three hours after we were due to arrive in New York. She told me, that despite the two flights being seperately booked, Virgin would take responsibility for getting me to Miami before the wedding. I thought this was very good of them, but also that I was being somewhat misled. I took the liberty of asking the same lady to repeat her statements, whilst slyly secretly recording her on my mobile phone.

 

Needless to say, Virgin DIDN'T make sure I got there on time and I missed the wedding. They also won't let me send them a copy of the recording, or give me any kind of compensation over £100.

 

So, what are my rights regarding playing this in a small claims court? Is there an independent adjudicator I can approach?

 

The recording is time and date stamped on my mobile. Thanks for reading!

Hiya sorry you missed the connecting flight forwarding you to the wedding.

Doesn't your insurance cover you for delayed or cancelled flights? okay you reached your 1st flight all be it delayed, the connecting flight was missed, therefore your insurance should cover you for the missed flight. I'd read the small print in your insurance documentation, you might find your covered by that. As for Virgin making any form of compo, you could apply to there good nature and explain the cirmcumstances, you might just drop lucky. But i'm rather certain your own insurance will cover such.

All advice is given through own opition, also by seeking/searching info on behalf of poster, and own personnel dealings.

V will probably settle before it gets to court, however do be sure you have the name of the person you spoke to as a transcript (and recording, if called for to corroborate the evidence) as it could be very easy to make a fake recording and attribute it to an unnamed Virgin employee.

I have to ask, if the said flight took place a year ago, why wait till now to raise the question?
