Paypal question.

Hello everyone,

 

Just a little query about Paypal.

 

As you may know, Paypal has done a runner to Luxembourg, and no longer maintains an office in the UK. Can the Small Claim's Service at the County

Court still be used to make a claim against them ?.

 

I remember reading that one of the requirmets of the Small Claim's Service, is that the parties involved have to be domiciled in the UK, i've spent hours searching for this in print, but without any luck.

 

I found this in Paypal's User Agreement;

14.3 Governing Law and Jurisdiction.

This Agreement and the relationship between us shall be governed by English law. For complaints that cannot be resolved otherwise, you submit to the non-exclusive jurisdiction of the English courts arising out of or relating to this Agreement or the provision of our Services without prejudice to your right to also initiate a proceeding against PayPal in that context before the competent courts of Luxembourg.

 

Seems a bit strange to me, we have to agree to English law, with a Luxembourg based company, but cant get them in an English court.

 

Any advise appreciated.

Who has said you 'cant' take them to an English court?

They still have a registered uk address.

but I would still use the luxembourg address and can send any letters by Airsure.

 

It just means they have to provide a lawyer in england for the case

Thanks everyone for all the info, but i'm still not sure if the Small Claims service can be used with a company thats not based in the UK.

 

All the Paypal companies that are registered at Companies house, are not the same one that is registered in Luxembourg.

Paypal are still regulated by the FSA.

With that in mind theres always that route.

I may be wrong but I thought they were now regulated as a bank by the Commission de Surveillance du Secteur Financier?
