    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

ty so much for this, I didn't know where to start as the loan was taken out by my husband while we were seperate for a while and I dont know how he managed to be accepted, but this way I can get all the information off the company themselves ty so so much

PPI is normally arranged via separate organisations, does this letter go to the bank or the separate PPI organisation?

 

Whoever sold it to you:D They are the ones that they made the profit on it for their unjust enrichment. These policies were sold on a lets make commission or reach target basis, and millions of pound were made in profit for these companies and banks. Did I just say that pppfffttt:D

The loan agreement is what you need to look for. This document is required to specify the amount that you have borrowed together with any anciliary charges which have been added to the loan. This will include total interest payable, your monthly payments and any insurance products you may have attached to the loan.

Hi,

 

I have submittes your S.A.R - (Subject Access Request) and the bank still has not got back to me. I sent the letter 16 days ago. What should i do? I have also noticed that although i cancelled my PPI 2 months ago, the bank is still charging me this protection cover.

They have 40days to comply, so tick, tock. I would also write again to them and remind them that you cancelled the ppi two months ago and you wish written confirmation that they have done so:D Can you post your questions on your thread, so that we can see the whole picture on it please:D

Just wondering would this include recording of telephone calls, Egg are saying they cant find mine.

The information they should provide is all information, this includes any recordings of telephone calls and transcripts of these calls.

 

If they do not have them, don't be discouraged, it may be more to your advantage, in that they have no proof:D

What is the difference of PPi and LLP(Loan for Loan Protection Insurance)?

 

I believe these are one and the same. PPI payment protection insurance is supposed to cover you for periods off work through illness etc but a lot of policies do not cover certain exclusions such as unemployment, self employment, pre existing medical conditions, over retirement age etc etc and are therefore not worth the paper they are printed on:mad:

 

LLP or Loan for Loan protection Insurance is I believe the same thing but renamed ie you will take out a Loan for x £ then you will be required to take out insurance to protect the capital on this loan.

 

So you borrow for example £10,000 that is ok but the banks to make money then require you to take out a protection loan to cover repayments in the event you cannot make the payments due to illness etc.

The cover sadly is not always appropriate and does not always pay out leaving the borrower in a bit of a pickle.

 

You are effectively taking out another LOAN to protect the initial loan of £10,000 the figures are added together and interest is added on for the life of the loan say 60 months if you pay the loan off after 24 months you are effectively still paying the interest on the loan for another 36 months. This means the banks are making a huge profit and your policy would not cover you.

 

Sorry for the long post but PPI is a very emotive issue.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Alanalana thanks for clarifying that, with out hijacking this thread Lloyds tsb have added £6,071.40 + 6.9% interest on my current existing of Loan £26485,20 including 6.9 % interest would it be wise to send a cca request since I'm still making payments this loan and have made 25 monthly payments todate of £550 from 10/2006? or is there a thread with a similar case to mine?

Yes to the CCA request.

There will no doubt be cases like your own. You are in the correct forum for the PPI issue but your own thread means you will get direct assistance without having to hunt for information.

 

Also have a good read of other threads and it will give you the general picture of the process.;)

Hello, Just a quick request for help and to check wether ive done right or not concerning PPI.

 

Heres the letter I sent to Halifax and I will type the their answering letter in afterwards, sorry for jumping on here If a mod would kindly start another thread with this I would be grateful.

 

Here's My letter

 

I purchased the above policy from you in [Febuary2003] in connection with the [loan agreement] referenced above.

I believe that I was mis-sold this policy for the reason(s) given below, and wish you to investigate my complaint according to your normal complaint procedures.

I was not told that the insurance was optional.[/font]

I was led to believe that my application for credit would be rejected if I did not take out the insurance.

The policy exclusions were not explained to me either before or at the time I took out the insurance. I was therefore unable to make an informed decision as to whether this insurance was appropriate for me.

I now believe the insurance was unsuitable for me as I was [self employed] at the time I took out the policy and was not made aware of the specific exclusions relating to unemployment cover.

If my complaint is upheld I require a refund of all premiums paid to the policy, plus any additional interest charged to me because of the PPI. I would also like to claim statutory compensation in view of the fact that I have been deprived of the use of this money.

Please now investigate my complaint within the eight weeks allowed to you.

Now when I took this loan out I was working full time, then I had a serious accident at work which made me diasbled for life, the halifax knew this because of doctors and specialist letters, which I supplied as I thought when needed, now I cannot pay this loan at any price and its been handed over to Moorcroft &*&&^ heads who are badgering me,

 

I thought that the insurance would kick in with payments because i couldnt work.

It has never happened Im 1986 pound in arrears and like I said I cannot pay a dime, I have 2 daughters and they seem to take up every penny and what with living expenses getting worse. I really feel like cutting my throat.

 

any help or advice would be gratefully received.

Hi Folks just thought I would update my last message with Halifax's answer to my letter post #24

What I need to know how is what di I do next ie I have tried to work out what they owe me and I dont understand the CAGs Spreadsheet for this. So any help would be apprieciated.

I refer to your recent complaint regarding the Payment Protection Insurance (PPI) on your Halifax loan.

 

First, on behalf of Halifax, please accept my sincere apologises that you have felt the need to complain. All such complaints are taken seriously indeed and to ensure I have understood and therefore addressed your complaint, I will now take the time to summarise your concerns.

 

You believe you were mis-sold insurance taken out with the above loan agreement for the following reasons:

  • You were not told that the insurance was optional

As part of my investigation into the sale of your PPi, I have considered the information available to me.

 

Having do so, and in view of the fact that you are a valued customer, I have decided to pay you an amount which will put you back in the position you would have been in had you had not taken the insurance. This is done without admission of liability and in full settlement of your complaint about the PPI on your loan.

 

Where an account you hold with Halifax is in arrears it is our Policy to offset the amount of redress we are offering against any currently outstanding balamce. By taking this action wea are helping you to ensure that interest and / or charges in relation to your loan are reduced. Therefore, if you are in arrears, the redress will be used to reduce or clear the arrears and any surplus will then be paid to you.

 

It is anticipated this payment will be made within the next month. If at this time you hold an open account. If you do not hold an open account with Halifax or Bank Of Scotland the settlement will be paid to you by cheque.

 

I trust that this offer has addressed your complaint fully, however you can of course contact me directly on the telephone number at the top of this letter should you wish to discuss any aspect of my review further.
