Hi All

 

Haven't been on here for a while as my case was heard back at the end of August and the judge ordered a stay, bit disillousioned at the time as the judge sat there arguing against the stay for me, but then gave them it anyway!

 

Anyway, the judge was kind enough to award me costs for taking a day off and ordered that the bank pay me £50, however when I received the letter and cheque from Barclays they included a letter that stated 'As requested by our head office, I enclose a cheque for £50.00 in full and final settlement. I trust this now concludes matters'.

 

I haven't cashed the cheque as this doesn't conclude matters due to the fact my case has been stayed.... was wondering what the best thing to do is, should I write back to the person who sent the letter enclosing a copy of the court order, or should I contact the litigation team.... don't want to make the wrong move and jeopardise all the hard work I've put in so far.

Hi YNWA,

 

I don't think bank is trying to pull a fast one here. However, write to the letter's sender with copy of order for your costs and say, "I accept your payment of £50 in sett't of the costs you were ordered to pay for my time attending court as per the enclosed copy Order.

 

" My claim against Barclays for the return of unlawful charges has been Stayed and will continue in due course."

thanks for getting back to me, I will certainly so that.

 

How long do you think I should leave it before I cash the cheque.... is starting to burn a hole!! :)

 

Yeah was a bit lucky with the costs.... shame he awarded them the stay thou!!
