    • Ok you are in the clear. The PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 for two reasons. The first is that in Section 9 [2][e]  says the PCN must "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges ". It does not say that even though it continues correctly with blurb about the driver. The other fault is that there is no parking period mentioned. Their ANPR cameras do show your arrival and departure times but as that at the very least includes driving from the entrance to the parking space then later leaving the parking space and driving to the exit. It also doesn't allow for finding a parking spot: manoeuvering into it avoiding parking on the lines: possibly having to stop to allow pedestrians/other cars to pass in front of you; returning the trolley after finishing shopping; loading children disabled people in and out of the car, etc etc.  All of that could easily add five, ten or even 15 minutes to your time which the ANPR cameras cannot take into account. So even if it was only two hours free time you could  still have been within the  time since there is a MINIMUM of 15 minutes Grace period when you leave the car park. However as they cannot even manage to get their PCN to comply with the Act you as keeper cannot be pursued. Only the driver is now liable and they do not know who was driving as you have not appealed and perhaps unwittingly given away who was driving. So you do not owe them a penny. No need to appeal. Let them waste their money pursuing you . 
    • If Labour are elected I hope they go after everyone who made huge amounts of money out of this, by loading the company with debt. The sad thing is that some pension schemes, including the universities one, USS, will lose money along with customers.
    • What's the reason for not wanting a smart meter? Personally I'm saving a pile on a tariff only available with one. Today electricity is 17.17p/kWh. If the meter is truly past its certification date the supplier is obliged to replace it. If you refuse to allow this then eventually they'll get warrant and do so by force. Certified life varies between models and generations, some only 10 or 15 years, some older types as long as 40 years or maybe even more. Your meter should have its certified start date marked somewhere so if you doubt the supplier you can look up the certified life and cross check.
    • No I'm not. Even if I was then comments on this forum wouldn't constitute legal advice in the formal sense. Now you've engaged a lawyer directly can I just make couple of final suggestions? Firstly make sure he is fully aware of the facts. And don't mix and match by taking his advice on one aspect while ploughing your own furrow on others.  Let us know how you get on now you have a solicitor acting for you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just a quickie i waited til the full 14 days were up even though they replied after 5-6 days before sending the l b a now sent the lba and again they replied after 5 days basically saying there is little else they can say from their previous letter and that this is their final response and suggest that i refer my complaint to the financial ombudsman serve. funny one paragraph in the letter says quote"although i do respect your opinion about our charges" and this letter was from a different person this is from jamie oneil. so shall i just complete the money claim online now and not wait til the 14 days are up again? thanks for your help

Personally, once I see "Final" on any document from a bank I enter the claim. You have been resonable.

hi, im new to this site,although i joined a few weeks ago and found your template leter which greatly helped me with confidence to write to lloyds.

I have been with them for about 5 years ans just looking back over 2.5 years statements they have charged £1300, iwrote with your format letter and had a reply in 6 days, basiclly saying i signed a contract with the bank when i opened my account.And they were sorry i felt i had a complaint.

What do i do next.?

I am a divorced woman and have been in receipt of disability and income support which are the only credits into the bank( they are not always paid in on time either which causes me to go overdrawn with direct debits set up for the days following expected credits).

I have struggled to pay for food or for travel costs to hospital appointments (a lot have had to be missed due to thier charges taking away sometimes a weeks money.

Any advice would be greatly appreciated.

Welcome Annie. We are all in this together. Firstly read the FAQ section. Then use one of the templates to request all of your statements back to 2000. Then calculate how much the filthy swines have taken. Then you send another letter, again using one of the great templates on here. Remember Annie, we're all in teh same boat, helping each other along as we go.

 

If you are unsure, ask on here. You will be helped along the way. :)

It's best if you start your own thread so you (and we) can track your progress, questions and answers. Do this by going to the main page for whichever bank you are making your claim against. At the bottom of the page is a "New Thread" button. Click on it and away you go! At the moment, you have unintentionally :rolleyes: hijacked jon700's thread. Read the FAQ's and as many threads as you can - take your time - to make sure you recover what is rightfully yours.

which format of letter requesting list of charges and statements template do i use to send to lloyds?

I am unsure also how to inform you of my actions, as other users seem to be doing?

Again this week I have been charged £35 for being £1.29 O/D which has come out of disability and income support benefit received leaving me in a mess again. I can't seem to catch up!

Hi annie44. I'd suggest you read the Frequently Asked Questions forum, in particular the Step-by-Step Instructions, the FAQs themselves, and the Rules of Engagement. You'd do well to read the other threads in there too :)

 

Once you've got those under your belt, take a look at the Bank Templates Library. It contains all the letters you should need to see your claim through to the end :D

 

To start your own thread to keep track of your claim, go back into the main 'Lloyds Bank' forum, and click on the 'New Thread' button near the top of list of threads. Put your subject in - "annie44 vs Lloyds" for example - write your post, and away you go.

got letter this morning and they are intending to defend but have noticed that they are not using mj as with most of you they are using a company called sechiari clark and mitchell based in brighton has anyone had dealings with these guys? let me know if poss thanks j

Yup they have jon - SCM have been handed cases for the last week or so, as I'm guessing MJ are swamped with cases at the moment :)

as i said previously they (llooydstsb) acknowledged on the 4th of july and have 28 days to file a defence(deemed to have been served on the 2nd of july) so have to wait til the 30th.do they normally wait til near the deadline or do they give it plenty of time? its a bit of a pain as going away for two weeks as of 2nd august so hopefully this wont be a problem for replies etc. if anyones got info would be great to hear thanks

Tried ringing them today bloke who was dealing with my case not in ,can they have my number to get back to me.If they try this with you let them have it but put your point across so they can have time to think or act on it before getting back to you.(they haven,t got back to me yet) but i feel i,m getting more ready for them as every damn hour goes past ...

sorry to be a dumbarse but my court papers show the court as northampton as a small claims shouldnt it be closer to home ie southend? or shall i just write to northampton? thanks guys

 

It will be transfered to your local court eventually.You can ring moneyclaims helpline and ask them who you need to write to or if they can put your holidays on the file.

well received the aq forms and their defence today and they are going to counterclaim......but they have not paid the fee and if not paid within 10 days then it will be struck out has anyone else had this? also there was no counterclaim enclosed with the forms so will try to call the court on monday to find out the details. am going on hols on the 2nd so will inform the court at the same time as the form has to be returned by the 8th of august.the defence is signed by alan ingledew of s c m. if i can bribe one of my kids ill get them to scan the defense and post it any feedback or anyone else in the same position your comments and suggestions would be appreciated thanks jon

I sent Lloyds the request fro my charges at the end of June. I have received the relevant info today but I don't know what to do next! Do I just add up the charges and request that amount? Everyone is mentioning interest, How do I calim that back too? I'm still so new to this and would appreciate any advice Thanks, Donna xx:?

Both in the same boat mate! I compared my defence against what reload posted a while back, and they are word for word apart from one para, which was specific to reloads original letter. Like you I am phoning on Monday to find what the craic is - but it does seem to be a new tactic! Mods - any inital thoughts?

well its now thursday and have just rung the courts to find out about the counter claim and its not on the system and they seem to think that its an error by northampton as there is nothing showing apart from their defence!! anyoneone else got similar news??? what bout you mr homershairdo?!! jon

I got my acknowledgement of service today they put in their letter to the court

they are preparing their defence and counterclaim:confused:
