hiya all.

 

i was wondering if someone could help me out with a reply i need to send to cabot?

 

I sent a CCA to Barclaycard in December and have as yet not received a credit agreement. obviously i know this has long since created a default for them and since an offence, but nevertheless they have this month sent the account to cabot. So, i sent a CCA with £1 to cabot over a week ago, and as a reply i have been sent a letter saying as they are not the creditor, they do not need to comply with a cca, but they have asked teh OC for a copy which might take some time as it may be archived.

 

i know from previous help on this wonderful site that they are fobbing me off and they DO have to comply, but could someone please help me with the wording of the reply to send? my mind went blank after 'yes you do, time limits still apply'. lol

 

any help much appretiated, thank you!!!!:confused:

Personally I wouldn't reply, but wait for them to default. My opinion is the same as some others here: if Cabot deny being the creditor then how the heck can you possibly be the debtor?

  • Barclays: WON!!! It took four months but was totally worth it!
  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!
  • Elephant.co.uk: VICTORY - they admitted there was no debt!
  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

Actually, they say they are not the creditor for a very good reason. This is because they use the Law of Property Act to purchase the rights but not the duties. May I suggest you write and say this account is in dispute with Barclaycard and you will not correspond with them until that dispute is resolved.Then pursue Barclaycard under the CCA you requested. If they do not respond make a complaint. They cannot sell a debt that is in dispute and I would suggest you mention that to Barclaycard too. Wait until you have a response from Barclaycard - it will come eventually I'd imagine, then come back here.

The Cabot Fan Club will keep an eye on you - won't we Mr Maynard? :D
