Hiya's I need some help, my daughter got a contract phone from 3, this was all done over the phone, no signing of any contract. She dropped it accidently and now the phone turns it self off, you can't read the screen because the screen is broke and the phone is falling to pieces. Phoned them up to come and get it, they come and got it, sent the same phone back, said that they could not repair it, but still have to pay the bill for a phone that is useless, any help greatly appreciated.

 

Was an 18mth contract only had it 3mths.

The fact is was purchased over the phone still means there is a valid contract in place. Did she take out the insurance on the handset? If so, claim on it - if not, then she'll need to buy your own replacement. Your SIM card will be allowing network service so no refund would be due. By far the best way forward to to purchase a s/h 3 phone on eBay or from a dealer than sells 'pre-loved' 3 handsets. It also might be useful to buy a case for it which offers some protection from misuse.

 

Just noticed your amendment. There's no issue with the fact she wasn't offered insurance either. It could have been added to a household policy instead. The bottom line remains that she did break the phone, so has to be responsible for her actions. Incidentally, a number of firms DO offer flat-rate repairs, so it might be worth looking to them as well.

3 network tend to sell pay and go handsets very cheaply.... this might be a better way to go than e bay, new handset with warranty and your contract sim should work in it instead of the pay and go

The most laughable thing is they offered her an upgrade but she has to pay £150 for a new handset.

It would still be a top flight phone AND subsidised (and they'll probably re-start that contract term to 18 months), but when all is said and done, it wasn't them that broke the original!

 

Mobiles aren't the disposable item most folk think!
