Can somebody clarify this for me. On the application form/credit agreement which Barclaycard sent me in response to my CCA (not sure which it is, but looks like an application form - they also sent T&C's which look like they are dated 2005 whereas my application was in 2001/2) my signature is clearly visible, however nobody appears to have signed this on Barclaycard's behalf, I take this to mean that even if it is my CCA it wouldn't be valid as there is no signature - is this right? Really want to make sure i've got all my facts correct. Thanks :)

The signature can be omitted on a copy sent in response to a CCA request, however if they came to rely on it in Court they'd need to provide a true copy of an executed agreement with sigs in place.

If the sigs are missing on your copy then they almost certainly don't appear on the original - but there's no way of knowing for sure.

But. But. Does the document contain the required prescribed terms? Have a read of this thread and see how yours stacks up.

Is it possible to scan it (blanking out all personal details) and post it to something like Photobucket so we can see it?

  • Barclays: WON!!! It took four months but was totally worth it!
  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!
  • Elephant.co.uk: VICTORY - they admitted there was no debt!
  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

<--- If I've been helpful please remember the scales ;)
