  1. Hello. A friend of mine has asked me to look in to the insurance policies that she has just realised were sold to her when she took her mortgage out back in 1998. From looking at the paperwork I can see that there were various forms of insurance but what strikes me straight away is the phrase 'Premiums are recovered from your monthly mortgage repayments. Separate payment is not, therefore required. Please amend your payment when advised'. Does this mean that the insurance was added to the mortgage, and by doing that, my friend was charged interest on both? Apologies for the naive question.

    Where is my money?

    Ok a bit of a strange one. A friend sent me 10k to purchase a car via BACS (as it was coming from his business account) This was on the 7th February, after 5 working days (14th February) the money had not arrived so I chased my friend who contacted TSB and they confirmed the Fraud team from Metro had been in touch but they confirmed the money was legit and confirmed Metro have the funds. I contact Metro who say they don't have it. Any Ideas?
  3. Hello, I will be grateful if you can please help me if there is something I can do with this notice please. On 23/12 I went to Kensington high street, whilst looking for parking space I saw a sign (attached) and empty space saying No stopping at any time except 7 am - 4 pm, P for 30 minutes. I safely parked my car which was left there for about 15 minutes. I then returned and made way home. I am now in receipt of this notice (attached). I went back there and saw two conflicting signs and wonder if I could successfully challenge it or it was just my sheer stupidity :/ Thank you for your help in advance.

Hi, I was hoping if someone could give me some advice in best way of tackling the damage to my property caused by my local council this morning. :-x:-x I came home this evening to see my rear gate in the garden which leads on to the access road at the back of the house broken, as well as brick wall knocked down. It appears this morning around 11am one of those caged type vehicles operated by the council was collecting rubbish along the road. From the CCTV footage I have (link below) the vehicle stops outside my back gate, as it drives away the gate at the back of the vehicle swings open, hits my gate taking it clean off it hinges and taking a wall down with it and damaging my neighbours garage and fence. Someone witnessed the incident and took the registration details of the vehicle and it does seem it's from my local council. What is the best way of approaching this, as it's going to cost a lot of money to put right and I don't see why I have to pay for this though my home insurance knowing full well what and who caused the damage.I will be making a formal complaint to the council tomorrow and have also reported this to the police. Can I issue a council with a 7 days notice to repair the damage or go to small claims court. I can't leave it like this for to long as my house is not secure and anyone can walk in through the back even through I have temporarily fixed the problem.   5. Hi there, I have just been advised my car costs more than it is worth to fix. In my agreement with AF it states i can terminate, or do a repossession: I signed a higher purchase agreement with Advantage Finance 2 years ago on a 48 month term. In my agreement it states that i have multiple options: 1. Early repayment 2. Termination of Rights: "you have the right to end this agreement. To do so you must write to the person you make payments to. They will then be entitled to the return of the Goods and to half the total amount payable under this agreement. That is £XXX (amount here, which i have paid with no exception). If you have paid at least this amount plus any overdue instalments and have taken reasonable care of the Goods, you will not have to pay anymore" I have taken reasonable care of the Goods, but wear and tear has taken its toll 3. Re Possession - Your Rights: "If you do not keep to your side of the agreement, but you have paid at least one third of the total under this agreement which is £XXXX (which i have without exception) we may not take back the Goods against your wishes unless we get a court order. If we do take your goods without a court order or your agreement , you have the right to get back any money you have paid under this agreement" Can you please assist me as to: 1. If i choose to terminate my rights in option 2 how is "taken reasonable care" defined? the car still starts and could be repaired! Is this a viable option 2. Or should i just go with option 3 Repossession? Would i notify the borrower that i was stopping payments as it does not advise how i would do this. Would this affect my credit score Any advice would be greatly appreciated

Hello, I got a PCN from CPS Midlands Ltd, I looked and they are not registered with the BPA (British Parking Association) and they also not registered with the IPC (International Parking Committee). I checked through their members today (17th of July 2018). I paid £2 initially for parking and got a machine error and the machine did not accept any more change. And it does not accept cards either. I then paid £5 and got my parking ticket which I displayed on my dashboard. There were two machines at their premises with the same tariff sign next to each. One of their machines were inaccessible as it was fenced off by a building company, hence I used their other machine. I wrote a complaint to them by signed for post, but they wrote back to me requesting my full details including full name, phone, and e-mail. I believe I do not owe them anything and I believe they are trying to scare me into paying. But in my case, I am not only totally innocent but I overpaid their parking fees by 40% due to their machine error and this company charged £25 for help so they are not for me.   7. We recently had a neighbour park over the edge of our driveway - they were asked to move their car but refused, we called the local council who sent a parking warden on a scooter. When he arrived he confirmed the car (shown in the photo) was over the drive BUT I thought over the edge begins at the stone that tapers down to meet the road (Point A) where as he said only the last 10cm of the car was over which is more like Point B in the photo. Which is correct? Also 3 days later a Police Man came to our door about the incident - no idea where they got our details from we weren't expecting them and they were 3 days too late but I did ask the Policeman the same question and he didn't seem to know either. it would be good to get a concrete answer and have that well known.
  8. Good afternoon I need some advice on who is responsible for getting my car repaired please. I have a Skoda Yeti on personal contract hire. My car suffered some minor damage to the o/s/r door at the beginning of May and at the time there was no other apparent damage. The car was collected by DLG Autos Orpington on Tue 22 May and returned on the morning of Sat 26 May. The next time I drove the car was on Tue 29 May when I drove to work when I noticed that that, apart from a small deep scratch on the driver's door that there was a knocking noise coming from the front of the car, I was about 2 miles from my house at this time. The knocking noise become louder and faster as the car got faster but abated when I took my foot off the accelerator I turned around as soon as possible and took the car to the Skoda dealership. I told them the issue and history of the RTA. The dealership believe that the problem lies within the gearbox where 'something' has been forced or bent and has come loose, maybe chassis misalignment but so far are unwilling to carry out any further tests if the fault is due to the RTA, also I believe trying to shift emphasis/cause on to the n/s/f tyre that I had changed at the beginning of the month. DLG Autos are unwilling to accept that the fault was caused by them as there is no other apparent damage to the car. Well it came back with it and another scratch and a broken door guard so what else did they do to it? My insurers Direct Line have upheld DLG Autos explanation and have closed the complaint (less the scratch that they will sort). I need to know please who has responsibility for diagnosing the fault and repairing it? The car had a full service, carried out by Skoda, in back end of April and was running as smooth as anything before DLG got hold of it. Thank you very much
  9. On 11/05/2018 at 12:36 I was amazed to spot a gap in the red and yellow lines on the hospital perimeter road close to the Willow Annexe which I was visiting for pre surgery assessment. Since I have very troublesome arthritic knees and ankles only having a 200 yd walk was like a gift from the gods. The gap in the lines was twice the size my car would need and I assumed that whoever had been parked there must have just moved. I parked up and went off to my appointment. When I came back, to my astonishment there was a ticket on the windscreen. I took some photos to prove I was not on red or yellow lines, got in the car, opened the plastic envelope and found that the accusation was, in fact, "Causing Obstruction". he perimeter road in that area is wide enough for two buses at least to pass each other, I wasn't obstructing the road, and I certainly wasn't obstructing the footpath. Any advice as to whether they can make this stick would be appreciated. I have not yet contacted Liberty Printers who issued the Parking Charge, which says £80 or £40 if paid within 14 days.
  10. Our house was repossessed in 2009 and sold at auction to recover the outstanding mortgage balance. The sale left a shortfall of £25K+ which the lender came after me for, and being in our late-60s with no savings, assets or investments following a business collapse this is being repaid at £5 per month from Pension Credit sole-income. At this rate it would take over 400 years to settle. I have twice formally requested that this be written off, as it is clear that there is now no expectation in retirement of there being a substantial income or a radical change of circumstance that would make settlement a possibility. My first approach 4 years ago was made direct to the lender, and shortly afterward a response came from the DCA advising that their client was not willing to do so. A follow-up request restating the realities and requesting reconsideration was never replied to. My second approach 2 years ago, and two subsequent chases, have never been replied to. I believe that the mortgage lender’s code of conduct has something to say in such a regard, particularly that a lender should not, or may not, pursue recovery of a mortgage shortfall debt where it is clear that recovery is impractical or unachievable. Is there a mortgage-debt expert on CAG who can confirm or deny this? I intend to request a write-off again, and want to leave zero wiggle-room because clearly 400 years is idiotically silly to enforce at age 68 or indeed any age! Any clarification will be greatly appreciated, thanks!
  11. Where do I stand Hello I am desperate for some help. My car was taken to a garage in May 2016. Although at first there were problems getting parts, I paid a £500 deposit to get it done. I have been pushing this garage to get my car done as have messages from the garage owner saying that it will be ready July, August, December just pushing the goal posts further and further. Because its the headgasket the car was not moveable. I have been in constant communication with them for nearly 2 years. Finally I arranged for the car to be picked up as I could not see them getting the work done and since this time the garage owner has sold the garage and open a car sales shop. I hired a company to collect my car. The car has been dented in all panels, parts are missing, pipes cut off he has trashed it. Although he no longer owns the garage can I make a personal claim against him? He does own another business selling car. I cannot loose out on a £7500 car. I am livid. I entitled to take him to court? I have extensive evidence of him promising to have the car ready in certain months.

  15. Hi, We are a married couple. We are entitled to tax credits but not universal credit (due to savings). However next week I am going abroad (out of the EU) where we are building a house. We are still a couple but as I understand it with me being out of the country I cannot be on a tax credit claim (even if this would reduce the amount we can claim). I'll probably come back to the UK in September, but that's not yet certain - it could be later but not earlier. Wife will come to see me in August for a month (she works in school so no problem) Apparently UC is being rolled out in our area in late 2018. So is it correct to apply for TCs now (or as soon as I leave in the country) in wife's name? (Money will go into joint account) When I return to the UK then would that be a new TC claim (so potentially going onto UC)? Or just a modification (we'd still be entitled to TCs if I'm here, it doesn't make too much difference to our income)?
  16. Apologies as I've probably posted on the wrong board! I've just returned from holiday. Before I left I read a thread that I really wanted to respond to but didn't have time to do so before gallivanting off to Florence. I'm pretty sure it must have been a legal thread. Essentially I recall it being about a magistrate remonstrating with a defendant who pleaded "not guilty" when the Mag thought they should have plead "Guilty". I think it was about "historic debt collection" and possibly TV licences. Anybody point me in the right direction? I've looked but can't find it.
  17. Hi all. I am in the process of moving my mum from the awful Talktalk to a company more reliable and trustworthy. However, it has come to my attention that Talktalk have been taking not one but THREE payments a month from her account. What's more, it looks like this may have been going on since 2013! Things are not making much sense to me I need to dig a little what I know so far is this... There are two amounts being taken for Talktalk and one for Talktalk mobile. She does not have a Talktalk mobile and certainly only one phone/internet line. I recall seeing a paper bill earlier this year which was for over £60, yet when I logged into her online account it's showed every bill at the same amount, £40.45. Almost every month she receives messages warning that she has almost used all of her allowance and has even been cut off a few times, yet online it says her allowance is £250 a month and NONE of it has been used. I checked at least five or six bills and they all said the same. On her bank statement the two main direct debits were started at the same time, have the same ID but a different account number. I also know there is no way she makes enough calls to use up even a fraction of that allowance. It seems like they are sending paper bills for one account whilst the other is handled online and something is very wrong. I won't be able to do anything until Monday when I will take her to the bank to see what transaction information they hold. I will also be looking to find as many bills and bank statements as I can to see how far back this goes. I estimate that Talktalk may possibly have robbed my mother of at least a couple of thousand pounds and I want to do all I can to get that back for her. The down side is, of course, I'm amateur at best when it comes to law which is why I'm posting here. If anyone can tell me what to do or where to go once I have this information it would be most helpful. My mum is a widowed, disabled pensioner who has mental health problems that affect her memory and concentration and in my opinion they have completely taken advantage of her, even upgrading her to the more expensive fibre - she has no need for this, she doesn't even know what it is!! I have had experience of their customer "service" myself in the past so if there's a way I can avoid going down that route I'll take it. I'll check back here over the weekend as I am busy tomorrow, for now I just need to gather advice to use after Monday. Thanks guys.

  19. Vodafone mis-sold me contracts on my account and have refused to cancel them as requested. This has been going on since June last year, even the Ombudsman didn't seem to see where I was coming from legally, but agreed Vodafone had made errors in handling my account and complaint and there was a shortfall in service. The Ombudsman also told me about an invalid charge on the account (which Vodafone have not admitted to me) and a voicemail I was apparently left regarding a credit to the account they were making, but neither has appeared and reduced the balance I'm being asked to pay. If a company don't tell you they are changing their contracts, but mislead them on the phone and make them believe their payments won't change, without mentioning increases in charges and a new 24 month contract, is that not illegal? I've quoted the Consumer Protection from Unfair Trading Practises as I believe they've carried out an unfair practise: Misleading practices – a practice misleads through the information it contains, or its deceptive presentation, and causes, or is likely to cause, the average consumer to take a different transactional decision specifically; general misleading information, creating confusion with competitors’ products or failing to honour commitments made in a code of conduct. They never sent me the promised email detailing the upcoming changes I should expect, which I believe is in violation of the Consumer Contracts Regulations. I also believe they broke their terms and conditions by not correctly informing me of the changes that would take place. Breaking any of these regulations/terms would give me the right to request the contracts be cancelled without penalties. I contacted Vodafone 3 times before I received a response, from June to November. Nick Jefferys was no use and ignored my legal points when I emailed him. I requested a copy of the call that took place in June but Vodafone ignored my requests, which resulted in a complaint to the ICO, who agreed that Vodafone had breached it. Does anyone have knowledge of where I stand legally please? My head's a mess over it all now, any help is greatly appreciated.

In the main area of the forum a few days ago, a debate took place regarding a question from a member of the public regarding a letter that he has received from a firm of bailiffs in relation to a Liability Order granted 6 years earlier. The OP wanted to know whether the Liability Order was statute barred (which it is not). Another poster advised that a complaint to the Local Government Ombudsman should be considered and that the LGO may likely make a finding of 'maladministration'. The following two LGO decisions would indicate that a complaint to the LGO would not amount to 'maladministration'. and furthermore that a Liability Order is not covered by the Limitations Act.
  21. Most days we see a number of complaints on CAG, where DVLA have not received notifications sent to them in the post. This leads to letters, court claims and sometimes bailiff visits. Can CAG please publicise what DVLA notifications can be done online, as it might save people having problems, after notifications e.g vehicles sold, get lost in the post. https://www.gov.uk/government/organisations/driver-and-vehicle-licensing-agency The link above confirms what can be done online. Personally, i would not send anything in the post to DVLA unless i had to and then i would keep a copy, plus get proof of posting at post office. Most people can access the internet, either at home or locally. Most libraries that are still open have free internet access.

Quick summary: - I owed about £200 in tax, which was passed to Rossendales - Tax was paid directly via HMRC website - Rossendales requested proof, which I sent - Rossendales then tell me HMRC say this relates to another debt (even though the payment reference shows the correct debt) and for me to send a payment proposal. - I send an SAR to Rossendales requesting among other things, a transcript of the conversation with HMRC about this being the "wrong debt". - Rossendales write back saying: "Sorry, we are not the Data Controller, send your SAR to HMRC" Question - is Rossendales obliged to deal with my SAR or can they pass the buck to HMRC?

  25. Hello. I really appreciate that this forum exists and I hope someone can give me some advice on how to proceed in this situation. I recently received a CPM Parking ticket for the car park of the flat where I am a leaseholder. I was away at the time and the building management company had told me (in writing) that they would inform me (and all lease holders) when a new parking management company took over the car park. Needless to say they didn't. They are also saying that the parking company did a mail drop explaining the new system. Apparently they did but I didn't see it, I have seen another copy and it was addressed to the occupier not the leaseholder. I called the parking company and they said they had a video of someone putting something through the door which they would email to me. This still hasn't happened but I imagine it just proves they put something through the door? My building management company say they will not get involved in any disputes with the parking company - I imagine this is part of the contract they have with them as in the copy of the circular that was put around the block and it says that the landowners will not get involved in any tickets. If that even legal? My lease also says nothing about parking permits. As far as I can see there must be some kind of deal where the parking company get anything they can take and the management company will now not get involved. Please can I have some advice about what to do next? Has anyone been in a similar situation please?
