  1. Hi All, Need a little advice as to where i stand and how to proceed. Myself and my partner moved into a new flat in July 2018 where the car park is managed by these clowns. We are one of about 10 who are fortunate enough to have a very big parking space where two cars can be parked back to back. We questioned this in the viewing and was told this was acceptable. The issues with countrywide parking started about a month after we moved in where we got a ticket on one of our cars for being parked incorrectly. This was appealed and of course, lost. It was then appealed to IAS and of course, lost. Since then we have taken the advice on here and i'm hoping that the letter received yesterday from BW legal titled Letter before claim is now the last from these cowboys The main issue i have is that since then, we have received multiple tickets on our vehicles (about 5 i believe) for the reason of "double parking". Thankfully, i have a copy of a letter from these cowboys that was sent to all residents before we moved in specifically highlighting that double parking was allowed in these spaces. This was thrown back at them during one of the appeals and yesterday we have received the appeal rejection saying that the block management have changed their mind, only single vehicles can now park in these spaces and that my appeal has been rejected on this matter (first i knew of this change of ruling). Firstly, where do i stand with appealing these and going forwards? One of the main reasons we moved in here was because it had the benefit of space to park two vehicles. There is no road parking around here that isn't charged so thats not really an option. I don't want to keep getting these PCNs. i know that CPM have never taken someone to court but i do not want to end up in a situation where they take us to court to make an example seeing as we will probably have a substantial amount of these by the time our lease is up! As expected, the appeal responses from them are pathetic, don't actually address the points i'm making and are going against their own signage and terms but i'm now starting to use a substantial amount of time dealing with these and whilst i'm taking great pleasure in wasting their time and money, id rather not have to!
  2. Last week I placed an order via the Footlocker website for a limited edition item. While checking out they make it clear in the page that your item is being held for 10 minutes while you checkout and to check out quick so you don’t lose it. Earlier this week my order was cancelled. After eventually getting through to someone to speak to in their customer services I was told: ‘we cannot live track our stock so we cannot hold items during checkout’ and that the message during checkout was ‘essentially a lie customer services are aware of’. Is there anything I should do? I’m annoyed I stopped looking for the item anywhere else because I thought I had a guaranteed order with someone else because mine was ‘held’ during checkout and I feel they shouldn’t promote this obvious lie during checkout, especially when they’re totally aware they can’t do what it says in their site.
  3. Not sure if this has been mentioned yet but just been on the Universal Job match website and saw this : Universal Jobmatch will be replaced by the Find a job service on 14 May 2018. Important: If you have an existing Universal Jobmatch account it will not move to the new service. Save any information you want to keep, like your CV, cover letters and application history by 17 June 2018.
  4. Hi all, I'll soon be moving home into a new 3 bedroom place 4 miles away. Anyway, I want to get everything set up in advance so that I can look for the good deals. I've been having a look online and checking out what quotes I can get for gas & electricity, but the range seems to be pretty huge. If anyone has any good suggestions, let me know please! Cheers, OhhEnnEmm.
  5. Anyone signed up for the new job site that has been replaced Universal Job Match? I know UJM has had it's faults, but it was way better then Find a job, the new site is useless with jobs, it's terrible, why have this been brought out? Am I the only one who finds it rubbish?
  6. Greetings All. First post (hopefully of not too many, but think there may be a few in the pipe). If a Dealer's Website says: "Complaint Procedure" - Awaiting Content" of course there's nothing about any trade bodies or ADR channels. is this a breach of law and if so which legislation/ASA code etc? Is it worthy of an additional 'complaint' ? Thanks for your time.
  7. I bought a rug from modern rugs last week. It arrived yesterday and while the pattern is the same, the colour of the rug is different. I have looked at their returns policy and they say they will refund the money if we send the rug back within 2 weeks at our own expense. It is a 116 x 170 rug and will be expensive to send back and as they sent a product that was not as advertised I do not feel I should have to pay the return costs. Does anyone know what rights I may have buying something online that does not match the pictures in the online shop?
  8. I've just been viewing the Merseyflow website for the second bridge crossing that's just opened. The website can be found here: https://www.merseyflow.co.uk/faqs/penalties To quote them: "A PCN is a legal document, carries a fine of £40, and will be issued to the home address of the registered keeper... ...If the PCN remains unpaid beyond this 42-day period then the penalty will be registered as a civil debt and if unpaid after another 36 days, recovery action will begin." I'm just wondering whether the wording here is misleading and/or illegal. As far as I was aware, private companies couldn't issue penalty charges and fines. P.S: Sorry if I've posted in the wrong place.
  9. Hello. Any advice appreciated please, I have a full paypal account which has been verified and never any issues in 15 years, its backed up with a bank classic account visa(TSB) with no overdraft facility part due to jan 2017 just completed a 3 yr trust deed form 5 completed currently awaiting form 6. Cut to the chase I offer no excuses but my mother taken turn for worse last week : i stupidly gambled online last week. I had gaming casino account for number of years betting mostly small amounts, I honestly cannot explain why or the right details but I suddenly started to wager large sums! I knowingly had £1200 in my classic account (NO overdraft) started to bet large sums out of character which escalated in me asking paypal for more funds which are linked directly through the online gambling UK website, I started to panic having spent the £1200 in my account and just ask paypal to credit me! I had no real grasp of the situation just blind panic and get my money back I asked paypal for 5 further transactions which were £1000 £2000 £1000 £1000 £2000 £400 all of which paypal processed to the gaming website leaving me £6600.42 in negative balance which already had swallowed my £1200 credit linked to bank account. make things clear : my bank account paid paypal £1200 but due to no overdraft : paypal went negative £6600.00 1 week latter they are asking me to fund the account I have no means to pay due low paid and have bills please whats my legal standing. I have no mortgage or own car etc It might be worth adding the payments were obvious to gambling website paid to platinum games
  10. I recently purchased a Flight on Opodo The reason I booked with Opodo was because it gave certain assurances that I would be able to cancel my flight and receive a refund if I booked though them. My trip was subject to change so I was shopping around for a flexible airline (for september) The first statement although not misleadign itself, did make me feel more comfortable about the booking: "Free cancellation on most routes and airlines" - now I agree this doesnt say ALL route and airlines, but its already put my mind a little at rest and made me feel comfortable to continue further The final nail in my coffin as it were is the statement on the following page: Trip Cancellation Insurance , a BIG bold blue box stating "Life is Unpredictable - dont lose your money if you need to cancel your trip" now there is a link to the full terms of the insurance, but given his bold statement and believing by purchasing this I wouldnt lose my money if i needed to cancel I went ahead and booked. Had this statement not been there I would not have continued with the purchase So correct me if I am wrong but Consumer Protection laws protect me from misleading statements, if a misleading statement is made which leads me to make a purchase I wouldnt otherwise have made then they are breaching the laws? Appreciate any help how to resolve this, Opodo keep fobbing me off to the insurer to make a claim when it is Opodo who own and operate the website and are solely responsible for the content published on it
  11. Here's my GoTo website for anything which takes batteries and which is related to cycling, triathlon et cetera. Ray Maker is an American but he now lives in Paris with his American wife who runs an American cupcake/patisserie business in the centre of Paris - with their young child. A few years ago he started up a blog but being a triathlete – and mostly a cyclist, so far as I can gather, he started reviewing gadgets and he quickly got a reputation for telling it how it is – and in the world of rather over-effusive Internet reviews where almost everything eventually turns out to be pretty good and gets at least four stars, Ray Maker's reviews were pretty refreshing. If you are into sports of any kind and you like gadgets and if you want to read a serious and unbiased opinion before you splash out your hard earned lucre, then the website of DCR is probably one of the best places to go to. He does a lot of reviews about drones and also action cameras as well and these are pretty interesting too. However, I'm a bit disappointed that he hasn't started to do any reviews of some of the more downmarket Chinese/Korean items which are available for a fraction of the price of the big brands and which sometimes really aren't too bad at all. Maybe he'll get round to it. https://www.dcrainmaker.com/ @dcrainmakerblog
  12. Be careful when Googling for Barclays. If you click on it, it looks, at first glance, like Barclays. But it is actually Barccays It's a sca mmers site, where you are asked to submit all your usual on-line banking details. Your account would be emptied before you were any the wiser. Always double check the address bar before entering any details
  13. Hi I'm new to forums. I dropped an air passenger off at Liverpool Airport's "Express Drop Off" zone, in a car park that I could not avoid as it was on the end of a No Stopping road. I was stopped for 30 seconds. When I went to the barrier to leave they demanded £2 and went on about a contract and a sign on the road which I had not seen and more .... after about 20 minutes I snapped the barrier by pushing it out of the way and went to leave in my car. The car park called the Police who asked very similar questions about a contract. Now I've investigated and found PoFA S54 and do not like the idea that a person can detain me on the grounds that they demand that I have agreed to a contract of which I am unware. Oh my defence for snapping the barrier is that I was trying to prevent a crime. No further action. So I've begun the Practice Directions pre-action letters and get a reply from the car park supervisor. They have a ParkMark accreditation, but don't bother to display T&Cs, as required. No T&Cs = no contract, not just for me but to anyone. They detained me for 45 until cops let me go. I asked the cop if he was recording his trying to coerce me into agreeing to a contract. He was. Snapping the barrier was proportionate and reasonable in the circumstances cos I felt trapped. Does anyone know where they got the right to detain me from cos it ain't S54(3) PoFA 2012? No one should be confused into accepting a nonsense contract, that is not on offer, by hostile, sneering people claiming that a sign on a 40 m.p.h. road which is only in view for 3 seconds as it flies past means you've agreed a contract and pay up to leave. Already found, item 24 Sch 1 unfair terms, signage is substandard and does not conform to BPA, Fraud by false representation and abuse of position. Thanks in advance. I know I'm a nuisance but I don't want other people barracked like I was.
  14. Hi There Wonder if anyone can help please. We were on holiday with the family in Mallorka and whilst in Mallorka tried to book our flights back home to East Mids Airport. Towards the end of the holiday we decided to start looking for various flight options with different airlines and used ryanair, jet2 and thompson websites to compare flight times and prices. Thompson has shown available flight in the day on the 24/08/2014 and we decided to book it and stay a bit longer. Bare in mind we have tried booking Thompson on a few occasions for a couple of days however they were showing flights one minute and then once the page is refreshed they would disappear. We thought it was due to their own holidays not sold last minute they would sell flight seats to general public at a reduced price, but they would disappear because it would have been sold or something. Anyway, we we happy with the flight time and date and proceeded to booking it. Booked and paid. Thompson booking process took only a few minutes - we have paid with the credit card and it didnt even ask for the security letters or numbers. As we were supposed to flight out in 2 days we thought we would check in at the same time and this is when we have realised that the booking was made for the 24/05/2015!!! Somehow , somewhere in the computer world the dates changed during the booking itself. We have selected correct dates in the original search, selected correct time and date for the flight and booked. Confirmation came however for the date in future! We checked and Thompson is non refundable airline. We called credit card company and advised them of the incident. When tried to go back and rebook the correct flight ( Thompson customer service line was permanently engaged) - they were no longer available!! We had to pay for another tickets with Jet2 in the end. Once were came back home we have raised this issue with Thompson - however they did not want to know and not even interested in giving us a credit note or vouchers to change for another date or flight or location. We are raising complaint with the credit card under s75 of CCA1974 Ironic thing is - we cannot fly out of Mallorka on the 24/05/2015 at 12pm as we are getting married here in the UK at 2pm! So its not like we have made a mistake in dates or anything. We are desperate to get the money back or credit towards another flight or a refund as not really interested in Thompson flights at all at the moment. Can anyone help with any suggestions please? thank you in advance
  15. Hi, I just had a Fixed Penalty Notice (fine) for dropping g a cigarette end on the floor and quite rightly so. So I'm not disputing the fine at all. When I came home looked on the Councils Website, it clearly states: I then logged in, attempted to pay and voila.. It asked for £80... I contacted the Council and asked to speak to the team which deals with this to get the correct amount put on (as I received the fine today) and was told that I wasn't able to speak to them. I explained about the website, they confirmed this; Her manager confirmed too that the site indeed IS incorrect and that as per 1st April there isn't a reduced fee any more. Luckily for me, I: 1) Took screenshots of the entirety of the page (including the date etc... in my computers status bar) 2) Printed off a copy of the page 3) Saved a copy of the page With the above quote in it. I was then assured that a manager from the team will contact me back this afternoon as they were unable to override the amount on the phone with me. Can I hold them against this £60 (rather than £80) that they quoted on their website? I've just confirmed now (58 minutes later) that the websites been amended... Lucky I took a load of screen shots and that Cheers, Ade
  16. Hi everyone, I'm new here and after some advice. I was made redundant from my job last September through no fault of my own and been signing on ever since. However, before Christmas I had an appointment with my advisor at my local job centre and gave me details of a job to apply for but 2 weeks ago I received a letter saying that they are going to stop my job seekers allowance from the end of January to the middle of march. I have since appealed the decision in writing but when i went to the job centre today I had to fill in another form and explain again. I know it was my fault for not applying for the job, but I always complete the booklet and attend the job centre on a regular basis to sign on. Any advice? Thanks Louise
  17. The onwards and upwards march of the ad blocker continues http://www.bbc.com/news/technology-35460785 Once again, like most of you, I hate the intrusion of ads while I'm trying to use my computer or my telephone. On the face of it, these ad blockers should be welcomed by all consumers. However, the people who will really be laughing are the banks, retailers, debt collectors, payday lenders et cetera who will be pleased to see the Consumer Action Group struggle and have difficulty paying its bills so that its very existence is endangered. This forum like tens of thousands of small hobby and enthusiast forums all over the world count on the small amount of advertising revenue to keep their heads above water and to pay their bills. We have hundreds of thousands of people who come to us every year and either simply benefit by reading all the advice and all the experience on this website or who actually get involved in discussions and ask the questions and get the help they need to stand up to the bullying and unfair treatment which is handed out every day by the companies that we all have to deal with. If this forum goes out of existence, those hundreds of thousands of ordinary individuals will lose and the companies that treat them so badly and which dominate them every day will win. If you have a choice, please don't use ad blockers – not only for this forum – but for all the small websites everywhere and for all the ordinary individuals who use them – everywhere – for every kind purpose. If you feel that you do have to use ad blockers, then maybe you should consider making a donation to the site – maybe not just once, maybe on a regular basis. We do our best to help you – but we can't do it alone. We need you to help us
  18. sorry if this is in wrong section, today Argos were selling on the site a dining table and chairs for £19.99. (was £215.59 £19.99) plus £8.95 deliver charge, seeing this bargain i have purchased it using my paypal account to pay. A friend also was trying to purchase this online but couldnt get through to her basket so called argos customer service line who told her "its a pricing mistake and will be taken off the site ASAP). checking my paypal account it tells me the payment is pending ...... This is a temporary authorisation to make sure your funding source will cover the payment. Your funding source will be charged when Argos Limited completes your order. my question is this, can argos refuse to honor the sale and simply not complete the order, its their mistake and the item has been on the page for well over 4 hours now. many thanks in advance
  19. Hello, Last September I paid for a one month premium membership of a music forum. It was a small amount $10 or £6.50. The forum was not much use to me so I did not renew or so I thought. Today I have discovered that this forum has continued to take payments out of my account for a futher 4 months. I am furious as I did not sanction these payments. When I bought the membership it said 1x1 Monthly Membership, nothing about renewals. When I contacted them to complain they basically said no refunds and that I could cancel if I wanted. Trying even to find where I could cancel took me about an hour as it is well hidden and I really feel this website has employed underhanded tactics to con me out of money. The website is based in the US and I am in the UK and I am not sure how much I can do. Is there anyone I can make a formal complaint to regarding this? many thanks in advance
  20. I have had an ongoing claim with Jet2 for compensation following a fight delay in Feb 2011. There are six family members in the group, my wife and I, and four children under 16. I am the lead passenger and paid for the flights and the booking was made using my Jet2 account. It was a technical fault and they have been using the “unexpected circumstances” excuse since 2011, and most recently said they were waiting the outcome of their appeal to the Supreme Court which they said would affect the outcome of my claim. When the Supreme Court refused permission for them to appeal, I wrote again asking for the full amount plus interest. They have now asked me to submit a separate claim for each individual or they won’t consider them. This is the first time since I first claimed in 2011 that they have made such a request. After my initial claim, they made a partial pay-out for our allocated seats booking-fee, all on the same claim. So they have the all the passenger details and they have even partially paid out on the claim. I am inclined just to go straight to the County Court now because they are obviously just time-wasting. In my most recent letter, I said that if they did not inform me within 14 days of how and when they are going to compensate me, I would pursue the matter in the court. Am I now justified in taking them to court? Is it reasonable of me to expect a reply in two weeks after an almost four year on-going case ? Their normal reply time is six to eight weeks. If I don’t submit the claims again individually, would they be able to use that as reason for not paying if I go to County Court? Many Thanks
  21. Police are investigating a "significant and sustained cyber-attack" on the TalkTalk website, the UK company says. The phone and broadband provider, which has over four million UK customers, said banking details and personal information could have been accessed. TalkTalk said potentially all customers could be affected but it was too early to know what data had been stolen. The Metropolitan Police said no-one had been arrested over Wednesday's attack but enquiries were ongoing. TalkTalk said in a statement that a criminal investigation had been launched on Thursday. It said there was a chance that some of the following customer data, not all of which was encrypted, had been accessed: Names and addresses Dates of birth Email addresses Telephone numbers TalkTalk account information Credit card and bank details http://www.bbc.co.uk/news/uk-34611857
  22. Hi, I hope you can help me. I posted a negative review on a website of a removal company. That company is now threatening me with defamation and false accusations unless I remove the review. I instructed the website to do this via email (I have no other means of contact) and copied in the removal company contact. It states, however, on the website that it can take up to 7 business days to remove the review and, after 6 business days, the review is still there. Note I am not able to remove or edit the review myself. I explained to the removal company that I cannot remove the review and that it can take up to 7 business days to have the review removed however they said yesterday, 6 business days after requesting the review to be removed, that they will issue court proceedings. I noted that there are other reviews on the website for that particular company that I would consider to be similar in nature and have been there for several months. My questions are: 1. Can the removal company issue court proceedings to me despite no longer living in the UK? 2. What exactly is the process for issuing court proceedings? Does someone have to physically give me something to do this rather than online? 3. Is there anything else I can do if the review is still not removed after 7 business days? Any help would be appreciated!
  23. Hi, just wanted some advice regarding a would-have-been purchase for me. I saw a listing on a national building centers website ( a section for trade members specifically ) for a deal on an in-store collection item which had a ladder for sale at £24.00 inc VAT however the ladder you would actually be given at the till is not the ladder that they list the specifications for online. as this would result in me making a trip to the store ( a 35 min drive ) to find out that the online page was not correct, where would I stand? I do hope this makes sense. Many thanks
  24. Hello friends, My pension fund administrator took a long time due to their system being dis-functional (over thirty days, when it should have been just two days) to register my account and make status of my pension fund available on-line. My pension fund pot is around £25000.00. I really had to continuously call and chase them to fix my problem. Is there any legislation that entitles me to compensation for keeping me deprived of being able to view my pension fund on-line? Thanks
  25. We bought a BEKO fridge / freezer that comes with a £100 cashback deal. One of the reasons that swayed our decision from another similar different brand fridge was the cashback offer. They have a form you fill out on their website to claim. But when you fill it out and press submit, it refreshes the page and everything is blank again. No messages, no emails or anything from them. We filled this out 3 times on different browsers and computers. We have contacted them on the contact form but no answer. It seems that they don't want to give cashback to people. Whats the best route to go down with this? Edit: I've emailed the CEO and will update here if I get a response.
