  1. Hey CAG, Hopefully someone can help me out with this issue. I just got a court letter issued 27th of June from MMF via Moriarty Law looking for payment from a payday loan taken out in 2011 from wageday advance for just over £400 (The claim was filled with the Northampton County Court). I went online and responded to the claim with an acknowledgement of service, however I can see that I am over the 14 days I had to respond to the initial claim and now I am a little worried that they may have already filled the CCJ. I want to defend the claim as I am 80% sure they took the money out of my account (even though I had no overdraft facility) from LloydsTSB which left me with a debt with the bank. However it's been over 6 years from the initial default with wageday, I've moved a number times since then, and Lloyds and TSB are now two separate entities so it's doubtful I have the proof of this. I am hoping someone on here could help me with what type of response I should issue to the court, or to any of the claimants specifically? I really don't want a CCJ (who does) and I've recently got on top of some really bad debts so this would be a major blow to my credit. If someone could help me out, I'd be eternally grateful. Thanks!

Hi All, My brother has had 8 loans setup in his name, 4x Wageday Advance and 4x Myjar, my brother suffered a brain hemorrhage about 6 years ago and since then he has found it difficult to read and comprehend things, his daughter is the one who setup the loans, we have proof of this by her making a transfer into his account when the payments are due, unfortunately she has also been found out for other fraud to other family members and the payments for the loans have now stopped, leaving my brother a tidy sum against his name. I have spoken to Wageday Advance and they requested a signed letter from my brother giving me permission to act on his behalf, which has been done and emailed back to them. I tried to talk to Myjar who also said they cannot talk to a 3rd party but would need a letter and a copy of this passport or driving license so they can match the signature, 1) the thing is, we have not been able to find out if the loans are in his name or simply his account details used. 2) my brother does not have a passport or driving license so they cannot have been used for the application of the loans so how are they going to match the signature ... Between us (the family) we have reported 11 instances of fraud to Action Fraud, but it would appear only 10% of the reports are investigated. We have reported it to the police, a PC came out, asked a few questions and went away saying he would need to talk to his sergeant, and we have heard nothing since. We also have other proof of bank accounts being emptied, ebay [problem]s and paypal [problem]s, the list goes on. Can anyone offer any advise on the above and how we can get a conviction?
  3. Hi, not looking for advice as i'm following the same format as my QQ and P2P complaints. I just wanted to update the forum. After WDA emailed me and said they noticed I'd borrowed a lot and they would freeze the interest on my current loan and arrange a repayment plan to help me, I thought it was great. After that the hassle started, constant phonecalls including to my work, even after I asked them to remove the number from their records. I put a complaint in about how poor their service was as they had offered something to me, yet started treating me as if I had defaulted. Letters with default charges 3 weeks before my DD was due etc. 8 weeks later I got an email saying they had been in the wrong and they would remove £25 off my loan, hardly the most generous offer, but an acknowledgement at least. The rest of the email ahd incorrect information on it in relation to my balance etc. I emailed back expressing my surprise at the information on outstanding amount etc. I also asked for all the information on my accounts and what I had borrowed / paid. I got a reply with the correct info on the account but no response on the additional info I asked for. Last week I emailed again to ask when i'd receive this info. As I still haven't received something today I decided to do my own digging I have found all the emails for loans in my Hotmail and was able to piece together all the payments, loans, interest and rollovers. I have had 37 separate loans, and during that time I've rolled over 20 times. This included one loan that was rolled over 10 times, then a payment plan put in place for 6 months to pay it off, and a loan issued again the month after!! Loans started at £150 per month borrowed and up to £640 (repaid £800) between March 2009 and October 2015. Total interest paid seems to be around £7,300 I have put in my complaint for irresponsible lending (the 10 month roll over one that took my 16 months in total to pay back and then immediately be offered another should be enough to show that!) and i'll await their response. I'll update if and when I hear anything
  4. Hi, I currently have outstanding loans with all 3 companies, and am in a position to finally pay them. I think I have previously given each company the right to attempt to take the outstanding amount out of my current bank account, but have not had the funds available, which I now will have in a few days or so. I was just wondering what I should be looking to repay (I have had these loans for about a year now so expect the interest to be high), I was just wondering what are the next steps that I should take before paying off the loans. Any help will be appreciated.

I stupidly took a loan out with these in September to help pay with an unexpected bill i thought it would be ok as i was due a cheque in the post which annoyingly bounced therefore i am now stuck. I borrowed £150 off them and am currently out of work so after finding out the cheque bounced i tried to set up the minimum on a payment plan with them but they are not having any of it, they now have added over £150 of charges on to the account and keep telling me i have to prove to them i am out of work etc i have no proof but they will not take my word for it, I am really annoyed they have decided to double the loan and won't remove the interest added or charges Today i received a letter from them stating if i dont settle the debt it will be sold to a DCA who will add £25 and if i fail to contact them a further £25 to be added. All i want is a payment plan set up temporary and the interest and charges removing so i can orginally pay back what i owe they also bombard me with emails and telephone calls this can range from 9am to 8pm at night any advice please
  6. Hi I have a loan with wageday Advance £500 was due on 23rd August. I cancelled my direct debits with the bank as i wanted to negotiate a payment plan. I checked my account on friday and the direct debits went through anyway. Checked with the bank and Wageday had set up a new one which i wasn't aware of. The bank cancelled the direct debit that morning and the money was returned to my account. i have e-mailed wageday advance today to request a payment plan. I have just checked my account and there is £500 been taken out. called the bank who confirmed it was a debit card payment to wageday Advance. i didn't even know they had my card details as I had always paid by direct debit. anyone got any advice on what i should do next and what are the chances i can get my money back. i phoned the bank and they just said ring wageday advance up. can't see the point in that. any advice would be greatly appreciated.
  7. Hi There, I took out a stupid pay-day loan and couldn't afford to pay it back. Now I cancelled my debit card and my bank manager cancelled the direct debit 2 months ago and all was fine and well. A few days ago I noticed that they had set up a direct debit again and applied for payment of the balance. Am I correct that this is a breach of the direct debit scheme regardless of their terms and conditions? As far as I am aware with other companies if I or my bank cancel the direct debit, the recipient requires my authorisation to set up a new one? Am I right? Are they in the wrong? Cheers in advance!

Hi These guys have sent me a letter "Default Notice" stating that I have 14 days to pay them the outstanding balance of £900+ They say this includes charges/fees etc. The original loan would only have been for £300 or so and it has been outstanding since May. Is there anyway I can ask for a breakdown of their charges and should i settle for this balance or should it just be 1 months interest? I am happy to arrange a payment plan with them but I dont really think the balance should be this much?
