  1. I had a loan via satsuma loans (provident financial ltd) I started to find unaffordable. I did the right thing and rather than paying late I contacted them being honest and setup a payment agreement, which I have stuck to 100% and not missed a single payment since it was setup in may 2017. Despite this and the fact ive made major strides to improve my debt handling and credit record over the last 12 months its still had something dragging it down and ive just found out that its provident financial ltd. The record for them on my credit file is still showing as per the original loan agreement which I haven't been paying for almost 12 months now however this is no longer valid as the new payment agreement I had with them superseded this original agreement which explains why I haven't been making payments towards it. I have requested via experian and noodle that satsuma update this record to reflect the new agreement but they have refused to do so. My question is, is this legal? I dont see how when ive setup a payment agreement with a company's approval that the original payment agreement is still valid as surely you cannot have 2 payment agreements with 1 company for 1 loan.. ...the payment agreement I setup surely supersedes the original one? and I dont see how its fair that im being penalised for late payments on a loan agreement I no longer have any agreement to pay. this whole thing has utterly tanked my credit file despite the fact ive worked really hard over the last year to sort myself out and until I find someway to correct it it will keep on tanking my credit file. So just wondering what my options are here? Is there anyway I can force satsuma to update my file to show the new agreement rather then the out of date invalid one? Can I get some advice please?
  2. DAY 46 I placed an order with my ISP to upgrade to fibre broadband on the 26th April and was told my go live date was the 6th of May. I'm still waiting for this to happen as of today the 11th JUNE. The problem is not with my ISP, who have been great, but with BT (Blocking Technology) and their creature Openreach (ClosedGrasp). They have been telling my ISP that there is a problem with a postcode "mismatch". I have been living in this address for almost 3 years and using the postcode for more than 18 months. I have been using broadband, paying Council Tax, phone and broadband bills, electricity bills, taxing and insuring motor vehicles, buying and selling on eBay, receiving post and parcels, etc from this address and this postcode for all of this time. However BT (Blocking Technology) and Openreach (Closed Grasp) who have been providing my phone and broadband services, via my ISP, have suddenly decided that my address doesn't exist. Watch this space. Another day fuming at BT. I have just checked their address databases and they still have not been updated with my postcode, I am on the Royal Mail database at last.
  3. I just received a letter this morning from Carter's stating that if I don't pay up they will issue Court Proceedings against me in the next couple of weeks. I need some advice please. The debt is for about £6k and was originally a Sky credit card issued by Barclaycard. The card was taken out in May 2005. In 2008 I got into financial difficulties and made my last payment to them in March 2009 and at the same time wrote asking for a CCA request. I never received a proper CCA but got a copy of their Terms & Conditions. After this I wrote to BC and told them the account was in dispute. Wescot then take the helm, writing to me in June 2009 making all sorts of threats. I informed them that the account was in dispute as BC failed to comply with my CCA request. I heard nothing more from Wescot and on checking my credit file a lot later, I notice that BC had written the debt off in December 2011. 2012 comes along with letters from Lowell. These letters contain a completely different account number. I wrote to them informing me that I have no knowledge of any debt with such an account number and they tell me it was the card Sky credit card. I didn't answer or send any form of acknowledgment back. I ignored all future mailings from them. Over the next couple of months ago I get a few, usual threatening letters from Fredrickson International, I ignored all these. Now this morning, I get the threat of Court Proceedings from Carter. At no time since I put the account in dispute did I ever receive any notification that this debt was being assigned to anyone else. I don't think but couldn't swear on it that I even received a default notice. There is no PPI attached to this account. I would have thought that if this was legally enforceable, BC would have had me in Court back in 2009 to get their money, not write it off?? Advice needed what to do now please.

  5. Hi All, I'm back with problems relating to Lloyd's, CRA's and data protection. Both for some advice and to see if this is a common problem with lloyds and their inability to update records correctly under the Data Protection Act. History Credit card was incorrectly defaulted as 2012, after a battle Lloyd's , in august 2013, finally corrected the default to be 2006 which means no longer reported on CRA files. 2 months later, it reappears. New formal complaint, apologies, some compensation and reassurance this won't happen again. Just checked equifax. It's back, with a default date of 2012! Loan : was incorrectly default to be 2010, again after a battle (still ongoing) it has been updated to January 2008, with confirmation in Nov 2013 that 'this should disappear from CRA in January 2014, if it doesn't get back to us' ...or similar. This is now on CRA as default of 2010, records updated by Lloyd's in late January this year. So even if it was a case of it should disappear a month later, in feb, it won't as the actual default date is still wrong. Advice on actions to take? As I've already complained to Lloyd's re CC reappearing, and in reference to the comments in the loan letter, Lloyd's clearly have an issue with accounts which defaulted over 6 years ago and their reporting of them, whe they should not be applied to the CRA. I have endured too much protracted communications with Lloyd's, I am still in a chain in a complaint about the loan, that i just want to put a stop to the repeated updating of the credit file inaccurately. Any advice on what actions to take? Should I give them one more chance, or should I escalate to ico? I don't have a great history with their Andover department as I was almost starting court action before they finally gave me full disclosure. Thanks CS
  6. Hello I have a friend who has lived in Malaysia for around 5 years. Recently she received a letter in Malaysia from Buchanan Clark & Wells acting for Barclays to chase an outstanding loan amount. She was unaware of this debt and as she asked me to help out. I live in here old flat (she still owns it) and Barclays would have this address on file. I wrote a request for Section 77/78 of the Consumer Credit Act to get the information needed. A letter went to Barclays and Buchanan Clark & Wells. Buchanan have replied to say account on hold and they have asked Barclays to supply the required info. Barclays have written to the UK address saying that the address the UK address is not the same as the address they have on file and ask that my friend go to branch to 'update address and signature' As my friend Lives in Malaysia and does not intend returning she will not be going to branch. I am also sure that as the bank have written to the UK address then this may be counted as updated on their files. I'm also not sure if asking for signature is because they don't have one on file. I am looking for a bit of a steer on what my next steps should be please. Thanks
  7. Hiya, I missed a payment to next due by 20th August 13. My credit file was updated on 22nd August 13 to say payments were up to date. I then paid both the arrears and the payment due by 20th September on 12th September. My credit file was updated by next on 22nd Sept to say the account was 1 month in arrears?? This obviously wasn't the case as the account was up to date. my credit file currently shows that I am one month in arrears which is not the case. Next have advised they update credit history one month behind. Can they do this or should all information be accurate on the date they update the account? They have also stated that they will have sent the information up to two weeks before 22/09 and it can take this long for the credit agency to update. Is this also correct? Thanks x
  8. Millions of NatWest and Royal Bank of Scotland customers have been hit by technical problems which have resulted in balances not being updated and online services being unavailable. A message on the banks' websites reads: "We are currently experiencing some technical issues which means that account balances have not been updated, and are still showing a balance from Wednesday. Some services are also unavailable online. We are working hard to fix this issue as soon as possible and will keep you updated on progress." http://www.guardian.co.uk/money/2012/jun/21/natwest-rbs-customer-technical-hitches
