  1. Hi - I have received a PCN for an alleged "Failing to Comply with a No Entry Restriction". It is not quite straight forward and I would appreciate any guidance please on my chances of appeal? I started my turn into a wide side road when I noticed it was a Non Entry. I decided not to enter and was able to continue my drive straight out again as the entrance to the No-Entry road is huge (width of several lanes - and hardly any traffic as it was 11pm). The front of my car would probably have veered across the double white lines across the side road, But I was able to continue to drive out the entrance - it was like a u-turn but more of a wide curve in and out of the road entrance (if that makes sense). I waited to check that the main road was clear and drove off. I did not actually drive into the side road and had no intention of entering into a No Entry road. They have sent me very faint photos - if they have video footage (they have not mentioned it), they would be able to see I turned out immediately. The PCN does say they will exercise discretion if there are mitigating circumstances, but that's not reassuring enough. What are my chances of a successful appeal? I am within the 14 days discount period. The PCN says that if my appeal is rejected I will need to pay "the Penalty Charge" - doesn't mention a discounted rate. The full charge is £130 (ouch!).   2. Hey All, I have tried to do some research on this but I have found this forum and hope you can help. I came back from holiday yesterday and have received a Unpaid Traffic Penalty Charge.. The offence was dated 11/07/2018 and the Date of issue for the certificate was 04/09/2018.. The letter states the following it says that I have lost the right to appeal to either the council or to the TPT and they have increased the penalty charge.. Now I did make this turn as I was following the Satnav.. didn't see a sign.. I have checked google maps and it is signed.. What I am looking for advice on is that this letter I received was the 1st communication that I have received about this offence.. I have had nothing previously about this.. The letter has come just shy of 2 months after the offence date and they are saying that my charge has increased and I have lost the right to appeal.. even though this is the 1st letter I have received... Does anyone know where I stand with this? Thanks in advance
  3. Parked in a slip road that's in foreground of pic, one way running right to left. Left slip road and turned right onto main road. Only signs are left and right of slip road exit. CCTV shows me turning right with long shot, then close-up showing vehicle reg. On reflection, I can only say I was watching out for other cars in this very busy area and honestly did not see the No Right Turn signs. There was no signage on the road surface, opposite in the form of signs or any physical obstruction. Can anyone say if the road signs give good cause to appeal due to height, etc. Also, is it right that my Appeal of the challenge already turned down will mean I HAVE to pay the FULL fine of £130, as opposed to the £65 "discounted charge" paid already. If it's just not worth the trouble, or paying the extra £65 if I lose the Appeal, just give it to me straight, thanks. LBH PCN pic small.pdf
  4. Hello hope you are well? I just received a PCN from Brent council for violating a no right turn, unfortunately I followed my satnav and turned right but I never saw the sign on the pavement. My question is that the spelling of the road is wrong on the PCN notice, does this mean I have grounds to appeal? Thanks. Kind regards Ummi
  5. Contravention 31 says "do not enter the box unless your exit is clear or if you are turning right and need to wait because of oncoming moving traffic. It does not say anything about turning left. One can not see a clear exit as it is around the corner, especially where there is a pedestrian traffic light that goes green immediately after the green light for the traffic turning left. Why isn't it treated like the right turn? Or is it?

Hi, was caught shoplifting in boots, picked up 4 items nearlly worth £700 (as per Boots). security staff took all my details, called police, and i had to wait until police turn up, but nobody came. security staff called police 4 times, they were given a log no. but were getting told that no police officers are free at the moment to attend. after 4 hours of waiting, i was let go, as the store had been closed and they waited over an hour for police even after the store was closed. i was escorted out , i was given banned notice and RLP recovery letter. was cautioned in 2009 for shoplifting in past (in another part of uk), never did anything wrong again after that. then in january this year i was in trouble with another retail store, they called police for shoplifting goods worth £40, police didnt arrest me since i had no id on me they wanted to know if all my details given to them were correct, they brought me home, they didnt enter my house but waited outside in car until i brought my id and showed it to them. then they just said that it was a slap on wrist this time but dont do anything wrong again. At that time i told them about incident of 2009 where i was cautioned but they seemed not to have that on their record. My question is that what should i do next? do i need to go to police station myself for last night event? will police come to my house to arrest me? (they dont have my phone no to contact me on.) will i go to prison or get a fine or get a caution? or will i be luckiest and police wont turn up at my house? will they search my house or enter inside (if this happens then i will loose my accommodation as i am living with a relative as i didnt have anywhere else to live, and slept two nights in a park two months ago then this relative finally helped and sheltered me, if they know about this then i will even loose the roof from my head) i am very very stressed and dont know what to do. (i asked security staff and he said that i dont need to go to police station, if police contact him then they wil pass my details to them and they will take it from there) they waited that long because of the worth of items stolen were about £650.
  7. Afternoon, I wonder if you can please help me with this ticket. Back in November 2016 I unknowingly made a mistake and took a wrong turn to the road where no right turn was allowed between XX and XX hours. I think about 2 weeks later I moved and was never aware of the offence until February 2017 I was actually nearby my old flat and met postman who I knew and who then handed me a mail which had that ticket with a penalty and from Northampton court etc. I then phoned Court, spoke with them and was advised to immediately submit 2 forms (out of time and something else) I Immediately processed them both and also provided them with my new address and that I understand I made a mistake and am happy to pay the original penalty charge. After about 4-6 weeks I received refusal letter from Northampton County court that they have refused my appeal despite me providing them evidence of my new address and that genuinely I never received any previous notices. I then phoned them again and asked what will happen next and was told to wait to hear from the council. I have since not heard anything from the council and have been told by new tenants in the previous property that they received a letter from some target collection company which I imagine would be for the same. The council and collection company still writing me to my old address? what should I do? write to council asking them to waive the fee and that I am prepared to pay the original amount or contact the agency etc . Please help!!!
  8. Well done those lads, how ridiculous - A Head Teacher of a Devon School threatened to put any boy who turned up to school in shorts in the recent spell of heatwave weather, into Isolation ! But sarcastically said they could turn up in skirts.. so a group of 5 did.   9. I have a PCN for turning right from Perrins Lane, London, NW3. I see previous post from 5 years ago, and can completely agree that from the roadside it is not clear. The council camera makes it look blindingly obvious but it isn't. I see the previous post got a reply from the council saying they think the signage is ok. But some how it needs to be shown that it isnt. Does anyone think that these reasons below together with the Traffic Signs Manual qoute may be worth my while appealing? The reasons the signage are not clear is threefold, 1) Many large trucks and buses go past on the near side and so the sign over the side of the road is hidden. 2) The road sign on the corner left is by a tree which actually takes your eye off the sign, and is very overgrown, and 3) i was behind another car, so the road marking was covered too, untill i had passed it. It is also seems a very easy place to turn in either direction. There's seems no credible reason to not turn right. What do you think??
  10. Im fuming. It just seems to me that car owners are one big cash machine for councils. Stick some cameras up and let the money roll in. I recently moved to a new area and started driving to work. Unbeknown to me one of the roads I was turning into on my way to work each morning at 7:30am has a time restriction in place that you cant turn into it after 7:30am. Its dark, its christmas , the streets are empty, no one was killed, no traffic was caused. But yet I have appealed against these tickets and am told by the council they are 'certain an offense has taken place' and I need to pay £390 thankyou very much. That is like almost half a months wages. For making a mistake that has harmed no one. Does anyone know how I can fight this?
  11. In a bid to stop people dashing through security at the last minute, Easyjet will turn you away if you don't make the 30 minute cut-off point they've just introduced. The low-cost airline company are saying that, anyone who tries to get through security barriers with less than half an hour to spare before departure, won't be allowed on the flight.   12. I went to court to defend against MKDP for a disputed debt relating to a HSBC credit card that has no CCA for it. They had paid £85 costs + £335 further costs to secure the court date. Upon attending court, I was called in 20 minutes or so after the scheduled time. The judge immediately began proceedings by making reference to the actual letter sent out to confirm the court date. He asked if I had, since this the date of this letter, received any witness statements or other correspondence from MKDP, to which I replied no. The judge then proceeded to confirm that the court had also not received any withness statements or other correspondence from MKDP , and as MKDP had not arrived, he was obliged to me offer me two options, either the case could be adjourned, or it could be struck out. He then proceeded to explain the process of getting the case re-instated etc (they could claim they were stuck on the M6 for example), and advised me of a few other things, and said I could leave. Where do I stand with this now? I have never formally submitted a request for a CCA previously, but I did make a request from the HSBC in a branch (I was informed by their support it was the only way to make such a request at the time) and they couldn't obtain it from the computer, sent to the branch where I was registered at the time, and they couldn't obtain it from there, they then sent to London to see if it was in the archives and it wasn't there either. Should I be sending a request for CCA quick-sharp? To both MKDP and HSBC? My defence was based around the argument of unenforceable, so far MKDP have not sent me an ounce of evidence to prove they actually own the debt, or that they have any CCA. In addition, they actually have the date of default incorrect on my credit file (HSBC date of default is some 6 months earlier, which was actually the true date of default). Why would they pay all that money and not turn up/send statements? Are they playing for time, or calling my bluff? What is the likelyhood of a court re-instating the claim? Thanks.

I meet all the criteria for financial hardship (checked the Moneysavingexpert advice on this) and have been absolutely crippled by Barclays charging me £3 a day or nearly £100 a month on my account since they changed the rules. I have also suffered from charges piling up on my account to form the overdraft that is the basis for those £3 a day charges. I sent them an SAR, got my documents and duly sent off an email to Barclays Head Office following personalized templates from here asking them to stop all further charges and refund me those for the past four and a half years I have been in hardship. They turned me down flat, stating: Under the Lending Code (section 9) and Banking Conduct of Business Sourcebook (Section 5.1.4), Barclays does have a duty to treat customers in financial difficulties positively and sympathetically. Any such obligations on Barclays where financial hardship has been shown are guided by these codes and rules. However, I would advise that neither of these, nor the Banking Code which proceeded them require Barclays to refund charges or suspend the application of them when someone is suffering from financial difficulties. Having reviewed your account I can see that all charges have been applied correctly in accordance with the terms and conditions of your account therefore I would be unable to offer a refund. However, I have arranged for our Financial Assistance team to review your account and they are keen to have a full discussion with you to ascertain you current position including your current income and expenditure. The Financial Assistance would then be in a better position to look at more permanent solutions to your current position and they have several potential solutions that may assist you ; if agreeable I can arrange for a member of our Financial Assistance team to call you at a time which is convenient to you. I'm sure the 'Financial Assistance team' are no such thing... Where do I go from here?
  15. I recently did a prohibited u-turn and it got caught in the camera. The only issue is that the actual turn doesn't take place on the main road. I have turned into a private road(?) and exited out again. Essential, the actual u-turn took place in that side road. This is what they caught on camera. I have turned completely into that side road and completed the u-turn in there. Can this be challenged? I've got an option to either pay half or challenge the contravention. If my challenge is denied, I have to pay the full amount of £130. EDIT: I'm the black VW Polo.
  16. Hi .. Hoping to get some advice... A few years ago I set up a DMP and was plodding along with that until I got my head turned by Unenforcabilty back in 2011, stopped all payments sent CCA's got some replies and some ignored me. Then a few things went wrong for my family, and I couldn't cope very well with everything that was going on, I buried my head deep in the sand and started promptly ignoring everything. Fast forward to the end of last year and I received Court Papers for a small debt I'd been ignoring, I didn't know what to do, made them a full & final offer which to my huge surprise and relief was accepted, then I paid and stuck my head firmly back in the sand. Fast forward to a couple of months ago (I'm still ignoring all the debt stuff - throwing away letters, etc) and I receive another set of court papers, again a credit card I've been ignoring, again I made an offer, which was accepted but I haven't paid yet as I am still waiting to hear from them. again a couple of weeks ago, I received more court papers, this time for an ignored overdraft, again made an offer, which they've replied to me with a counter offer, which I can afford if I lend the money. But right now I'm terrified of how many more times I have to go through this ... As I said, I've (stupidly) ignored everything, right now I don't even know who I owe the money too, or where to start or what to do. My last payments to them all where made through the DMP some time around May 2011. Most of the debts are £1-2000, which if it comes to it and court papers are received I can raise the funds for around a 50% offer of F&F. But this isn't ideal I know, and the stress of it is killing me, the thing is I barely receive any letters regarding these debts now... . And the one thing that has me really worried is a larger debt, a bank loan which was left with a balance of around £8000 when I stopped paying, If I receive papers for this one I wouldnt be able to raise enough money to make a F&F offer, then what would happen? Sorry this has been such a long post, and sorry if I've posted in the wrong place, I'm just not sure which way to turn, I was thinking of finding out who I owe the money to and then trying to self manage a DMP, but I don't think I'm anywhere near strong enough to handle that. Any advice would be massively appreciated...
  17. Hi all, Really do hope me posting here I am able to seek some advice. I'm facing the likely prospect of handing in my notice so that I can continue using the reference for future jobs. Company has complied with ACAS regulations and has now set a side a final disciplinary date... The allegations against me are, lying to a member of staff regarding my whereabouts and asking for another member of staff to cover for me. I have admitted the allegations but I do believe it was done mitigating circumstances. The charge is breach of confidence and trust. Here is my story: My family have been going through a tough time whereby my partner’s grandfather had suffered cancer to the neck and lower body; it is a type of cancer attached to the blood cells which is treatable through specialist treatment. He was unwell for a period of time and was undergoing chemo therapy. At first the treatment responded well and he was fully fit and healthy and full of life. As time went by the lymphoma had returned and further subsequent treatment was required, this in turn slowly had weakened him until the clear was given. The cancer had returned for the third time over a period of one year, by this time doctors had advised this to be the final treatment, given his age and condition his body could no longer cope with the treatment. Prior to Christmas Eve he was eventually given his final treatment and the family could only stand by in hope. By this time the cancer had retuned and his health & weight fell into rapid decline, one day he could walk freely and then in the next few days bed ridden requiring assistance for his mobility and care. Doctors had advised he was going to be placed on the Liverpool Care Pathway as he was not able to have any more treatment due to his condition. I have stood by with the family and assisted where possible from the moment of his first treatment, using any time possible. Over time I and my partner’s granddad grew a special bond together, he had appreciated every help I could give to him and his family doing what was necessary at the time. On Christmas Eve he’d asked me to visit him and comfort him, he knew he was in rapid decline and asked for his family to be close by. On the day of Christmas Eve, I was working away with close proximity to my partner’s grandfather; I was hoping I’d leave for work in a matter of a few hours. I explained I had to leave for work, but he’d asked me to say. I understand I took it upon myself to go visit him and not contact a senior manager as I thought I could both work and comfort him at the same time. I now know this was the wrong decision to make and should have discussed with my Line manager during our one and only supervision session of home life difficulties. On Christmas Eve senior manager had called me and asked where I was, having known I’d made the wrong decision I lied to the senior manager and stated I was in another location. I knew this was the wrong thing to do and I panicked. I was at my partner’s grandfather side and was unsure what to say. I was sat with a man who needed care and a cross call with a manager. I felt the manager would have been displeased should I have told him of the situation and what I chosen to do. From the moment I panic, I contacted another member of staff and asked if should could cover me should the senior manager asked, she declined and from that moment I knew I should not of asked her to get involved. I felt some comfort that she declined and never was any under pressure to accept. I did not give her a reason as I felt this was too personal to push onto her. With his conditions getting worse by the day and knowing the Liverpool Care Pathway, I had asked work to take some time off some time off, which they agreed . My partner’s grandfather passed away during that time. I was there at his last moment to comfort him till the end and subsequently attend his funeral a few days later. I had 7 working days to confess the allegations raised. Whilst in that time period I noted there was supervision arranged for 07.01.2013. I did want to use this opportunity to discuss with my line manager of my actions and seek advice. My senior line manager said I had ample opportunity to discuss the allegation, however due to work commitments and nerves I was not able to succumb to the opportunity but did want to in Supervisions as it’s seen as an area to discuss anything affecting working life. I felt nervous, sick and appalled of my actions, stuck with a decision to help comfort or to be at the correct locality. They were was disappointed by my actions and I was and have been since sorry for what had happened. I never did want to cause a breach of trust or to waste anyone’s time in the matter. I continually did my work as required and never did use any opportunity not to do work, as there are many projects at hand to complete and do. I have worked very hard for the firm. I have placed more hours than I normally should have, previously not logged until management asked me to log all extra hours. I have been committed and always will be committed to my work and colleagues, always supporting them and looking for solutions to help aid everyday working practices. It’s given me time to reflect and think about the consequences, and has made me feel anxious and overwhelmed given me lack of sleep and health gradually subsiding due to not know where the investigation will lead to. Thank you all for reading and understanding. As a final note, my records a clean and I have been with the firm 3 years initially and 5 months currently, had one years gap in between with another company. Question now is of no doubt of handing in notice or not, to brave through the final hearing...
  18. Hello Sir/Madam, need your advice! I am attaching the police constable statement who caught me for u-turning from that road where it is prohibited. I checked again on that road I seen 3 u-turn not allowed sign on that road, one at the start of the road second few yards ahead opposite bus stop then last almost at the end of the road and there are few u-turn not allowed signs too for opposite site traffic so it means no one can u-turn from both sides. From where I started the u-turn that is a Newcastle city council taxi rank and where I finished the u-turn that is also a Newcastle city council taxi rank. I just moved from one taxi rank to other taxi rank but I cross the road that became u-turn. Actually I was working on that taxi rank first time and I seen many taxi drivers u-turning from there even in front of police plus from where I started the u-turn, there is a u-turn not allowed sign but that sign is not facing towards me which police constable mention in his statement that sign is for opposite traffic so I thought u-turn might be allowed for taxi drivers cause they moved from one taxi rank to other taxi rank so I did the same and police caught me. Now my question is:- 1. Cause it's a taxi rank so all taxi drivers u-turn from there day and night even in front of police. if I provide the proof in court that everyone u-turn from there even in front of police will it be helpful in my case? that it's a mistake 2. The police constable indicate that there was a u-turn not allowed sign from where I started the u-turn. I confirm that sign face is not towards me that sign is for opposite traffic. for example if u see no entry sign in front of you it means u cannot enter in that road but opposite side traffic can come out from that road I hope you understand my point. will it be helpful in my case ? hope you will help me out from it.   19. I've been offered a job that on paper is 15 hours a week, which would mean that I would be better off with the job than on JSA. If an opportunity like this came up normally I would take it. However, here's the bad information about the job. It's only a temporary role, which is three months long. Most importantly the hours of work each day aren't fixed. Some days I would be working one or two hours a day and occasionally not at all. The interviewer was quite clear that I would only be paid for the hours I work and that on average I would be working less than 10. They mentioned that since I would officially be working 15 hours and technically being paid £90 a week, this would likely cause problems with my benefits. If I go by an average of 10 hours a week, with travel costs taken away I would only receive £45 a week, which only just covers my monthly rent. As it would be less then 10 hours a week on most weeks the job wouldn't even cover my rent at all most of the time as I would be taking home less than £40 a week on average. Am I able to turn this job down? It seems very dodgy as if DWP find out, I would technically have refused a £90 a week job, even though the job on average would pay around half of this. The interviewer did sound a number of concerns about my financial state if I was to take the job, so I think it is unlikely that they would report me to DWP.
  20. Hello I have read several threads about this particular traffic sign at Gliddon Road and the motorists who have received fines for carrying out what the council asserts is a U-turn. The aggrieved motorists argument has consistently been that the type of turn they carried out was not a U-turn but a 3-point turn. The council maintains that this amounts to a u-turn but there is no legal definition of a u-turn. Furthermore, the number of people who have been caught since the signs were erected is in the thousands (I have seen figures - through a freedom of information request - that show the revenue this particular sign has generated in fines runs into the millions of pounds) which suggests there is an element of ambiguity about the sign which the council are profiting from. If they wanted to prevent this manoeuver being carried out the measures they have taken have plainly failed. I know someone who has received a fine for performing this manoeuver and is considering going to the high court to seek judicial review to overturn the PATAS decision rejecting his appeal of the original PCN issued. I would be grateful for any advice or information about the procedure for making an application to the High Court. He is still well within the 3 month period following the rejection of the appeal to the PATAS decision so there is still plenty of time. Has anyone researched this or know where to start?   21. Hi i was looking for some help and advice. Last night bailiffs turned up out of the blue saying that i owed money on a outstanding parking ticket from 2010.i never received this parking ticket or any letters from the courts. I would have paid the ticket of £25 if i has received it, it is now £500. The bailiffs clamped my car and then parked outside my house for 3 hrs waiting for me to get the money. I had to give them the 500 as i need my car for work, i rang the council today to complain and find out about the ticket and they said i could contest it. I was wondering about the best way to go about this, as i didnt receive any thing from courts or council,or a letter from the bailiffs to say they would be coming. Any help or advice would be much appreciated. Thanks jennie
  22. Santander has staged an about-turn and will no longer withdraw its "free banking forever" account from 230,000 small business customers. The original decision, first revealed in late July, upset some customers who thought the bank was reneging on an unbreakable promise to them. They would have had to pay either £7.50 or £12.50 a month for a business bank account that was previously free. Santander had previously said it was within its right to change the account. But less than two months after first announcing the change, it has reversed its policy. "After listening to feedback from our existing customers, a small number of whom do not feel their businesses would benefit from these changes, we will be retaining the fee-free option for existing customers," a spokesman said. One factor that may have weighed on the bank's mind is that every one of the affected customers could have taken their complaint to the Financial Ombudsman Service (FOS). Hi, I would really like any help I can get on this...I received a PCN for contravention 50JR " Preforming a prohibited right turn" , which I would really like to appeal against as I dont think that the signage on the road is clear. The sign is on the other side of the road and is well before you reach the road, there is no sign on the road itself and therefore when making a last minuet decision to turn right you have no idea that it is prohibited.
