  1. Hi all, I need some help. The defendant has been issued with a £100 'Parking Charge' by Parking Eye. The alleged offence occurred during the day time on a weekend, and was apparently brought to the attention of the plaintiff by ANPR cameras recording time-stamped photos with entry+exit times of the vehicle registered to the defendant. The plaintiff claims that the defendant spent just over 30 minutes in total at the car park. Answers to the FAQ thread are as follows: 1 Date of the infringement: Late January 2019. 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 5 days after the date of the alleged infringement 3 Date received 11 days after the date of the alleged infringement. 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] YES. 5 Is there any photographic evidence of the event? YES, see above. 6 Have you appealed? {y/n?] post up your appeal] Defendant has not entered any correspondence with plaintiff or any 3rd party appeals company. Have you had a response? [Y/N?] post it up n/a 7 Who is the parking company? ParkingEye Limited 8. Where exactly [carpark name and town] Town Quay 2, Southampton For either option, does it say which appeals body they operate under. Letter mentions POPLA Many thanks for taking the time to read... My query is - should defendant appeal via POPLA, or contest the charge with ParkingEye? Some guidance would be greatly appreciated, based on the answer to above as well as potential defense points to the claim, I can write a draft letter for the defendant and post up here for critique before issuing.

May i just add a very important factor on how WE all teach these unethical business a lesson that will make then sit up and take note… Business, in particular hotels such as Holiday Inn operate in a highly completive market place where even small adjustments to their statistics have significant rippled effects on their margins. So much so they employ technicians to monitor downward curves on online statics If WE collectively spent just 2 minutes posting a 1 star NEGATIVE GOOGLE review you will drive their ratings down faster then their CEO could say “get those ParkingEye systems torn down, its ruining our online reputation” Simply voice your disgust at their “unethical and immoral parking charge system”, preying on those of us who have been paying customers such as Lauren1994. Just 2 minutes, on Google and instantly reduce their ratings. EVERYONE looking at booking a hotel checks ratings right ! If you want to see this in action, see the start of a ripple effect at Holiday Inn Winchester whom since January 2020 started with 4.5 rating and then installed their new ParkingEye ARNP system. If you have more then 2 minutes then post across all their review systems to share with others your genuine experiences upon parking at their hotel, paying and then being charged days later and in your own words your thoughts on this.   3. Hi, i need some advise please. I too received a letter from PE with regards to parking on the Town Quay in October 2019. I didn’t really understand their payment system - do I pay before or after - so I asked someone who worked there, they said I could pay either way. So, I paid when I got back, entered my vehicle number - which didn’t say how long I had been there - the payment layout was difficult to understand, I think I had underpaid by £2, I paid £6.50. What do I do? I can’t afford the £60, do I write to them, do I write to them with a cheque with the outstanding £2. I don’t want to leave this as it’s affecting my mental health and stress, already had a sleepless night thinking about it. thank you for reading this
  4. Something similar was highlighted in London a few years ago. Beggars were travelling from the suburbs into London by train - Journalists discovered that the beggars were then returning to their homes at the end of the day, usually £300-500 better off !!
  5. Just starting a thread on Electric Cars. I have noticed a Taxi Firm in my town has gone fully Electric. Can you believe this news. As i looked around Great Britain to see what was going on other towns have done the same. Just a quick look around but sure i read that cost of electric v fuel was roughly 1500.00 Electric per year v 7500.00 for fuel a saving of 6,000 pounds.This was a Taxi and i will have to find the article again.   6. Hi, Not sure where to post this but I am in a jam and need help getting back on my feet. I am 23 and for last 4 years I have moved around the country camping and surviving on busking but now I need to hang up my violin and concentrate on settling down. My first problem is getting a care of address in the city I have decided to make my home, is it possible to use an address for benefit purposes which is located in another part of country. If I have no proof of living anywhere for the last four years am I unlikely to get help with social housing as I have no local connection with anywhere ? Any help or thoughts appreciated.
  7. Let us imagine.I hear many things. In my day,when you bought a house you did it up over time and that was that. Looked for a cheap house perhaps a little run down and bought it. Then spent many years saving a little and spending on your home. But i hear whispers,ok cannot be proved and i have not the time to delve to deep. Many landlords may have contacts and when a cheap house comes up puff,it is bought as quick as that. The first time buyers have no chance.Does this happen,perhaps you can tell me. I am not in a big town but i spoke to one landlord who had one hundred properties. And another who together with a few others connected to estate agents had 400 properties. Rents for some of these properties make me laugh,and because these are so high i have heard some landlords get ripped off,take anybody who says they will pay the rent. Instead of lowering it a touch and getting decent tenants. When finally many weeks later and the house is wrecked,just brush it off. Has many properties so perhaps expected. And if what i have heard is true,word gets passed round and the same happens again. And one is doing this over and over again.Now this part i can not understand at all. Maybe he is just stupid. So many will hopefully read between the lines of this short thread and say what you think of modern day living. And first time buyers and landlords in general.And tenants and rents that many must find it is hard to pay. And if first time buyers who deserve their chance in their local towns and cities are losing out through underhand practices this should be sorted by some sort of law,or changes to how houses are sold.Do you think this is reasonable. What can be done. Something seems to be building. Do you know strange things that are going on in your town,city. I will be very interested on what you will say i hope of your experiences in your place you call home. If renting for six months perhaps.You never know. Some places i believe in France have 10 year leases.At least you would feel secure. And am i imaging how run down the outside of many tenanted properties are. Inside maybe ok,or maybe not. But outsides that many you see are clearly not maintained. Not the gardens the properties themselves. Do councils have to check these out when let. Have a team to check this ,the property is in fair shape for letting out. Independant people.And teams. Things need improving. But that is my view,and expect some reaction. I feel some thumping at the door. Come on in and introduce yourself.

  9. It seems in order for the post office to deliver their mail slightly cheaper, they have changed my postal address, not just the post code. I now no longer live in the town the house has belonged to for 150 years. Can they legally move my town adress as I thought boundaries had to be changed by statute? I am no longer on the voting/ Electoral role list for my town... or any other town. The insurance companies can't find me so can't insure me. The school is discussing whether my children will have to move. It is having a devastating effect on our family! Any and all help gratefully received.

  11. Hi guys. I'm a long time user (occasional poster) and have been daft and obtained a notice which was affixed to my car the other week. On the 18th August, I went to Lincoln and parked in a Smart car park (T/A T&C) and paid for 4 hours parking. Stupidly, I went over the 4 hours by a few minutes and as I returned to my car, saw a yellow striped plastic bag stuck to my windscreen, stating "PARKING CHARGE NOTICE.... Unauthorised Removal is an offence". I opened it and there was an invoice for £35 rising to £70 if I didn't pay within a week. Now, I know I'm at fault for going over, but surely £70 is a bit steep for 16 minutes??? I know the old advice was ignore/ignore or ignore, but have things changed? I don't want to end up being a living breathing puppet for these guys in a courtroom. Thanks in advance.
  12. Just to mention that I have received two speculative invoices from Town and City Parking. In both cases I have sent the letter below and they have cancelled the tickets rather than pursued the matter further. I know the advice is to ignore but this worked for me with this company. Dear Sir I acknowledge receipt of your “Notice to Owner” reference TCX. I do not acknowledge any liability to company. Your document is no more than a speculative invoice. Despite your reference to a “writ” and a “summons”, your only means of enforcement is through the county court. To do this you would have to establish that there is a contract in existence, that I am the person that you have contracted with and that the “amount outstanding” is not a disproportionate penalty. I do not believe that you are able to satisfactorily establish any of these things. If you believe that you have a legally sound basis on which to proceed with this matter, then you are at liberty to commence proceedings in the county court. The address for the service of papers is X I am aware, of course, of your company and how they generally deal with these matters. Rather than court proceedings I am expecting to receive an increasingly hysterical series of letters from you, debt collectors acting on your behalf and then solicitors before you give up. Please note the following: 1) I specifically deny you consent to process my personal data under Section 10 of the Data Protection Act (1998) or to pass my personal data to any third party. If you do so, I will make a complaint to the Information Commissioner and I reserve my legal rights in this matter. 2) I will not pay your invoice unless ordered to do so by a county court. In these circumstances, I regard any referral of this matter to a debt collection agency as harassment and I will deal with this accordingly by means of complaints to statutory and regulatory bodies and I reserve my legal rights in this matter.   13. Other forums are reporting that TCP (or Smart Parking as they are now called) have been banned from accessing DVLA records. It's believed that the ban relates to the confusion over signage after the company was taken over by Smart Parking. All signs still mention Town and City even though that company does not exist any more. So a motorist is being asked to form a contract with a non-existent company and not with the new company.

  15. Hi again all, I know there has been some changes within the parking system! This is for a family member, and I just want to put her mind at rest, as when you pay for parking you have to produce your other half of the Parking ticket to get a discount in store. Is this still just the case of ignore the letters that sent as per usual, as there is No Loss by the Lando owner, in this case Asda! Here is what was stuck to screen and inside.   16. I have just read an interesting article on Wreham. Com involving the perth based private parking company Town and City Parking limited. I understand that ASDA management were contacted and asked if the demands being sent are legal parking tickets or just speculative invoices and they replied“the car park management company issue a parking charge notice (PCN) which are not fines, but civil penalties.” Correct me if I am wrong but I understood that penalties are ulawful not only in England and Wales but also in Scotland
