  1. Hi, I parked in a loading bay for what felt like no more than 15 minutes and received a parking ticket. See images attached. I couldn't see any signs that clearly displayed the time allowed or the terms and conditions. Is this legal? Please let me know if you need any information and thank you CAG in advanced!
  2. Well it seems it is going to be one of those days.Already i have put two threads out and it is only 8am. This one has caused by blood to boil.But everyone has a view,what is yours. Received today and the time is not correct also i think the code is wrong the fact was i had a disabled person in the passenger seat needed the loo very quickly so i cut around the to light at 1703 the ticket saying 1702 the code also said 38l think that was wrong to but i needed to get them to a loo asap and had sat in the traffic 20 minutes already and could not pull into the left as was a bus lane what can i do

  5. Hi folks - here's my question. In October 2018, I received a NIP for doing 59 in a 50 zone, and this went forward with a Fixed Penalty. However, the points for this would put me on 12 (I probably should have known, but it didn't actually occur to me to check). The HMCTS, in early January, returned my driving license and refunded my £100 fine, informing me that GMP would be in touch "forthwith" in order to proceed to court for the totting-up ban. I have yet to hear anything from GMP. My question: Is there a time limit between the offence and the court date, or between the HMCTS decision and the court date? In other words, do GMP have a time limit to prosecute me, or could this essentially be whenever they choose? I am accepting of the impending 6-month ban for my stupidity, and just want to "get it over with", however, if there is a time-limit and they run-down the clock, might I get away without a ban? Any advice appreciated.
  6. Evening all, I ordered some equipment from Fitness Superstore, checked both items were in stock (it showed as such on the website but I checked anyway)and there is an email trail showing this. As I was having them install it I had to submit a form which I did and they acknowledged receipt. I had to hasten info on a delivery date but once they had been reminded of my order this was set for next Monday (11th Feb). Yesterday they informed me that the Monday delivery is only for one item and the other will be restocked 'sometime in March but they don't know when'. It could potentially be 7 weeks before it's available again and then there's the wait for installation. A kerbside delivery isn't an option for us with equipment of this size and weight. After some discussion I have today cancelled the whole order. I did use a credit card but I transferred the money to it on the day of the order so I am out of pocket over £3000. I want the refund sooner rather than later. The way this went I've lost all confidence in this company as they don't give a damn and I want my money back so I can go elsewhere. I can email an LBA first thing on Monday and I'd like to give close of business on Friday as a deadline - all they have to do is press buttons to refund my credit card and I know it can be done. Must I give them any longer? I see two weeks quoted on here quite often.

  8. Good morning all, I've been with Eurodebt for 179 months, yes over 14 years and yes I know I've been pretty stupid. I can't remember exactly who the original creditors were but it was credit card companies. Having got myself in a mess when I was not paid for work completed I borrowed on cards to keep me going, much of the debt rocketed with the addition of interest and PPI's, I claimed back the PPI's but I was still in debt and struggling, foolishly it seems now ended up with Eurodebt. I've just been blindly paying this each month, there is no realistic chance of me paying this off, I'm paying £71 per month, to three companies CapQuest, Cabot Financial and DLC I can't remember who the original creditors were but I think these have changed hands more than once. What can I do? Advice gratefully received!
  9. can someone please confirm to me how far back i can claim for being overcharged by my landlord, on the annual insurance premium on my leasehold flat? I have discovered that they have been overcharging me 4% of the premium since 1994. this equates to almost 5k Thanks.
  10. Could you offer some advise on my situation please? I moved into a property in December 2010, and the Water bill was put into my name. I left this property at some point during 2014, at which point i had made no payments towards the water or been in contact with the water company. I've made good the debt now, ive actually cleared all my debts! My question is regards to the default date. The company placed the default in January 2016. They then applied for and won a CCJ by default in August 2016. I've raised a complaint as i believe the default should have been dated between March-July 2011. That is correct i assume? In regards to the CCJ, I have asked that they agree to have it set aside, as if they had placed the default on the correct date then it would have been statute barred. Im confident on my first point, how do you feel the second point (CCJ set aside) will be? I've already paid any monies i owe to them, but if they had placed the default correctly then it would have been statute barred before the date that they actually applied for it
  11. Folks, Long time since I've been on the CAG. I have had a couple of issues sorted with the help of this site, and I'm very grateful for the support so far. I am now wanting to end another 2 barclaycard accounts, which has balance amounting to 15K in total. One of these (the largest) is an old morgan stanley card bought by barclaycard few years ago. The balance was built up very quickly when the account was opened (circa 2004), and I have managed minimum repayments for many many years. Those are more than £200 a month. I have certainly paid well over 20K on that account over the years, and it's time to end it. So where do I go from here? I'm guessing a SAR for both accounts, CCA for the morgan stanley one? are the rules still similar to those from 2011? e.g. if they cannot produce an enforceable agreement, I can end this quickly? also, i understand there's new legislation around over-limit and late fees which can be claimed back? in my case i'm sure these are significant! Any other advise? I need to end these debts once and for all. Thanks all. NC
  12. I took out a money claim to recover money owed. The Defendant hired a Solicitor who sent and acknowledgement and applied for extra time, 28 days, to file a defence, I made no objection to this application and the court never put it in front of a judge for ratifying. However, 28 days later when the date specified by the Solicitor on their sample order had passed, no defence had been filed, so I applied for the judgement to be made by default as no defence has been filed. The Solicitor then called me (4 days past filing date) requesting further information so that they could begin to put together their defence... (BEGIN to??!) and I pointed out that I had already applied for Judgement as they were now out of time (CPR 12.3 (2)a "The Claimant may obtain Judgement by Default where acknowledgement of service has been filed but a defence has not been filed and the time for filing has expired). The Solicitor said that the extra 21 days dont start until they are rubber stamped by a judge. Today I received notification from the Court that the request for judgement has been returned by the judge for referral to a District Judge. So, my question is: Where extra time is requested and not challenged, is it accepted that the extra time is granted by agreement? Or can this defendant solicitor continue to delay filing until they get a rubber stamp agreeing extra time? My reading of the rules that where extra time is agreed 28 days would be given, would apply where no challenge is made to the request for extra time. How do I challenge this and stop them late filing please?
  13. just had a letter from my current Gas/Electricity suppliers EBICO, saying that because Government will introduce a price cap on variable/default tariffs from end of 2018, that my current ZERO tariff (no standing charge) will come to an end. This will mean for my supply, that I will see an increase of about £100 a year. EBICO say that because of the Goverment price cap, the current tariff they provide to me, will become commercially unsustainable. I have done a few calculations and if I switch suppliers, I can limit the increase to about £50 a year, moving to a supplier that does not charge for cancelling early. In the Spring of 2019, I can then look again and see if it is worth switching again. Thought I would post this, as from memory there are a number of people who post on CAG that were with EBICO. Also going into Winter, with many suppliers currently changing tariffs, it may be worth people shopping around to see if they can save money.
  14. I hope I'm posting this in right place. I hope some one can give me some advice. I work in a small hotel. I'm the Head Chef. We have 2 other chefs working in the kitchen. One of the chefs is known to be very lazy. Likes to take time off saying he is ill when isn't, spends more time playing on phone than working etc. Earlyer this week on the Tuesday I was working with him and he started going on about how he had just got a new xbox and the new call of duty game that had just come out. He started moaning that his friends were already much higher level than him and that he need to catch up. He had his days off Wednesday and Thursday and Friday morning we hear from him and he has apparently been to doctors and been signed off works for 2 weeks due to stress. He is not stressed, he is only 25, is not married and has no children. He has only just come back off holiday a week ago. I'm sure he has lied to Dr to get time off to play his new video game. He has been playing his new call of duty game for nearly 80 hours straight. And is still online playing at 3am. Would some one who is under that much stress that they can't work be able to play videos games non stop. I am really angry, I have young children and my youngest son is very poorly. He has hospital appointments next week and weeks after. I had booked days off for both weeks, over a month ago. So I could look after my other children whilst my wife takes our youngest to hospital. These hospital appointments are very important. And include Nurosurgery appointments and appointments at eye hospital. We have no family to ask for help, and no friends so my wife relies on me to help. A lot of the hospital appointments are over 3 hours away at specialist hospitals, and a lot they require that my youngest son is bought alone, so it's not possible for my wife to take are other children with her. We are going to have to cancel all appointments as I have now got to cover for this other chef and will have no days off next week or the week after. Its so wrong that he gets to sit at home playing stupid video games and still gets paid whilst I'm left having to pick up the pieces covering for him working my self in to the ground and it will effect my children as they will not see me, and expecially my youngest as he won't get to his hospital appointments. I also feel sorry for my boss as she is a old lady in her 80s and I feel he is taking advantage of her, he lies to her and she believes him. I don't like to see him walking all over her, he laughs at her behind her back. She ended up in a simular situation with a different employee many years ago and she did sack them but then end up being sued for apparent unfair dismissal. Although that situation sorted its self out she is afraid to do any thing or sack any one else. Is there any thing I can do about this chef, how can I get my boss to see what he really is like. I have physical evidence to back up my claims that he wanted time off to play call of duty. Is it worth me mentioning to my boss. Surely as Head chef I should have a say in who works in kitchen. I don't want some one lazy, I want some one hard working who I can trust and who is reliable. If my boss will listen what should be her first step to dealing with this so she doesn't end up in same situation as last time. Any advice would be much appreciated If you wondering why I'm awake posting this at 3.50am is because a neighbours parrot escaped and is sitting in a tree out side my window sqauking like crazy so cant sleep.   15. This happened on June 19th, I was caught abusing a loophole in the self checkout where I scanned cheaper items to put in heavier, more expensive items down. I had being doing this for a while quite often, but didn't take anything of high value, just food on my lunch breaks. When I was caught, they said they were on to me for the past couple months. I had visited the Tesco only 2 to 3 times a week and at odd times during lunch (could be from 12pm to 2pm) and not everytime I did this, sometimes paying for a bag of crisps, etc. The thing is, the security guard didn't even pull me into their office, he took me to the side and gotten my personal details and didn't even bother calling the police because what I took that day was such a low value. Told me I would receive a letter telling me what action they will take in 2 weeks or so. Just got down my details from my drivers license, paid for what I had taken on that occasion, didn't take a photo of me and said I'm banned from the store. Did not mention civil recovery action. He said it's likely the head office will review the CCTV footage of previous times I went in and will probably take it to the police. I immediately wrote a letter to the store manager and head office, showing deep remorse and apologised, in which the customer service manager replied with a letter thanking me, but not saying what actions the head office will take due to data privacy laws. Not heard anything from the store itself. I was expecting this to trigger a DWF letter to pressure fines on me, but it has almost been 3 months and haven't heard anything else, other than that one letter so it's making me so anxious and worried. If it's taking so long, is it likely the are building a case and the police are getting involved? Or were they pressuring me into not going in again and have just left it at that? Or should I expect a late DWF letter and nothing else? Does it take multiple months to see one of these letters? People have said they're letting me sweat it: it's too much time to sit through hours of CCTV to see what I had took of relatively low value and it would not be cost effective to involve the police, but still a possibility, or it could have even been forgotten about. I have been told it might be sitting in a pile with others, but a lot of people on this forum seem to have received DWF / RLP letters relatively quick. Someone else had even told me there won't be any complicated background police investigation and my punishment would be very minor if I was to receive one, but I am still unsure and very very worried about it still, I stress about it often. I had also been told waiting this long could have potentially harmed any chances of a case, since it would have been proceeded with sooner after the incident? Would they still hold onto CCTV from April to June?
  16. Hi everyone, Last week I stole from a TKMaxx branch. This is the third time I am caught stealing from a shop, and third time I am told about Retail Loss Prevention (It has never been from the same shop/company.) The first time I received a letter and I paid the money that I was told "I had to pay". The second time I actually never received a letter, therefore I never paid anything. However, as this is my third time, I wonder what the consequences can be? Based on posts I've seen on here I shouldn't take RLP too seriously but as this is the third time I'm caught shoplifting I am a bit worried as to what RLP can do and if they can take any legal action. I wonder if they have a database with my information and previous offences? Thank you

  18. Hi guys, On the 12th of september I had just had a mis-carriage and been discharged from hospital. I also had a flight that evening at 9pm to a family wedding in spain. I rushed to primark to gather last minute things; whilst grabbing clothes i was struggling to hold all my shopping and couldn't see any shopping bags near me so i places a PJ set and a bra into my actual handbag. Through the stress and rush I went to the cashier and paid for everything in my hand which was (£40+) and did not pay for the two items in my handbag - which is a huge oversight on my half (but i was very stressed and under a time deadline.) I was approached by security staff who told me i had not paid for items in my bag which i instantly gasped at and offered to pay. However, at this point I can not recall if I had technically left the store as I do feel as if the security had approached me just by the exit. I was very cooperative as I was trying to catch my flight - however one of the security officers was making me feel very uncomfortable telling me how pretty i look and asking me loads of personal questions (which i refused to reply to as I did not see the relevance to the issue at hand.) He then began getting rather rude with me and I asked to see the cctv footage to see if i had actually left the store without paying. They refused to show me the cctv and threatened with police. Which on a normal day I would fight but I had a flight to catch and just wanted the day to be over. I have now received the infamous letter from RLP asking for £150.00!! Just wanted to know what steps I could take forward? Do I send an appeal? I actually am moving to NYC and dont want debt collectors coming to my family home whilst away. Thank you!

Hi all Today I had a moment of insanity, wanted to buy some pants for my daughter, thought £5 was a bit pricey for one pair of pants for a baby and added another pair to the hanger, went to the checkout with my other items paid (only for 1 pair of pants as store operative did not realise what I had done) then left the shop. On leaving the shop saw the security guard and a staff member speaking to him who then immediately looked at me - but no one tried to stop me.. I immediately regret what I did and can honestly say it will never happen again. I would happily go back and pay for the item which is only worth £5. I have a history of anxiety and have not stopped panicking since I left the store. Worried the police are going to turn up and arrest me - that I’ll go to jail and my 3 month old baby will be taken away from me.. I can’t believe I was so careless and stupid over £5! Anyway question is - will the above happen? Am I likely to have the police turn up or will I get a letter with a fine in a few weeks if anything is to come of it? I don’t even know if it was just coincidence the staff member was looking at me while I exited. Surely if it was suspected I would have been stopped then and there? I know it was wrong it won’t happen again just looking for advice Many thanks
  20. Hello all, Posting on behalf of a work colleague. Have passed them site details and suggested they register themselves. The person in question works as a cleaner for a third party company who have a contact with our business. Our business is part of a much larger group who are currently restructuring. As part of the restructure, our business is moving from its current facility to a new shared site along with other parts of the organisation. For this reason our contract with the cleaning company is due be terminated. This now leaves the cleaner, who has 8 years service at this site, all be it possibly with differing cleaning comapanies. By this I mean that although the contracted agent has maybe changed it has always been the person holding the position and performing the duties. They have essentially moved with the contact. They have now been informed that once the closes they are basically redundant. It is also being claimed they they are not entitled to any redundancy as it not them, her employer (cleaning company) who are making them redundant but us as we the ones moving site. No other positions are available for them to be relocated / transferred to. What are their rights in this case ?

Good Morning everyone, My situation is quite complex so please bear with me and any help and uggestions would be greatly appreciated, i will start with a brief statement as to how this all started 15 years ago and then onto the problems i am now facing. In 2003 i applied to remortgage and take equity from my home, i was turned down, i checked my credit reports to see that i had several defaults and a CCJ from Barclays on my acc, after a few years i managed to get all of this sorted with apology letters from Barclays. In 2013 i was again chased for debts that did not belong to me, i tried every avenue possible to get this mistake sorted for a second time but eventually i ended up going to the newspapers and the FOS who then sorted out the problem with Lloyds and Experian with a pathetic £250 compensation, even though id spent 10 times this on phone calls and writing letters/emails etc . Now in 2018 this has all happened again, i have checked my report from all 3 CRAs and Call Credit and Experian are showing defaults, CCJ, addresses i have never lived at, they have even changed my electoral roll entry without any instruction by myself or legal documents to do this. All of this wrong information is for a person with the same first and last name as me and also the same date of birth, however this other person has a middle name and i do not. I received a letter from 02 on the 19th of March chasing a debt for this other person, i immediately checked my credit report, and there it was, 02 had already linked me and the debt/account to my address without doing any checks whatsoever to see if i was the correct person, i DONT have an account with 02. There is then the other accounts from 6 other companies in default that i have never had accounts with and a CCJ which i dont even know what it is for , i just know none of these belong to me as ive never missed a payment on anything or had any dealings with these companies. I have disputed all of this with Call Credit but they refuse to remove all of this wrong information, i have not spoke to any of the companies involved as from past experience they will not speak to me due to data protection when i say i am not the person they seek, but they also dont resolve the problem either, i have since joined checkmyfile and they are trying to sort things out with call credit , but say i have to sort out this mess with Experian myself. I am seeking advice as to what to do next, to be honest the companies reporting all of this wrong information in my eyes need to pay, i am busy renovating my home and considering an extension as my wife is 8 months pregnant but i am now reluctant to apply for any loans/remortgage etc as i know i will be turned down, and as you can expect for this to happen a 3rd time my stress levels have went through the roof. Companies listing defaults on my report who i have no dealings with at all and ruining my credit report because of there incompetence to check they have the correct person are: Lloyds Bank (again) Lowell Vanquis Bank Capital One Hoist Portfolio Home retail group 02 ( who reported and made the link with callcredit , even though this serial debtor has paid his bill now, so is not showing as a default, but its now to late as they have done the damage) Thank you kindly to anyone that can help.   23. its hopefully a quick query recently we have had a communication at work (large company merged recently) previously if we have worked a bank holiday (usually 10 hours) we have been paid time and a half for this and earnt time in leu - this has been 10 hours recently we noticed that the hours for this hadnt been added, after alot of chasing we were told that they were now added at the start of the holiday year. however we have only been granted 7.5 hours per bank holiday, their reasoning for has only just been given to us copied below --- To confirm a payroll week runs from Sunday to Saturday and the payroll team will process this accordingly, with this in mind, certain rota’s will either work three or four days per week. For the vast majority of our colleagues a full time working week is 37.5 hours per week, which equates to 1,950 hours over the year (37.5 hours per week x 52 weeks in a year) – regardless of shift pattern. This includes the MyTime rota, as additional hours worked are given in lieu time. The standard contract template is 5 over 7, so holiday entitlement is calculated as 7.5 hours x the contractual number of days entitlement for that colleague. --- this would be fine if we WORKED 7.5 hours a bank holiday however we work between 10 and 11 hours on a bank holiday, even worse they have based the hours over a 5/7 contract most of our workplace is on a 4on 4off rota, in my case im on flexible working and my current time is either 3 or 4 days in 7 we have asked for explanations but just keep being given the same details as above we have also been told that if we want the days the business is closed off (christmas day etc) then we have to book it off, on asking if that means we have to give the 7.5 hours back we have been told that no we have to use 10/11 hours of holiday time any advice?
  24. Hi I'm looking for a bit of advice regarding a debt collection agency that is hounding me at the moment... I have a few very old debts,credit cards and Catalogue debt that will be statute barred come December but this debt collector is now planning to issue CCJ's on them... There's a couple of these debts where i have grounds to dispute them as they are actually not my fault as the originally company just didn't attempt to take any payments off me for over 12 months and when they realised they demanded all the back payments all at once... My question is are there guidelines on how long it should take a dca to go for CCJ's ??or can they effectively stretch the effects of them out on your credit file over 12 years by waiting the 6 years before issuing CCJ's which will then last for another 6 ??? Thanks

A recent report claims that the costs of alcohol use to the government in England – including the NHS, police, criminal justice and welfare costs – amount to just under £4 billion a year, while tax revenue from alcohol comes to over £10 billion. So for all the deaths, misery and ruined lives they still manage to make a 6 billion pound profit on this drug, no wonder its legal, now if the country wants to get back up on its feet here is an idea. Legalise a far safer and less anti social drug namely cannabis. Allow people to grow cannabis in their own homes so that can they sell any excess to the pharmaceutical industry, this will spawn a whole new cottage industry in itself which this country desperately needs. It will have multiple benefits, huge savings on the police bill, it will create thousands of jobs and generate a huge amount of money through taxation, it will also deal a massive blow to the criminal gangs who take advantage of the situation.
