  1. I hope this is in the right place, please would any mod kindly move if not. I would appreciate any guidance along the way from pple more versed in the small claims court. Lowell Solicitors have lodged a claim with Northampton, particulars as follows. Issue Date: 18-1-2016 Amount approx: under £600 Claimant: Lowell Portfolio 1 LTD Solicitor: Lowell Solicitors Limited Original Credit: Shopacheck Particulars of Claim: 1) The defendant entered into a Consumer Credit Act 1974 regulated agreement with Shopacheck under account reference ******** ("the agreement"). 2) The defendant failed to maintain the required payments and a default notice was served and not complied with. 3) The agreement was later assigned to the claimant on **/**/2012 and notice given to the defendant. 4) Despite repeated requests for payment, the sum of *** remains due and outstanding. And the claimant claims a) The said sum of *** b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, acrruing at a daily rate of *** but limited to one year, being ***. c) Costs What I have done so far: 1) Acknowledgement of service - Online MCOL Website (20/01/2016) 2) Sent CCA REQUEST - £1 postal order - Signed For Post (21/01/2016) - Lowell Portfolio I Ltd 3) Sent CPR 31.14 - Requesting Default Notice, CCA Agreement and assignment - Signed For Post (21/01/2016) - Lowell Solicitors I Cannot for the life of me remember having shopacheck, but then again in 2012 my head was up my proverbial **** as my mother died that year. I have never received any default notice from Shopacheck or Lowells, I am very good with paperwork/documents/post, everything that comes that is official if filed in ring binder boxes... If I had received any default notice I would have acted. Also, I never received any letter from Shopacheck / Lowells to inform me that the debt has been re-assigned. I am not denying the loan but also am not accepting it as I just do not know, what I do know is I have had 20 + loans from shopacheck in the past since circa 2000 , so do have a financial history with the company I have looked through any/all paper work kept from previous loans but cannot find details of the one they are referring to with the reference number they gave me in the Particulars of Claim. So, as of 15/02/2016, Lowell Portfolio I Ltd have not replied to the CCA, Lowell Solicitors did reply to the CPR stating they are requesting the documents but that is as far as it went, they refused to answer my question asking for an agreement to extend the time for filing defence. Last night I filed my defence in time for the 15/02/2016 defence deadline. the defence was along the lines of this link Thanks to anyone who can help with guidance along the way
  2. Hi guys just a quick question. I am slowly but surely getting myself back on my feet financially. Over the years I have used doorstep lenders such as shopacheck. In February I Will pay my last ever payment. My question is when I borrow money I would pay so much off then re loan this was a vicious circle that went on for years. Could I claim any of this money back as when I reloaned I would always pay off the interest and never receive the full amount of the new loan. It would be very nice if I could. Thanks bd
  3. Please advise! I have an account with the Shopacheck and have always been a good customer in that I always paid on time and paid off quickly. However since the beginning of September no agent has called at my address. I contacted them and we agreed a day and timespan. However the agent has still failed to appear and I am now getting stroppy letters from Shopacheck accusing me of defaulting on the agreement. I have rung Head Office and their attitude is that it is my responsibilty to pay but I have no way of paying without an agent calleing round. I have the money ready but no-one to give it to. What can I do? there does not seem to be a local office. All I want to do is pay it. I am so cross as the agent in question is claiming that he has been calling round and is blatantly lying.
  4. I had a loan from these people in Dec2008. I don't remember paying any payments. It wasn't a good time for me. It shows on my CrA files as settled so I assume it was purchased. Fredrickson are now chasing. There is no default showing on file. I live in Scotland. Is this statute barred in December this year? I have not had any assignment notices from Fredricksons. Letter fro Bryan carter says that Freds have recorded a default. Help please!!!
  5. Hi my wife has been paying shopacheck for years now we were down to paying £3 a week. We owe approx. £100.The loans were from 2003 Then when the new government legislation came in IE bedroom tax etc. we had to drop this to £1 a week. I am disabled on ESA Support. After a couple of weeks the agent stopped calling. We then received a letter from shopacheck telling us we needed to pay the contracted payment. I wrote back and told them that is all we can afford, They then said they were going to send someone to my house, I sent them a letter to the effect of do not darken my door etc. As shopacheck have now got very unpleasant I decided to send them a cca request. What we received back was a Recon of an amount we have not borrowed, It looks like all the accounts have been consolidated together, It also states 0% Interest. My question is as these loans were taken out in 2003 would a reconstructed agreement stand up in court, As I was led to believe a debt before April 2007 would need to have the original signed agreement, To enforce the debt. And also as the amount stated on the recon does not amount to any loan we have taken out before, would this recon be enforceable in court.   6. Hi, My problem relates to my girlfriend who has loans out with provident, greenwood and shopacheck. She works 21 hours a week and 6 months ago she was able to pay these loans off but then her youngest turned 20 and left education which meant she lost all her benefits and as she only works 21 hours a week she cant even get working tax credits. She is now finding it hard to repay these loans, she fell behind in her rent which has led to her giving up her house a nd the housing executive is taking her to court to get the rent owed off her. At the minute these loans are taking most of her wages every month which is the reason she cant pay the rent owed. I have come here to see if i can get any information on how she can get these loan repayments reduced to an amount that she can comfortly afford on a weekly basis so she can start to get back on her feet as she is getting so depressed over it all. I have told her some of what i know which sorry to say isnt alot about what she can do, so any and all information would be greatly appreciated....
  7. I had an account with Shopacheck which, according to the CRA`s is settled. Today i got a letter from Lowells looking for payment. I wont be paying them a penny but other than ignoring, what should I do

  9. Hi Caggers Just after your thoughts on dealing with this on behalf of a friend. Now approx 2yrs ago they took out a small load all payed off and settled. Since then Shopacheck has constantly been sending out letters trying there best to get them to take out another load even though they never agreed to these letters. I have the latest one which he gave me and I was quiet surprised at there tactics to basically try to keep people that for whatever reason they end up using these companies in there debt with these constant letters. I have even seen the BBC article from 2004 on this companies tactics and it seem they aint changed. I have told him to make a formal complaint to the company and to add in that this is not tantamount to Harassment and remind them of the The Protection from Harassment Act 1997 and OFT Debt Collection Guidance an Unfair or improper business practices. Now this is just a sample from their last letter: Dear XXXXXXXXXXXX You've had a load with us before so you'll know how useful they are. There are lots of events happening this summer. Maybe you would like to celebrate them, or prehaps you'd like to plan a summer getaway. Whatever it is you'd like to do we may be able to help you with a new loan. As a former customer we'd like to welcome you back with a loan of up to £500* subject to approval. All he is wanting is them to stop and has asked them to but to no avail. Your thoughts as always very much appreciated on anything else to hit them with.
