  1. I hope this is the right place for this question. I currently receive ESA, but am considering trying to get back into work, although I'm not sure if I'm ready. I'm interested in a job with the NHS, but am worried that if I apply, but don't get the job or don't feel well enough to accept when I learn more about it, the NHS will nevertheless share the information about my application with the DWP, which will affect my ESA. So, would the NHS be able to share my personal data/details of the application with the DWP in these circumstances? Thank you in advance.
  2. Afternoon everyone, I have an issue with Eon Energy. I checked my credit score as I'm about to apply for a mortgage and saw that I have 2 accounts with them. One current one which is up to date and in £250 credit, and one earlier one that has lots of irregular missed payments and is closed and marked as settled. See image... I've been over and over with them for weeks about this and they can't really explain it. They said at some point I switched providers and then came back. They also have no record of me being a client prior to 2013 yet they have been reporting on late and missed payments during this period. This has gone to the Complaints department, then Alternative Dispute Resolution department and to their datashare department. Their datashare say the info is valid and they will not amend anything. Only step now is the financial ombudsman, I really don't have the energy to deal with this. I'm leaving Eon for another energy provider as I've had enough. What I ultimately want to know is, will this 2nd Eon account from 2012-2014 showing missed payments affect my mortgage application? Other than this, my other accounts are 100% in excellent order and my wife's credit file is also 100% excellent.
  3. I have a current packaged bank account complaint and can confirm the FOS's poor practises. Important info in my case was drip fed to the FOS from the bank without my disclosure. The FOS caseworker would ring me sometimes 5 days later than agreed. The caseworker would then ambush me on the phone about information I knew nothing about, hardly good advocacy at any level. The They could not even read a bank statement correctly which led to sleepless nights because the FOS caseworker attributed a 11k withdrawal to the wrong company making me believe fraud had occurred, that is until many weeks later once I got sight of the bank statements I requested from the FSO and realised the FSO caseworker's school boy error. Even when I demanded the case be dealt with by another caseworker due to incompetence this was ignored and a decision railroaded. Now I have a legitimate claim for harassment against the caseworker for refusing to hand the case over and for continuing to ring me trying to harass me with questions about information not prior disclosed to me. I held a senior management post at The Home Office for over 23 years so I am used to dealing with casework and policy matters at all levels. I believe I am well qualified therefore to categorically state what a complete mess and state of denial the FOS is in. Until MP's experience this poor level of service I seriously doubt things will change for the better.
  4. Hi, I've just ordered something over the internet and had a call back from the company in question to confirm my identity. They apparently used Equifax to do this, which is fine. What concerns me is that the person on the phone was able to see some very very specific details about me e.g. Broadband Accounts and Balances Banking Details e.g. which bank, when I openend the x number of accounts at them Old CC Accounts Are they supposed to be giving any of this information away? Furthermore, are those companies in question e.g. the banks, broadband providers supposed to be allowing Equifax to pass my details on to third parties? This is EXTREMELY disturbing... Is there anything I can do about this? I understand that there's a need for credit reports, but I was categorically told by Barclays that all that's ever shared is a "probability number" rather than personal details.   5. Sorry if ive posted in the wrong place, I have recently got divorced and having an NHS pension have had to surrender 24% to my ex. I have just had a letter from her solicitors demanding £3117 as admin and implementation fee which after checking on the nhs pensions website is valid, my issue is, as an ambulance man I don't tend to carry that sort of money round ( I wish I did) I have bad credit because of the marriage and after paying £425 pcm maintenance I don't have a lot left to live on, any ideas for a solution to this matter anyone, it would be appreciated.
  6. Hey I have been advised to post my story here then once it has been assessed it can be moved to the correct section. I had an account with 2checkout.com back in 2012, the account was closed in September 2012. My father recently applied for an account with them and they advised he failed background checks, he contacted them for more information to find out the issues and work to resolve them. The person on the phone told him he had already had an account in 2012 which was closed. My father has never had an account with them and asked for them to email this so called account information to him. They emailed him my account number from their website and details for when the account was opened and closed. I know my father is not going to be doing anything with the information but fact is they still shared the information. My father had provided drivers licence and utility bill during the application. Myself and my father do not have the same first name only surname. My father phoned back again after receiving the email with my account information on only to be met with a reply of "nothing we can do, I have other customers to deal with in the queue, goodbye" I am confused how to complain, yes my father is not going to abuse the account information they shared but surely this breaks data protection Any advise on what to do next will be great

  10. Hello all. I want to stop my local council sharing our data with our social housing landlord. Is this under the DPA 1998 or 1989? Or does it mater which one?
  11. Good morning. I was wondering if someone has the definitive answer to this one: Is it still the case that a supplier has to have a consumer's signed agreement before they are allowed to share the consumer's information with a credit reference agency? I have had an electricity and gas account with utilities supplier "Eon" since April 2011. It was arranged over the telephone. There is no signed agreement. When the account was opened over the telephone they did not ask me to confirm that I agree to allow them to share my information with a credit reference agency, or indeed any other third party. For the record, they also didn't state that they would be doing this at all. From googling around they seem to be receiving quite a number of Injunctive Relief Orders from customers who believe that Eon has committed a breach of the Data Protection Act by sharing their info with Credit Reference Agencies, and appear to be being successful in having the account and all data removed from their file. If they are actually legally allowed to share my information with credit reference agencies, I believe they have made some mistakes with my account and I am struggling to get them resolved. 1. My account began in April 2011 when we moved into the property. According to Experian it didn't begin until 6 months later in October 2011. 2. There are no payments, no information whatsoever recorded in the months between the incorrect start date of October 2011 and May 2012 inclusive. 3. There are 4 red "payment late" boxes recorded on the account between June and September 2012 4. There is no information recorded in the boxes between October and December 2012. We were late for the payments between June and September 2012 - A combination of being outside UK and a regular problem with post not arriving. This was resolved in December and we are no clearing the balance by direct debit. The first payment was made in December. In a call to Eon this morning, I pointed out the incorrect account start date, and that in every other credit account that I have recorded on Equifax, both the positive and the negative information is recorded - So any payments that are made are shown in green and any payments that are late are shown in red. I also pointed out that as this is not the case it looks to anyone checking my file that I have made absolutely no payments in the history of the account. Whilst all of my other credit history is excellent, this one misrepresented account it causing my credit score to be recored as "Very Poor". I also pointed out that even if they had recorded all of the payments that I HAD made on the account, that because the account opening date was incorrectly reported by 6 months on my Equifax report, that ratio of payments made on time against those that weren't made on time over the incorrectly reported period of the account would also be inaccurate and look worse than it actually is. The CSR I spoke with spoke a lady in Credit Reporting. The CSR came back to me and gave me the following answers via the lady in Credit Reporting: 1. Eon are aware that the start date of customers accounts are incorrect on Equifax. Apparently if they change the date at their end it reverts back to the incorrect date the following month. 2. As Eon didn't have a payment agreement with me at the time, they are unable to record the payments I made on my account. I pointed out that if not having a payment agreement with them excludes them from being able to record the payments I have made in the months I have made them, then surely it also excludes them from recording the payments I haven't made in the months I haven't made them.........Apparently it doesn't work like that Sir, although no further explanation could be given. 3. I agreed in November 2012 to pay off the balance that was owed along with new usage monthly by direct debit beginning on December 3rd. Despite now having a payment agreement with them, Eon states that they do not display any information on any monthly payments that have been made by customers.....Only those payments that aren't made....So even with a payment agreement they're still only reporting the negative payment information and not the positive......Surely this isn't correct. No other organisation with whom I have a credit account reported on Equifax behaves like this....They record good and bad to give a fair and accurate picture of my credit worthiness. Eon's behaviour just makes their customers look bad, even if they pay. 3. Eon reckons that the Data Protection Act allows them to share customers information with third parties including credit reference agencies without a signed contract or agreement with a customer because they point out that they will be doing so in their terms and conditions. Even if that is the correct interpretation of the law and no signature or agreement by the customer is required, as far as I am aware Eon only started doing this in 2012 - They started supplying with gas and electricity long before this in April 2011 - I wonder if the fact that the account incorrectly shows that it begun 6 months later in October is something to do with the law changing? Either way, I have never signed any contract or agreement with them of any kind. They never asked me if I wished to allow them to, or stated that they would share my information with any third party or credit reference agency when I started the account in April. I have been advised by their CSR to write to the Ombudsman, or report anything I am unhappy with to Equifax who will report it back to the lady in Eon Credit Reporting. Apparently it's pointless writing directly to Eon Credit Reporting - It smacks to me that Eon is chucking any old nonsense on Equifax reports, and relying upon Equifax to resolve their mistakes for them. In the meantime, my credit rating is being seriously screwed up by one organisation's ineptitude. Do I have grounds to threaten Eon with an Injunctive Relief Order? It seems to me that any other path could take a long, long time, and I would quite like to apply for a mortgage NOW!

  13. I just thought I would share some good news and hope to people who were in my position. After reading through hours of horus on here, and taking some fantastic advice from people on here (thank you) I have sorted out all my defaults on my PDL's, and the only one left who will not agree to anything are Pay Day Express and Tooth Fairy are just ignoring me. Pounds to Pockets are sending generic emails, but I am paying them the amount I can afford in the meantime anyway. The others were not that bad, Wage Day advance agreed with only 2 emails being exchanged, as did Wonga, and Payday Uk were hard work but after a fab letter (from someone on here) they also agreed. The reason for posting this, is for people coming on here for help you are in the right place, I felt like my head was going to explode with all this debt and now im more than half way there, I thought I would share some good news I also have all the bank details of people I am paying back as on sound advice I have a parachute account! I thought I would list them to see if it useful to anyone else.
