I received Notice of assignment 14 day befor court date 12/09/17.It's a reconstituted copy.its dated 10/10/14 not seen before Did you receive a Default Notice from the original creditor? yes on 12/09/17 14 days before court (although dated 08/09/13) not seen before Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year no but moved house twice Why did you cease payments? financial difficulties What was the date of your last payment? 11/06/13 Was there a dispute with the original creditor that remains unresolved? no Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management planicon? no I have done CPR 31.14 to both lowell and capital one sent 08/03/17 I have done section 77-79 to both capital one and lowell 08/03/17 CCA sent to me on 29/03/17 after a letter dated 20/03/17 from capital one that they couldn't help me as address they had on record did not match the address on my letter. Lowell wrote to me on 20/03/17 stating that they enclosed a copy of their client Lowell portfolio 1 ltd informing you of there intentions with regards to your account and to treat that as notice of assignment. Those letters were dated 11/02/17 I have a couple of questions 1) Notice of assignment The letter date 11/02/17 regarding treating that as NOA can they do that? as they have not put it with evidence for court. The NOa that they have submitted with court papers I have never seen before they say it was sent by regular post. It has my current address on it an address that capital One admitted they didnt have on record until March 2017 NOA IS dated 10/10/14. It is also signed by Micheal Woodburn who I believe left Capital one in February 2014. As I have said Lowell saying reconstituted copy. yet claim NOA sent in 2014 why can they not produce the original? I believe the reconstituted copy is in fact a template that Lowell just copy. It's not on headed paper, there no address on it regarding its from from capital one. 2) Lowell solicitor (paralegal) hasn't signed her witness statement she has printed name but no signature. (all other paperwork has been signed any advice i have 10 days before court

  4. Another report predicting the end of the world due to an asteroid. Every week in a newspaper there is a report of someone predicting the end of human life on Earth due to an asteroid hit. Of course this is just in someones imagination and there is no proof. But if there was an asteriod due to hit the Earth causing either huge damage to countries or the end of all human life, would NASA or any other official body make any announcement ? Of course the answer is no announcement would be made and any reports of asteroids likely to be catastrophic would be denied. There would be a total panic with people running riot in public, committing crimes and doing things because of the limited time left. The chances are that no asteroid announcement would be made until it was visable to many and it could not be denied. A few months ago an asteriod that had not been identified previously was a near miss to Earth in space terms, proving that NASA and other bodies cannot currently track all asteriods.

  8. hi, I'm wondering if its still possible to reclaim mortgage fees as of September 2013. Have things changed? I'm now coming across PPI reclaim firms offering to reclaim mortgage arrears. I had a mortgage with the evil GMAC. They repossessed 3 years ago and Paratus AMC are still after me for £4,777.91. I've written to them and told them that they owe me £5504.73. AMC Paratus wrote back in reply and said that I still owe this money and that I am to repay it and failure to repay it would result in alternative actions to recover the debt. Is it still possible to reclaim the charges they levied against me? Should I proceed through the FSO or the courts? Does anyone have recent experience of dealing with AMC?   9. We have received court papers for possession of our rented house, the case is due to be heard on 28 September 2013. The landlord has failed to and refused to place our deposit in a TDS. We have proof by way of signed receipt from the agent that the deposit was received, it is also in our tenancy agreement that it has been paid. Is the correct way to go about claiming deposit back and compensation by using the counterclaim section of the landlords claim for possession? or would this have to be done in our own separate claim? Is it worth me doing it? or should I involve one of the many firms who are currently doing No Win no Fee? thanks in advance for your help AGAIN!!! these forums have been so helpful to me in the past to which I extend my gratitude. thepalace1
  10. Although this doesnt affect me, I am taking an interest - I didnt realise that it only affected those living in 4 council areas until September. I wonder why those 4 areas have been chosen for the Pilot scheme ? Hopefully by then, it will be proved to be another disaster and it will be stopped. Dear Ell-Enn, I got your details after carrying out some research on the Internet and various forums regarding the same predicament I find myself in, with a Notice of Eviction due on 6th September 2012. Detailed below is the full synopsis: On the 25th of June 2008, I purchased my current residence via an interest only mortgage obtained through Santander Bank. The total property was valued at GBP 387,500 and the mortgage was for GBP 343,000 Monthly payments were consistently paid for 2 1/2 years until I ran into financial trouble as a result of high hospital bills for one of my family members resulting in arrears to the tune of GBP 15,000/- As a result of the arrears, I attended a Court Hearing in early December 2010 in which the judge issued a Suspended Possession Order provided the mortgage payment of GBP 1315 + an additional GBP 100 would be made payable to Santander against the arrears. We, my wife and I, both joint owners of the mortgage continued to make consistent monthly payments of the mortagage + arrears ensuring we were never late or fell behind. Inspite of being made redundant in December of 2011, we continued to make our monthly payments until all our savings dried up. I have not been able to make any additional payments since June 2012 which has only resulted in an increase in arrears. I am now in a situation where I have been issued with this Eviction notice but yet firmly believe I am in a position to repay the arrears and continue to meet my monthly commitments provided I be given an extension on repayment. I have now been offered a position as a UK representative for a USA firm and will commence employment on 1st October 2012, with an annual salary of GBP 35,000/- My wife is in part time employment, works 24 hours a week, and receives an annual salary of GBP 28,000/- > Further to my wife and me, we have two children, one aged 10 and the other > 3, both who are on the "SENCO" (Special Needs Register for Children) as > they are both diagnosed with Asperger's Syndrome, which is on the Autistic > Spectrum. By way of background, following the Energy Supply Probe – link opens in a new browser window, Ofgem put in place a new version of standard licence condition 25 with a view to helping domestic customers make well-informed decisions in response to telephone and face-to-face sales activities. In particular, there are new requirements for domestic suppliers to provide estimates and comparisons during face-to-face sales activities (with effect from 18 January 2010) and to secure the achievement of an objective in respect of both face-to-face and telesales activities (with effect from 21 October 2009). In summary, the objective requires domestic suppliers to take all reasonable steps to ensure information provided is complete and accurate, understandable, appropriate and not misleading, and that sales activities are conducted in a fair, transparent, appropriate and professional manner.
