Hi to all - I can see from a quick search that 'Blemain' is a popular talking point I have had a secret commission claim against Blemain with [removed] since 2015 and it hasn't gone anywhere in the 30 months since then at all. I've struggled to get any meaningful update from them for some time excluding the committal generic updates we sporadically receive. I've noted on other forums that other [removed] clients are posting that [removed] have run out of money and no longer have the skilled staff to settle the claims. If it is true and they have run out of cash, surely Blemain will just stall our claim as long as possible until they go into admin? Does anyone know if the capital adequacy rules apply to CMCs like they do to firms authorised by the FCA? Does anyone know any other claims companies are running these sorts of claims? Ideally I would be interested in speaking to law firms rather than a CMC (as [removed] are) as surely it is better if the firm acting for me is allowed to issue a claim in the Courts? I'm also worried about limitation and when my claim becomes statute barred. If anyone can help with this, please let me know.

  3. Hi, I wonder if anyone could offer some advice? I received a letter from a firm of solicitors stating that a small secured loan I took out in 1997 was possibly subject to a secret commission. They included a copy of the mortgage deed but nothing else. They wanted me to sign a contract for their fee of 35% of monies they claimed back + contribution towards legal costs from GE Money. I wrote to them stating that I thought 35% a bit much - they replied saying that they weren't even sure that there was a claim to be had, but their initial investigations would be free and if a claim was pursuable, their fees could be less depending on the amount claimable. I have now received an offer from GE Money via the solicitors to pay:- the secret commission + contractural interest from the date I entered the loan to the date it was redeemed + 6% interest from the date the loan was redeemed ("delay interest") less 20% of daily interest paid to HMRC + the fee I paid to the broker + contribution towards legal costs. SO out of approx £1500 I get approx £800. This deal is on the table until the end of January and includes a confidentiality clause. Does this sound about right? I have spent many hours looking into this, and researching Hurstanger - unlike HUrstanger, this is a proper secret commission (in that I knew nothing about it at all - I thought the only commission being paid was the one I made). Whilst I am grateful for the heads up re; secret commission (I had never heard of it), I have no idea where these solicitors have got my details from, where they got a copy of my mortgage deed from, or if this is worth pursuing..... Obviously £800 is an unexpected bonus after all of these years, am I being greedy thinking that there should be more? Should interest be paid on the whole amount of commission + contractural interest that I paid, not just on the secret commission? If I were taking them to court myself the rate would be 8%?... In the meantime the solicitors are pressing me to sign the agreement and send it back to them before the end of the month when it expires. Thanks in advance This loan was 18 years ago, is there no time limit on making a claim?

  5. Just got a £70 fine for 'overstaying' in Aldi's Boscombe store. As a paying customer I would expect to at least be informed that this time restriction was in place. Signage is appalling. I would have gone elsewhere to do my shopping if I had known about the ?70 tax on shopping at Aldi. Apparently there is a machine inside you're meant to put your registration number into - only they try not to let you know as it is more profitable for them to get their hired thugs to send court threats and fines. I now have to deal with Parking Eye - a well documented bunch of cowboy bullies with a notorious reputation for ripping off the general public. I guess it's not just the shoddy products that help Aldi keep its prices low. It's now using underhand and sneaky tactics to help its bullyboy business partner threaten its customers with court - for a share of the booty presumably. Not only that but #ParkingEye issued the ticket on June 20 and it didn't arrive until July 6. Even Royal Mail aren't that bad. Something devious is going on to make it impossible to pay the 'reduced' amount of £40. Not that I am going to pay a penny for this cheating [problem]. Don't expect me back in Aldi anytime soon.

  7. Can I share something with you all - We have just been screwed by Latminute.com's secret hotel booking and I wish to make sure nobody does the same as I. We are going to my Brother in-law's 70th birthday bash in Bristol this coming June and wanted to stay overnight near to St.Paul's so used LASTMINUTE.COM Secret Hotel and bang we have now got a hotel that is a 30 minute drive from Bristol in another county! Not the hotel which is southwest of Bristol city center as the web site implies but a hotel which is in North Somerset! nearer to WESTON SUPER MARE than Bristol.., Have spoken to LASTMINUTE.COM in India and had no response apart than the party line, spoken with the Secret Hotel and again no real response, have spoken to the Secret Hotels parent company in the USA again no real response! SO I have been duped by LASTMINUTE.COM but don't you get done - don't book with LASTMINUTE.COM - support my crusade and do not use their Internet site,

  9. My dog sleeps about 20 hours a day. He has his food prepared for him. He can eat whenever he wants. His meals are provided at no cost to him. He visits the Doctor once a year for his checkup, and again during the year if any medical needs arise. For this he pays nothing, and nothing is required of him. He lives in a nice neighborhood in a house that is much larger than he needs, but he is not required to do any upkeep. He makes no contribution to the running or maintenance of the house. If he makes a mess, someone else cleans it up. He has his choice of luxurious places to sleep. He receives these accomodations absolutely free. He is living like a King, and has absolutely no expenses whatsoever. All of his costs are picked up by others who go out, work hard, and earn a living every day. I was just thinking about all this, and suddenly it hit me like a brick in the head. I think my dog is an IMMIGRANT!!!

I appreciate this may be a little unusual but.... say you come out of fixed term contract with Company X for whatever reason, but have signed an agreement and other instruments that you are never to disclose: a) That you worked there; b) The type of work that you did; c) The people who you worked with d) The location of your work, or any other sites, e) Any training or skills acquired through that position No references or ANYTHING from Company X can be provided as a result, but Company X offers a rather generous "golden goodbye" package but not so generous as to last forever! How do you best explain a massive gap in employment to future employers/benefits agency etc? Presumably if you apply to another employer, they are going to want an explanation of a "blank" gap of (say) 6 years. Equally, if ever needing things like benefits/pensions etc, presumably the Benefits agencies would want to know your employment history? If revealing the previous employment details could be classed as a criminal offence, or at best, one with a serious financial implication,what would be the recommended strategy to getting another (good paying, non-menial) job in the future? So, simply, how do you explain a massive unverifiable black-hole in your CV and still get a decent job?
  11. Hello All! I have not posted here for a while mainly due to ill health. However,as I feel abit better,I want to run through with you folks as written below: Scenario as follows: 1.Obtained unsecured loan for doubleglazing just over 10 years ago. 2.The loan had PPI added to it 3.After obtaining a SAR it was revealed that there was a “secret commission”. 4.Original creditor sells debt to DCA . 5.Arrangement is made to clear the debt(Tomlin Order) with DCA. 6.Arrangement is broken and CCJ is obtained by DCA. 7.CCJ was then followed by Charging Order on my home. 8.Having read through various posts the original debt seems to be unenforceable mainly due the “secret commission” . 9.The commission was given to the dg salesperson that I was purchasing at the time. 10.The company that I had bought the dg went into liquidation a few years ago. All the above happened several years ago. I have been too ill to deal with this earlier but feel abit better and ready to deal with this now. My questions are as follows: a.What is the best way forward in order to sue either/both the original creditor and the DCA and get the CCJ removed? TAKING INTO ACCOUNT…. 1,The original creditor should have never sold the debt as there was an ongoing dispute. 2.Also as it seems that both parties knew that the debt was unenforceable. 3.I did receive a rebate of PPI from the DCA but I still believe the balance has an element of PPI remaining due to compound interest. b. How can a DCA go to court,obtain a CCJ and then a Charging Order with the full knowledge that it has no right to enforce the debt in the first place? Is this not a form of fraud or deceit? Or worse i.e.contempt of court? c.Can I obtain a refund of any of the payments that I have made whether to the Original Creditor and/or the DCA? Naturally I would have already made more than enough payments to cover the value of the “cash purchase” value plus some interest. d.Is it correct to say that I would only legally owe the value of the item but not the interest as the secret commission voids the agreement? If you have any questions,please just ask. Many thanks in advance. Note:I have NOT included the name of the DCA due to ongoing litigation.
