  1. 12 july 2015 Hi, Please can someone help me, its urgent and I am very worried. Just to give you a brief background I am a single mother and was diagnosed with a chronic pain condition at a young age and Iv had for many years other health issues have now made me worse like diabetes, Ibs, arthritis and more. Iv also had to be there for my mother who is bed ridden after a car accident and my step father who for many years had liver disease and was very ill before he died a couple of years ago. I have tried to go back to college and university where I now have a degree but its been really difficult iv also had battles with neighbours, bullying with the children in school etc as well as problems with debt people. Iv been trying so hard to get my life back on track and my credit report and feel that I cant win because there is not enough hours in the day or my health is constantly giving me problems or looking after everyone else is over whelming. I also have dyslexia also so paperwork is a struggle the last few months my mum has been very ill after a suspected stroke, heart was checked out and now she has lost the feeling down one whole side of the body. Due to this and all my other issues including being forced back to work which I was trying to do but I was trying to do it in my time due to my health, my paperwork has had to take a back seat. Recently iv gone through some letters I didn't know that santandar were trying to take me to court and missed the dates etc. I have now received this letter that I have enclosed it on your site for you to see and I am very frightened I don't have a lot but what I do have I cant afford to loose especially when Im trying so hard to get work and start a business if I can, but due to me struggling with everything and feeling very over whelmed and I don't know what to do. Please can some one help me to sort this out quickly, so I don't loose anything. I do have other debts but I feel I need to just work one debt at a time at the moment due to trying to cope with everything and my dyslexia. I have years of this actually going on and my mum helped me pay off this account so that I thought and I moved over to another bank for a new start only to find out latter that I had a debt, I need to go through years of statements which I don't have all of them because I believe at the time they were giving me charges for anything and everything and at one point I was in college/uni and was supposed to be a student and not get any charges at all because I was a student. So I feel let down by this company. Since I have gone over to a new bank iv never had such problems or charges etc ever again. Thanks in advance to everyone. Roguehunter
  2. Hi Hope some one can help me on this. I sent santandar a CCA request for a credit card. They've responded by saying that they do not hold a signed copy as it was an online application and have sent me terms and conditions. Can i send them the default notice now are they in default? Can they enforce this now as they have no signed agreement. Many many thanks in advance...LLew
  3. A friend of mine was in despair following Santander not only charging him for a failed direct debit,but then continued to add further daily charges. He informed me that he had called them and emailed them,explaining that the charges were punitive since his only income is Jobseekers allowance. The fees stood at £55 and were rising. He asked me if I could help,and duly wrote him a letter. I was finding it hard to understand,how a bank like Santander,were openly flouting their obligations. My friend had pleaded with them and explained his situation. Santander of course could see from the account too-that he was in reciept of benefits since they were paid into this account. No excuses then...lets get to work. Account number xxxxxxxxxxx Sort Code xx xx xx letter before action Dear Sir/Madam, I am very disappointed in your response to my complaints which were made to you today, and that you have chosen to ignore my request for hardship, I therefore have no alternative but to seek recourse through the county court system. I believe that Santander have treated me unfairly under the following BCOB rules of which Santander should be compliant with,since Santander is a firm regulated by the FSA. Rule 5.1.1 R states “A firm must provide a service in relation to a retail banking service which is prompt, efficient and fair to a banking customer and which has regard to any communications or financial promotion made by the firm to the banking customer from time to time.” Rule 5.1.4 G “Principle 6 requires a firm to pay due regard to the interests of its customers and to treat them fairly. In particular, a firm should deal fairly with a banking customer whom it has reason to believe is in financial difficulty.” Santandar have been informed that I am in reciept of state benefits and that I need these to cover essential living costs including food and heat/lighting. Santander have not at any point acknowledged that this is a hardship case despite me notifying you.You have levied charges of £55 in recent days,and have refused to refund these in your return call to me on 6th.June. For these grounds I feel that I have been treated unfairly. In order for this claim to be settled without the need for court action I require that the full amount taken of £55 returned to me by way of a credit to my account. If I have not received a satisfactory response within 14 days then court action will be commenced without further notice and further costs will be incurred. A judgment for a breach of BCOBS is very serious and the FSA would be empowered to act. Yours Faithfully Mr V. Message: Good Afternoon Mr V. Upset Thank you for your email. I am happy to reverse the amount of £55, which have been waived due to exceptional circumstances. To ensure no further charges are incurred on your accounts, we would ask you to monitor your accounts throughout the month. This can be completed through Online Banking, Local Branch and Telephone Banking.
