  1. I'm livid - today we have received a £100!!!!! 'charge' for parking 'longer than the maximum period permitted' (which is 60mins) on the 9th Feb 2019. We went to see an evening performance at Theatre Deli and parked in the carpark directly outside the theatre, which is on a small retail park (it used to be a carpet shop). A theatre performance is obviously going to last more than an hour, and as there were no pay machines we presumed it was free to park (especially on an evening). The notice is dated 21.2.19, the envelope does not have a post mark. The PCN is from VCS Ltd who are members of IPC. Happy to provide more info if needed. Please help me sort this as quickly and easily as possible.

I've dug the envelope out of the bin, it does not have a postmark. The contravention date is 9th Feb.

  4. Wow so happy to have found you CAG. Fingers crossed I can beat this. I am devastated, treated myself and a friend to a theatre show tickets were about £7 each. We are both pretty skint and I have now had a charge for £60-£100 quid!!! Theatre Delicatessen (voluntary run theatre) had just moved to the address above when I went to see the show which was on the 24th October 2017. Yesterday 6th Dec 2017 I received a letter asking me to pay £100, or £60 if I pay within 14 days of the date of the letter 29/11/17. (Why have they taken so long to respond but yet I am pressured to pay so quickly just before Christmas and I have two small boys!) The building they have moved into is a retail outlet which used to be a Mothercare outlet. Next door to staples. The show was at 7:30pm. I checked to see if there were any pay and display machines but did not see and other signs (tempted to go back to check where they are) The letter shows registration recognition (but does not show the driver) points out that I stayed 152 minutes and the maximum time of free parking is an hour. I can understand why this is in place as I guess some people could take the mick and go into town but I was visiting a building that the carpark was for and the rest of the carpark was pretty empty except a few others which expect will also have received a charge. I have rang the theatre who sypathetically said that I'm not the only one and that there is nothing they can do about. She pointed out some other places I could park in future and that they have got signs inside the theatre. These were not there when we visited as as it had just opened my friend and I had a good look around. She said they are trying to sort something with the council which is a bit strange as the letter I have had says "Private land" and is from Vehicle control services who are accredited by the IPC. I think I probably ought to call back and ask about this. Could the council have employed VCS. Please can anyone advise me what to to for the best. Should I ignore? Appeal? Contact the company direct and explain the situation? I sense they would not show goodwill. Have I got a leg to stand on??? The driver was in the ten pin bowling alley, which the car park is outside, with son for his birthday. Just wondering how I, the registered keeper, will go about handling this. 1 Date of the infringement - 10/2/19 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 18/2/19 3 Date received - 20/2/19 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] - N 5 Is there any photographic evidence of the event? - Yes 6 Have you appealed? [Y/N?] post up your appeal] - Y (See below sent 22/2/19) Have you had a response? [Y/N?] post it up - N 7 Who is the parking company? - Smart Parking 8. Where exactly [carpark name and town] - Havens Bank Retail Park, Exeter Appeal: I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.: - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end. - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date. Formal note: Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.   6. Hello, I'm in need of help and advice please............. On Monday 14th January 2019 I received a parking charge notice from PCN notice to keeper NTK St Mary's Road Retail Park Car Park, Sheffield S2 4AL- DFS sofas, Ammount charge -£100 within 28 days or £60 if paid before 24.1.19 contravention date: 27.12.18 contravention reason: parked for longer than the maximum period permitted - 120 mins!! Total duration stay: 199 minutes I visited DFS to look at sofas, I presumed this was owned by DFS not a private company!! NTK are lying because I left the car park- drove to Ikea Sheffield and Next outlet over at Meadowhall, at least a 20 minute drive over there. Looked the whole way round Ikea- and got stuck in traffic and then Next outlet, i then called at centretainment to pick family members up and then returned back to the car park to show my family a sofa I'd seen in DFS I have contacted my online banking and have evidence via online chat with them the time of transaction I made at Ikea and also have printed a statement with the date I made the transaction. I'm so upset about it- firstly I presumed the car park was owned by DFS and didn't see a sign. I haven't done anything about this charge notice yet- can someone please advise?? Do I appeal if so what should I reply with? Do I ignore it? Many thanks in advance
  7. Hello, I have received a Claim Form issued 07 Dec 2018 that I need to respond to. I have no previous communication regarding the PCN, the issue date of the PCN was 26/09/2016. Claimant: Excel Parking Service Limited BW Legal Particulars of claim: "The Claimant's Claim is for the sum of £100.00 being monies due from the Defendant to the Claimant in respect of a Parking Charge Notice (PCN) issued on 26/09/2016 (Issue Date) at 18:42:53 at Cavendish Retail Park Keighley. The PCN relate to .... under registration ... The terms of the PCN allowed the Defendant 28 days from the issue Date to pay the PCN, but the Defendant failed to do so. Despite demand having been made, the Defendant has failed to settle their outstanding liability. The Claim also includes Statutory Interest pursuant to section 69 of the County Courts Act 1984 at a rate of 8% per annum a daily rate of 0.02 from 26/09/2016 to 06/12/2018 being an amount of £16.04. The Claimant also claims £60.00 contractual costs pursuant to PCN Terms and Conditions" Amount claimed: 176.04 Court Fee: 25.00 Legal representative's costs: 50.00 Total amount: 251.04 Advice on how to respond would be gratefully received. I am willing to face them in court if it comes to that.

  9. Hi there, I'm new to this site. I received a parking charge notice of £90 for parking there on the 27th April 2018. I only received it today, and it says I need to pay this by 28th May 2018. I'm not sure what to do about this as I think its quite excessive, and from what I have read elsewhere, they are not the council so can not "fine" me. However, I would like some advice from here as to what I should do about something like this? the penalty is under my mum's name, but it was me who had taken the car to Exeter.   10. Hi all, new to CAG but hoping you can help! My husband has received a claim for for a PCN over a year ago which I feel is unfair and would strongly like to contest on the basis that none of the parking machines were working on the night he parked there. I have just completed the Acknowledgement of Service online amd intend to request info under CPR 31:14 but I would really appreciate any help you can offer, particularly with respect to what I should specifically request.   11. Hi there, Can anyone kindly advise - Parking Charge of £100 received for not displaying BB in Disabled Space, at night in a large Retail Park from UKPC. I don't have a BB and I'm not disabled. I didn't see any signs for UKPC in that area and it was very dark - I only saw them afterward driving home once I had received the ticket. I took a photo to demonstrate that there were no signs in front of the car. Should I just ignore this. Or should I contact UKPC to say that I wish to contest this. I parked there because it was late at night and the car park was extremely busy and as I didn't see any enforcement I didn't think it would be a problem. I was rushing to meet a friend and didn't want to be late for the cinema. The vehicle is not owned by me - it's a leased vehicle via my brother's firm.
  12. Hi everyone, I know this car park, operated by Smart Parking, has been the subject of many threads here. I nevertheless thought I'd find out whether my situation is different from others. I got a PCN for failing to pay for the time (15min) I spent on the car park. I had no idea I had to pay to park, as I thought it was a regular retail car park. I received three documents: I one PCN (pay £54 within 14 days or £90 thereafter) one reply to my appeal (which was rejected) and one DRP letter. Here are the details of the PCN: 1 Date of the infringement - 20/04/18 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 03/05/18 3 Date received - can't remember 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] It refers to the possiblity of appealing through POPLA on the back of the letter 5 Is there any photographic evidence of the event? - Yes, 2 pictures with my number plate and time stamps 6 Have you appealed? {y/n?] post up your appeal] - Yes Have you had a response? [Y/N?] post it up - YES - I claimed I did not see any sign and they replied: 'several signs are situated around the car park that advise of the terms and conditions and we can confirm that all signage on site are BPA approved' 7 Who is the parking company?   15. Here's the chain of events, any advice appreciated! Thursday 23rd November 2017 - "An authorised driver" parked my wife's car in a restaurant car park in York, went in to the restaurant to ask if a payment could be made to park until Sunday 26th (Minster Baywatch didn't offer anything above a "3 hours + until 6am" option). £15 paid and a hand written receipt was issued, showing the registration number of the car, and confirming authorisation to park from 23rd to 26th. No other writing on the receipt that stated the receipt needed to be kept on display in the car. Friday 24th November - Parking Charge Notice issued by Minster Baywatch, reason stated that no valid parking ticket was being displayed. Sunday 26th November - Car removed from car park within the agreed time. Saturday 30th December - NTK received. We have made no contact so far with Minster Baywatch. The NTK shows photographs of the car confirming no ticket being displayed on the dashboard. My main question is, because the driver went directly to the restaurant and made an agreement with them, with nothing confirming that their receipt needed to be kept on display, does this in any way override any presumed contract with the parking operator? Any advice appreciated. I have redacted scans of the NTK and receipt from the restaurant, so far keep getting an error when I try to upload them , will continue to try and get them uploaded. Thanks!   18. Hello PCN issued by Smart Parking for wrong VRM a zero instead of O was entered. The alleged contravention happened at HAVEN BANKS RETAIL PARK EXETER A ticket was purchased for the time parked but a zero was entered instead of letter O PCN received 06/11/17 Date of alleged contrevetion 21/10/2017 I appealed, not realising that I had entered a zero instead of O. Not sure if I disclosed the driver ( sorry didn't realise at the time what a mistake that may have been). Sent supporting evidence of purchased tickets- I had know idea what I had done wrong. Appeal refused although they acknowledge my tickets as eveidence of tickets purchased. Appeal refused as a zero was entered instead of the letter O I'm now appealing to POPLA I'm struggling to get my head around the legal jargon and which bits apply to my case. Any help would be much apprieciated.

  20. First of all, thanks for the great forum and I am sorry that my first post is a request, it would have been nicer to have helped someone else first. In 2011, I received a parking notice from a privately owned car park. This was at st andrews retail park Hull (HU3 4EB). I initially disputed the notice by phone for the usual reasons that there is no contract and the car park is free for two hours, but also based on the sign and situation. I was only parked for about 10 mins as I popped into Wilko to get a fuse for the car. However, I had parked in a Taxi bay at the front of the car park. It doesn't look like it was part of the main car park at all and the standard Excel sign made no reference to not parking in a Taxi slot (not an official taxi rank, but a few spaces for taxis to wait), just the usual "Park within authorised bays, do not park to cause an obstruction, or obstruct other vehicles, entrances, exits, pedestrian walkways, doorways, emergency exits or emergency vehicle access." I disputed this by phone and then unfortunately ignored letters sent (which I have not kept all of them). I don't think that the sign is clear for parking in a taxi slot and there were no taxis. Also, it was a distress purchase. Now I have received a Claim Form (claimant Excel Parking) which appears to be from the County Court Business Centre (Northampton NN1 2LH). Also a letter from BW Legal titles Notice of County Court Claim Issued saying they have issued legal proceedings as I have failed to make a payment. The claim is £270 (£100 +£41.92 interest, court fees £25, Solicitors costs £104). They say they may enter a CCJ against me if I do not contact them or reply to the court claim. I am not sure what to do next. I don't want to go to court and this looks official. Does this mean that I already have a court claim against me? Any help appreciated and I am more than happy to donate to the site for any advice received. I hope that I have given enough information.

Hi All, I recently received a parking notice from Smart parking ltd for unauthorised parking to the sum of 54 pounds and I would like your advice as to whether I am liable to pay considering this is a private parking company? So the back drop... my Japanese friend arrived late Saturday night (30/09/17) still wanted to show him a bit of the city Decided to take him down to the quay on the River Exe here in Exeter Not knowing this part of the city well I parked in this car park opposite the bowling alley, The time was 8.45pm and presuming it was late that the car park operating time had finish as I knew this to be a council car park in the past operating from 8am to 6pm (or along those lines). Upon entering the car park I didn't see any signs as it was very dark and the area was not well lit, again presuming it was closed I did not purchase a ticket. Our stay was only an hour when I returned a few days later to check the signs within the car park it does state its 24hrs.. .it also mentions up to two hours parking is 1 pound which can be refunded at one of the retail sites, if I knew this I would have purchased a ticket. I find it disgusting that they are charging me 54 pounds for one hour in which the ticket is only one pound anyway.   22. Got a APNR notification from parking eye - will fight this as genuinely I did not see any signs,. I have taken video and photo evidence of the sight and there is no visible signs stating parking restrictions on entry. This is a huge retail carpark where there are signs dotted around on walls and high level posts (10ft). When I entered the car park there was an immediate space to my Right hand side which I parked In. At this point there was no signage around and I Went and did some shopping. I met a friend After Buying goods in Tesco (With a ProvenReceipt, Time 11:37A.m.) We had lunch and I then went to the petrol station Which is on-site but i had Forgotten To buy some something And went back and bought Again in Tesco (Timed receipt 14:16 p.m.) The ticket says I left the car park at 14:24 PM. On returning to the car I saw the parking signs as i walked through the actual carpark for the first time, got some petrol and left the premises. I then had an after thought and feeling very cheated , decided to turn the car around, went back and parked again and took photos to show exactly where I was parked. (I believe this can be a cause of 'double dipping"- I will mention it in my appeal as i do not believe i was parked for all that time. Any tips would be helpful my thoughts are that the signage was solely on clear even though there are plenty of signage in other areasI was not looking for car park signs after I had parked.And also disputed in the time I was actually parked compare twoOn site.I have completed the details belowPlease let me know you your thoughts.   23. Hello All, This is my first thread at this forum, so I'm sorry if I missed some rules. I'm not a native speaker, but live in UK, so my apologise for any grammar or spelling mistakes. I have received Parking Charge Notice from Euro Car Parks. I will try to answer question posted by "silverfox1961" to explain what happened and what I did. 1 Date of the infringement On 1st July 2017 I parked at Solent Retail Park in Havant to go with my wife for shopping. We were there few times before, but never noticed any information that there is a maximum stay time. because I am not from Havant I cannot check right now what is the allowed parking time, but I assumed it is 2 hours. From the letter I received I see that I exceeded this time by 45 minutes. They are asking me now for £90 or £50 if paid in 14 days. 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] Letter was issued on 12th July. 3 Date received Because I leased the car form my company letter from ECP was sent first to them and then I got an email and printed version on 14th July (I think my company received it at the same day). 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Yes. 5 Is there any photographic evidence of the event? Document encloses only pictures of car's registration plates. 6 Have you appealed? {y/n?] post up you appeal] Have you had a response?   24. I have received a parking ticket from Parking Eye. My wife was driving the car at the time. There is a 1 hour limit on the parking and she over stayed by 17 minutes. They are demanding £85 or £50 if you pay up quick. This is the shortest time limit in Grantham Is there any obligation on my part to inform them that it was my wife driving? How can I check if they have planning permission? Can I ask they directly?
  25. Hi all, I have had a letter from wescot today chasing a debt from Natwest Retail. The balance is £318.99 Im guessing it was a joint bank account my ex and I had some years ago, possibly 4 or 5 years. If it is a bank account should I do a CCA request to wescot and maybe a SAR to Natwest? Please help
