  1. Can anyone help me with a letter template for a deed of postponement. At the moment I’m thinking of remortgaging to a better deal. mortgage advisor advised that I would need to write to the people named on the deeds to see if they would agree to this. The main problem is that the company 3rd on the list is welcome finance who have sold the debt to a company via a deed of assignment called prime credit who are now 4th on the list. Any debt owed is made up of penatly charges and part of a long running dispute with both owners. That resulted in a possession hearing last year which I won. But the arguement now on this debt is that it should be a lot lower than what they are claiming. At worse I will have to add this 18k debt into the remortgage. But ideally would rather only remortgage for 67K not including this debt as it’s set at 0%. In amongst arguing what is owed I want to get a letter off to Lloyds first to see if they agree. Then welcome. Last on the list will be prime as there’s many unresolved issues with their debt. Like the actual balance when historical fees and charges are removed the debt will be no where near 18k. I doubt prime will agree to the deed of postponement. But i need to start somewhere. And if the6 do take me back to court I have all my eggs in One basket sort of speak If anyone can’t point me in the right direction to this type of letter it would be amazing. thank you PDF Photos 29-11-2016.pdf
  2. Hello Friends, I have heard about the legislation on auto-enrolment of employees in pension scheme and the time by which an employer can chose to postpone auto enrolment etc etc. My understanding is that Auto-enrolment is meant for bare minimum contribution that both employer and employee must make to secure a future and that the postponement period is to give both employees and employer time to absorb the financial impact. My job contract says that my employer will make Pension contribution of 9% and an additional 1% will be taken from my salary. As simple as that. Now in this case, where/what is Auto-enrolment? Is the Auto-enrolment legislation applicable to such Pension Contributions which are part of benefit package of mentioned in job contract. Thanks.
  3. Respondent has put in request to ET to postpone claim citing that one of their witnesses will be away due to a pre-booked holiday (apparently booked in advance). I have imminent case management orders to follow (remedy, list of bundle docs and mitigation of loss) but in the respondents request it's also stated that 'neither part has undertaken any preparation' (?) I know I'm almost ready to send my documents over to the ET and respondent. Any ideas on best course of action at this point? E.g. objections etc...
  4. Hello there, I'm hoping that someone can advise, or has maybe been in my situation. I was made redundant whilst I was preganant and took the company that I worked for to tribunal in August 2012. The case was due to be heard next month, but my solicitor has recently advised me that the main witnesses of the company have gone off work long term sick. This is following me submitting all of my evidence, which is quite strong evidence, a few weeks ago. They intend to ask the tribunal for a postponement on this basis, which I have agreed to so it doesn't prejudice my case. So it;s now down to a judge to decide whether they are granted a postponement. But my question is, how many times can they do this? I feel that they're being crafty because I've got good evidence. I've left the company over 9 months now..
