  1. Hi this is my first post...so apologies in advance if I'm not doing it right! I've done the research after getting a notice from UKCPS. I wasn't the driver at the time so they are pursuing me as the registered keeper. What Id like to know is how the Protection of Freedom Act is being used by them to circumvent Contract Law... My question is if I wasn't there and didn't read their signage how can I bound by their contract?

Hello all, 1 Date of the infringement 20/11/2016 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 25/11/2016 3 Date received 28/11/2016 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Yes (see attached) 5 Is there any photographic evidence of the event? Yes - ANPR. 6 Have you appealed? Yes - standard template to receive POPLA code. In the process of writing POPLA appeal. Not currently attached as standard text used Have you had a response? Yes, their (the parking company) rejection also attached. 7 Who is the parking company? Total Parking Solutions Ltd. 8. Where exactly Heritage Retail Park, Crewe So, I overstayed my welcome. I honestly did not see the signs, not about the length of stay nor about the charge - they are unclear and the writing is tiny. The store where the carpark is was closed at the time. Attached photos of the sign, one zoomed in from my car and the other standing right underneath it trying to read it. My question is about POFA liability and the NTK. I can understand the legislation but from my reading of the NTK, I cannot see whether it is POFA compliant. So how do I use this? They haven't any evidence of who the driver was and the appeal has been from the keeper at all times. No liability has been admitted.   3. I had a pcn in early 2012. That makes it pre-pofa. But I am still getting letters. Roxburg, White, Newlyn and now bw legal. I have posted on MSE about "4 year old pcn at JLA and MOCL". If you continue posting about your progress I will do the same so we can let people know what to do about JLA. I am just drafting a letter to bw legal. I know mine was before October 2012 but I am still really curious to know if VCS will ever risk taking anyone to court and risk questions about bye-laws and relevant land.
  4. I have received copies of letters sent to a person who parked in a car park managed by UKPC. Originally he got screen tickets slapped on his car and he ignored them and waited for the NTK. After just under 2 months he got letters thouth the post saying "final reminder" and they go on to say that he has been idnetified as the driver at the time by the keeper. Well, as the vehicle is his and he hasnt said a word i wonder how UKPC can leap to taht conclusion. It is more likely that they know they will have to spend good money making their case at POPLA so have just let the clock run down, invent a cock and bull story and hope that someone will be impressed by the novel approach With UKPC's track record I would say deception but that would imply they are deliberately trying to deceive but I am happy to accept that they are just palin incompetent or stupid. however, if you have received a screen ticket at the Valley retail park in Croydon please let us know so I can compare the wording on the NTK (or "final remninder" if you didnt get the NTK in time) This doesnt change the rubbish incoherent signage at the retail park into ones that are actual contractual offers though.
  5. I was interested to read on the Parking Pranksters website that POPLA has decided that addresses outside England and Wales are acceptable as serviceable under the Protection of Freedoms act. I fear this may upset the BPA and the PPC's who have always stated that serviceable addresses for the vehicle driver must be in the area covered by POFA. One wonders if a new can of worms has just exploded as I do recall posting some time ago during the introduction of POFA mentioning the number of people who travel from Outer Mongolia borrow a car and shop at Lidl's.
