  1. Saw my car with a clamp on it this morning and found out it was due for non payment of a PCN which I appealed against. Now i never received the council's response to my appeal and the only letter i recently received was on the Wednesday ( which i was told by the enforcement office, was hand delivered! which I think was posted via royal mail) The letter from the bailiffs stated i owe £200 as the for the PCN and court an legal fee due immediately. I was actually going to response to their letter today, but then saw the car clamped and i was charged £438 which had to be paid within 2 hours otherwise it would have been towed away at an additional charge. Had no choice but to pay and now am fuming over this ridicules fee which i cannot afford at the moment. Apparently once it goes to court, I don't get the court's decision and goes straight to a bailiff. Would appreciate advise on how i can take some of the charges back.
  2. I forgot to notify them of change of address and stopped deferring so they're now chasing for the full amount of my 1998 loans. I've been a stay at home mum since 2013 so no income at all. They've passed it on to Link Financial which I'm assuming is their debt collection agency. They've said my last deferment ended 2014. Which might be right as I moved that year. They've also said I've breech the terms ie cannot defer anymore and loan won't end at 50 I can't declare bankruptcy or do an IVA. Unless I win the lottery there's no way I can pay this and don't want a ccj. What are my options if any? Thanks
  3. Hi, I had an agreement with MBNA where they would hold all interest, as long as I paid the debt off within 10 years. The amount owing was divided up in 120 months (10 years). However, in the mean time, they have decided to sell the debt, at the same time as our financial situation has changed. The monthly payments are now less. They write to inform me that I am in arrears. The DCA have said the following, is this right does anyone know?? The payment was set by MBNA, based upon, I assume a previous Income and Expenditure form at the point of being 'charged off' which means no further interest is applied to your account but it does mean that this is your 'normal monthly payment'. This can not be amended now as it was sold on this way. It is also less than the 5% normally applied to credit card accounts. And so, we are happy to accept your offer of payment but as it is does not meet your contractual payment the arrears will continue to accrue. We have a legal obligation to reflect accurate data to the Credit Reference Agencies, which also includes arrangements, missed payments and arrears and so your data entry at the credit reference agency will be updated with this information.
  4. Hi all, I recently CCAed all my creditors in order to try and sort out my finances finally. I have been paying £1 token payments to each, having defaulted on all over 6 years ago. I have moved house a few times since and have lost track of what has happened to them all. having sent a CCA request to Robinson Way, who I originally dealt with for a Halifax debt, I received a strange reply, returning my £1 PO, and saying that "the account is closed on our files, please contact our principal". This was written on a very unprofessional piece of paper that looked more like a memo than a letter! Has anyone got any advise as to how I should proceed with this? The 12+2 days are definitely over. As Robinson Way were dealing with this, is it still their responsibility to respond to my CCA request? Thanks AM
  5. Hi, I am new to the forum. Thanks in advance for any advice given. Student Loan Has Matured/ Full Payment Due within 14 days letter received from Erudio I am 45 years old and had taken out two student loans(95,96) and one (98) so under the old and new style loans. About 10 years ago I had arranged a payment plan (spread across all 3 loans) with student loan company (I think I was over the threshold to defer but was experiencing hardship). I had set up a standing order which remains in place to this day. When Erudio took over I received letter, calls , statements etc from them but have never contacted or corresponded with them in any way (just figured I am paying something towards the loan and was worried that if interacted with them in any way it would somehow trigger a new agreement or obligation, so just left it at that). I have recently received 3 letters within the last two weeks from them stating that my loan has now matured and full payment is due (aprrox £3600). Only after looking around on forums have I become aware of statute of limitations, but am I correct in thinking that my payment plan still running to student loans company constitutes acknowledgment of the loan? I believe that these payments continue to just beforwarded to Erudio (as I never signed or arranged for the payment to go directly to Erudio, only to the Student Loans Company details I had at the time). I’m wondering why there sending me letter so closely spaced, are they trying scare tactics to get me to contact them? I have other priority debts so do not want to pay this off if there’s a chance I could continue to do it over a longer period. Does it make any difference that I have not acknowledged anything to do with Erudio, accepted calls, responded to letters etc. Any advice is most appreciated. Thanks
  6. Good evening all, I took out a unsecured personal loan around 2 years ago with Tesco bank. My financial situation has changed quite a bit in the past 6 months, lost a family member, dealing with depression and anxiety and due to this my self employment businesses sales have plummeted. I got a part time job to help cover my living expenses so i'm trying my best to keep up with all of my payments. My outstanding balance is just over £16k. Monthly payments just under £400. The past 4 months I've been paying late. At the end of every month I end up giving every single penny I have toward this loan payment. Tomorrow I am planning on sending this letter off I found in the forums. https://www.consumeractiongroup.co.uk/forum/showthread.php?387346-Ask-Creditor-to-Accept-Pro-Rata-Payments-**Correct-as-at-October-2013** I was just wondering where I can find a I/E sheet? and do I include this loan payment in that sheet? Also what is considered a reasonable offer that they would be inclined to accept? Is this the best way forward? Thank you in advance
  7. We currently have arrears on our mortgage of £1000, at the moment I am clearing them at £50 per month. When we took out the mortgage in 2007 our paydays where the 15th, this changed in 2008 to the 25th so I wrote to the company concerned and explained that we needed to change, they agreed but said that the mortgage would always be shown as in arrears for the 10day gap. They also charge £40 per month in "late payment fees". Having asked for a breakdown of costs I also not there are a number of "agents fees" which I presume means home visits of £60 none of which where agreed to and no one spoken to. It also shows "solicitors fees" for various letters etc. Having been succesful during the bank charge days, can we still claim for these fees in the same way or have the mortgage companies wised up as well now.
  8. bit long winded this one, sorry folks. I had been working for an outsourced company in a well known bank. Whilst in training I received strange emails from the trainer. This was following from a conversation in training were I asked a question. He explained (in answer to my question) it was in relation to couples who had a joint account and subsequently split. He said “say you and I were in a relationship”. Three days later I’ve seen he’s gone into my email and sent himself an email from my account/computer “that joint account we were talking about, do you fancy it? Can we get back together” (paraphrased, I have a copy) One of my colleagues saw this email and told me to take a copy to “protect yourself, that's really bizzare”. I replied to him saying “he’ll nah” thinking nip that right now! he’s then ran into the class in front of everyone and said “not up for it no” then left the class. From that moment on every single word that came out of my mouth he seemed to take offence to. Everything. Even just hello. The end result being I chose to just sit in silence in the corner, segregate myself from everyone else, keep myself to myself and not speak to anyone. I did speak to the manager about it and she told me “I get on with him so..” and that was that. Once he told off a member of staff for coming in hung over. Fair enough. However, the next day he’s come in hungover himself and stated “I’m hungover I can’t be (expletive) training you today”. On another occasion I had a difficult call and he grabbed a team leader, they then proceeded to stand watching, laughing at me. On another occasion during “coaching” he took my entire group out for a smoke I “wasn’t allowed until she asks me herself”. i stated "I'm not engaging in that power game, sorry" I was then left sat alone completely ostracised whilst they all went out for a smoke. It later came to me that during this he’d called me a “bitch” I then spoke to his manager who agreed I had a legitimate complaint “but she’s off today so” and that was the end of that. We’ve then gone onto the floor and continued training. We were told we would receive multiple one 2 one coaching. This happened once. When these coaching sessions had been booked onto our schedules we’d be left sitting around doing nothing for hours. the manager told us “the training we said were giving You’re not getting it , I don’t have time”. On the one occasion I did receive coaching I had a call fail for following incorrect procedure. I explained I remembered the call and put my hand up and did what the trainer told me to do. I still failed. This happened multiple times with different members of staff.The end result was hoards of new staff(and old seemingly) on the phones not knowing what their doing (and saying it). I witnessed several regulatory breaches at all levels of staff.. I am PTSD (undeclared, following on from being stalked for two years by a colleague, sexually assaulted and suicide attempts..) and found this exacerbated symptoms. I didn’t declare PTSD to the employer however i did state to trainers the lack of appropriate training was causing severe anxiety attacks. Nothing changed. During my time on the floor training it was agreed that mine would be extended for another week. I was entirely happy with this and expressed the fact that I was going to ask anyway. A few days later I’m told oh no that’s not happening now your going live Monday. I had zero input in this. Decisions are being made around my development with zero input from myself. I stated to them outright "I don’t know what I’m doing!!!" So I’m making my way to work Monday 24th December and had a panic attack in the street. I’ve not had panic attacks for 6 months. I just went home and txt the recruitment number “it’s not for me”. This was a clear resignation with immediate effect. Training group; Bullying was rife amongst this group. One in particular would talk about everyone when they were not around in a derogatory manner. According to this individual several members of staff are “sociopaths”. She would mock me to my face around my degree “shut up about it”. I suspect jealously because we did the same degree and I did better. This individual would relentlessly pick on someone in the group (who had an obvious mental disability of some sort, autism or something I wasn't rally sure). He’d speak in class and this individual would mutter “shut up” he’d sit next to us and she would intentionally and deliberately move away from him then stand around giving dirty looks. He picked up on it because he came and spoke to me he told me it was “making me sad”. I could give many many many many more examples of this persons behaviour. Another individual, the self confessed personality disordered individual(bpd). She started spreading rumours about me and a trainer. I was "into him" apparently, I wasn't. Rumours that were entirely baseless, again. She can deny deny deny but her “friend” told me And I heard her talking about it with my own ears. When I would sit next to the group she would intentionally move away and I’d hear her talking about me. On another occasion this individual was making £5 bets on “who would cry first” this is so nasty I have no words. One of the trainers said to a colleague “I come in here and play with my phones then I go home and play with my girlfriend..” hes 55 shes 19...bleughhhhhhhhh Another time this trainer was ‘helping’ me I got something correct myself and said ‘was I right,yeah?’ He said ‘had to happen sometime didn’t it..”. Bullying. This particular trainer got "barred" from being around trainees because of multiple complaints around his behaviour. Wages; During the 24/12/18 and 7/1/19 I received no communication whatsoever from the employer. I have then emailed on the 7th jan asking for confirmation of what my final wage will be. The response was; “Hi x, Your final pay will be 28th Jan due to your leave date. You will received payment on Monday 14th with any hours worked up till 6th Jan then on 28th you will received any remaining hours due and leaver Annual leave. Thanks x Executive – Compensation and Benefits” I have then received a payslip which just states states “zero”. no deductions nada, just blank. I’ve queried this stating, as per your own timescales I left on the 24th and therefore should receive 1 week outstanding wages and outstanding holiday pay on the 14th jan NOT the 28th as per your own email. At this point someone should have joined the dots that something had gone wrong, they didn’t. They then proceeded to IGNORE subsequent emails and failed to respond or amend my pay. I have then received emails a supposed HR senior: “Hi x, I requested the details from our team and they confirmed an AWOL letter – request to contact was sent to your address and email as attached both on 27th December. As they failed to hear from you it proceeded then to a disciplinary on 7th January again the invite dated 3rd January 2019 was sent to the address we have on file. This meeting went ahead in your absence and was held by x and x. An outcome letter was then sent to you via post which I am happy to hear an appeal should you wish to send through. Can you send me this evidence of your resignation so I can review ( I sent this twice one week prior fyi)? If not, can you confirm who you sent this to and to whom did you resign on the 24th? This resignation had not been cascaded to the team and thus your leave date being 7th Jan via dismissal due to AWOL. If you have evidence of sending your resignation then I can deal with the appropriate person as this has clearly caused a number of issues none more so than your final payment date being pushed back to the 28th January. Regarding names, that’s fine although this can limit our investigations which will be carried out by the training manager when on site in x next week. In regards to your pay & any outstanding monies owed by the company: Ø You will be paid firstly for hours worked from 23rd Dec – 6th Jan on 14th January 2019. Ø Your final pay will then be on the 28th Jan which as both x and x from our Payroll Dept. has advised will include any outstanding hours and unused AL." None of these communications were received by myself. I have then received a call from someone on the floor stating there has been a “GDPR breach”. In that all the wages are incorrect and members of staff have other people’s personal information contained in their own payslips. I was also told they were “wiping the system clean and in putting everyone’s data again. No one from x informed me of a data breach. I have then received copies of the email/letters x claim to have sent me. The email has gone to an address that isn’t mine. The letter has gone to a postcode that isn’t mine. The letters contained within are marked “private and confidential” and contain private personal HR information. This is causing distress. in that I have not left my home for days, I'm trying to secure accounts, I cant eat, I have not slept, days later I have not received a single response from the employer regarding the breach. I am losing my mind. I have been paid zero. Recently I noticed my mobile number has ben used to sign up for shortcode txts. i didn't do this. I DO NOT give my number out. ONLY for work. I believe the two are related. I pointed out this breach to x on the 11/1/19 they seemingly hadn't noticed, it is now 14/1/19 and I have received not one single response from them. I believe they have not noticed this breach, it was me! I have spoken with the ICO who tell me the breach (ive filled in the personal breach report form myself) hasn’t been reported (yet) I believe the 72 hour time limit is breached-the letter sent out was dated 27th December 18. So I have been unfairly dismissed based on data that wasn’t received and has breached my personal data! I also have not been paid a single penny today on my wages. Nothing. I am now unable to make rent and again exacerbates symptoms of PTSD. I also didn’t receive a copy of the contract, despite asking. what can I do here?
  9. Hi been given a reposession date after mounting arrears and not keeping to the suspended possession order given about 5 years ago. I haven't worked since 2011 but am starting work next month so offered Halifax £90 extra a month. Was told by Halifax a month ago that we could make a payment arrangement but first they needed to get another possession order but not to worry it was cos old one had lapsed. I then swiftly got a possession date through. I have liased through Ascent and they won't accept it they want the £9000 arrears. I have had medical problems and a break down a few years ago and still on medication. Halifax have all medical notes . I didn't just have a bit of depression it was very very bad and on a lot of medication. Any advice as am putting an n244 in.
  10. I request your assistance for dealing with DRP (Dept recovery plus ltd) who are acting on behalf of Empark UK Ltd operating on ground of Mount Vernon Cancer centre. I had a letter on 12th April 2018 that my vehicle was issued with a penalty charge notice on 12th February 2018 for the reason of 'parked in marked ambulance bay'. I disputed the matter in writing that; 1. My vehicle was never parked in the bay 2. No where the location states 'Ambulance bay' rather at one point it says 'Authorised vehicles'. The parking area is used by Ambulances, private hire vehicles (who are contracted by hospital to pick up/drop off passengers) and also for people who pick up and drop off passengers. My mother is a cancer patient. On 12th she attended hospital to see the consultant, due to some internal issues she continued to wait for over 4 hours and her condition deteriorated, started vomiting i drove the car from the car park which is fair distance to the door of cancer centre (never parked in the bay), i then walked in, pushed her wheel chair to the car. Within this matter of minutes, the parking attendent issued a ticket and had gone to avoid confrontation. I went back to the reception and explained the matter, showed them the parking ticket i had paid. I left the parking notice with them and was assured that this matter will be taken care of. After few weeks I received letter demanding the payment. I wrote on 29 April 2018 back with all the details as above. I then had rejection on 22nd June 2018 and that i can write to POPLA. I must admit at that time, my mother wasn't well and I was struggling to look after her full time and also concentrating on my full time degree course that i did not spend time to attend to that matter. Now on 17th Dec, I received letter from DRP (Dept recovery plus ltd) demanding £145.00 by 26th December. I had a look to see if i can appeal but POPLA only accept appeals within 28 days which i missed.. what options do i have? anything i can do?? I have been in full time studies and out of work for over a year now.. can't really afford to pay..
  11. Hi all, Thanks to anyone who would mind taking the time to read this and advise me if possible. I received a 2 fines from the magistrates court. 1 for no tv license (fair enough) and one for driving without insurance (although the car wasn't been driven it was just parked on my street as it was broken down and id transferred my insurance onto a new vehicle. Taxed to be on the road but didn't realise it had to be insured as well, my bad but I guess that's by the by). In the midst of this I was granted a debt relief order and was granted £300 by the official receiver to cover the TV license fine (strange as that fine was for £200) but left the insurance fine outstanding. initially as I wasn't working deductions were been made from my benefits. When I returned to work in January 2017 this stopped I didn't make any payments as id lost my paperwork and expected to hear from them regarding payments and thought id pick it up from there. In the meantime I got myself another fine. ( I know, I know but it was cheaper to be found guilty and pay £400 than pay a solicitor to find me not guilty) I began making payments for this fine immediately. In mid May I received a letter from the South Yorkshire Enforcement unit giving me one reference number to cover all my fines. It showed the amount i'd paid and the balance. (though there was no reference to the £300 that the insolvency officer had written off under the DRO). Again I continued making payments and have regularly paid £50 a month every since. In total since April I have paid £560 towards the fines. Then I received a letter from collectica. A notice of enforcement. Showing the correct balance of £883.50 but they have also added on £75 for god knows what. I rang them and explained to the guy who answered that I had made regular payments to my fines and had been doing since April. I asked if I could continue making payments at the amount I had been - £50.00. This was a big no no. He wanted half the money up front before agreeing to a payment plan. I explained to him that I had just been discharged from my DRO and that I was very careful with my budgeting. I tried to explain to him that by paying him more that I could afford the money would have to come from another pot i'd be sorting one problem and creating another. He told me his was a priority debt, I explained I have no other debt anymore and that this was the only one outstanding my payment history should clearly show that I am trying my best to clear it. We went back and forth for about half an hour. I stood my ground. I refused to pay anymore than I could afford, explained that i'm certainly no sat with a 50" T.V on my wall and that if they come to my house the only thing they will find of value is my sons PS4 which is about 3 years old. (and my car which my mum bought me for work, now been parked out of the way of my house. His final offer was of an initial payment of £280 and a payment plan. Otherwise I would be charged for bailiffs attendance and get more fees, worst case scenario been arrested. I told him at this point id welcome a change to plead my case in court. Although I suspect they would rather just add more fees onto the debt that I have been trying to clear. I told him this was the most insane act of bullying ever. They can clearly say I have been making regular and timely payments directly to the court, now they want to eliminate all that money I've struggled to pay by sticking it back on in fees meaning that it will take me even longer to pay. How the hell is that even I thing?!!!! I told him I may as well have kept all the money I paid so that when they wanted an initial payment I could have made it. This makes absolutely no sense to me. I have worked my ass off to get out of debt and despite paying on time they are determined to land me back in it. I got off the phone and resolved nothing. He told me I have another few days to agree to his terms before a bailiff will call at my house (he'll be very disappointed by the nothing of value that I have ) its hassle I just don't need. I got off the phone and made my due payment of £50 but again to the courts not to collectica. Does anyone have any advise for me please? This is infuriating for me that they can see I am not ignoring the fines I am paying each month yet they seen hell bent on making the debt larger. Also can anyone advise what to do regarding the £300 the DRO shows they have allowed towards these fines that is not showing on the letter I received from the courts. Many Thanks
  12. I will be concise as this is not a confessional, if helpers need more information I will respond promptly. I am 67 years old and have seven creditors, one with CCJ. I followed the advice of CAG and offered what I could, a token £5 a month to each. These payments were set up and have run without apparent fault for about seven years. Since doing this I was evicted from my home of sixteen years (the reluctant CCJ with a very patient landlord) and had no valid postal address for some time. In 2013 I had to move to Germany for family reasons. My only income is my state pension and a very, very small private pension. In short, absolutely no spare cash as the pension has to cover room rent and everything else. My assets fit into two suitcases and have no value My sister who is in the UK received a letter from Robinson Way addressed to me. She has told them to remove her address from my file as I do not and never have lived at that address. They have agreed to do this. They are talking as if this were a recent matter, insisting on the establishment of a repayment plan. Obviously I have nothing to offer them and their threats of legal action are not particularly concerning. When the CCJ was issued the judge noted that the matter would not be pursued unless there were substantial assets, which is oddly reassuring now. I intend to contact RW by email so that everything is recorded but before I do I wanted to gather any advice from you good folks. Incidental to this, I do not know what my credit record looks like now. I have lost my CRA access details and it seems not to be possible to open a new subscription from Germany. Finally, (because it is stupidly embarrassing) I have noticed an error in Robinson Way's payments. When I agreed to the monthly payment I established a standing order which is still running. I periodically check that all payments are going out as they should. What I did not notice was that RW established a direct debit, with the same reference number in addition to the standing order. So they have been receiving and taking twice the payment I agreed and this seems to have been going on for the whole period.
  13. Hi everyone For the past 7 years I have been paying IDEM in respect of an MBNA credit card debt that they purchased probably for a tiny % of the actual. Since 2009 I have also removed several defaults from my credit file and paid back pretty much everything that I owed following a difficult financial period of my life. I got to the point that I was actually approved for a mortgage 2 years ago. However , a few months ago , I registered a complaint with IDEM as they would not accept a full and final offer to pay off the final and mistakenly I stopped payments for a coupe of months whilst they responded to my complaint . I then paid off the outstanding debt in FULL. My challenge is that they have rightly registered those missed payments with Experian which has taken my credit score down to FAIR . I have asked IDEM if they would consider a gesture of goodwill and remove the missed payment record in respect of the complaint at the time and my exemplary payment record over 7 years. SO far they have refused which I think is unfair but correct I guess. Is there any way I can approach this differently - I have been very polite and reasonable to them Thanks DP

  15. I have just received demands for final balances, gas and electric, after moving out 4 years ago. Firstly I did give final readings, as my ex LL was a problem, I also transferred my accounts to my new address, and still at the same address. I can't remember if I got final bills from that long ago. The demands I've received state they have tried contacting me several times, and that I have 28 days to pay or the will register defaults on my credit file! Any advice, I have emailed a complaint to them.

I sent a CHAPS payment on Thursday from my account with the Yorkshire Building Society as I needed the money in my own business account with Santander that day to make a foreign currency payment. I paid £23.50 for the fast service and was promised the money would be in the Santander account later that day. It's now Tuesday morning and still no money in my business account. Numerous phone calls to both institutions just sees them pass the blame onto the other side. Is there anything I can do quickly to get this sorted. All i'm being quoted is that the 'chase' they can put on the payment can take up to 30 days. I don't have 30 days and need my money now, and it seriously puts a shambles on it being a same day payment service.
  17. Hi. I've attempted to find the answers on here but my head is swimming... I've received notice that i'm in default and erudio want full payment. I thought i was in deferment although now realised that this had lapsed in September. I haven't received any letters prior to this one. I've logged into my online account and not sure where to go from here. I thought id be paying the monthly amount after my deferment lapsed. This i realise hasn't been taken. My loans are from 1996 and 1999. I can afford to pay the monthly fee but not the whole amount which is what they now want... What should i do?!

My 27 year old son rang me today saying he has received a letter Housing benefits from when he was in a bedsit at 18 attending college He moved and they have just sent him a letter saying he owes £500 and they are taking it direct from his wages as he did not inform them he had moved on time.. . He has always worked since leaving the property and has always paid council tax at his new addresses for 9 years and been on the electoral roll. He has never received any letters of over payment and has no knowledge of this over payment. I was guarantor at the estate agents for the bedsit and i never received anything. Is this legal for them just to take from his wages, he doesn't remember dates that long ago. He is on low income and he and his partner pay the rent on their home £1,000 a month as they both work. He has not claimed housing benefits other than for the 6 months he was at the bedsit 9 years ago. They want to take an extra 25 per week from his wages, he already pays £40 a month for arrears of council tax from his previous property. I think its unfair that they can chase an over payment without contacting you when you have been legally available on electoral role and council tax, we can not prove that he did not tell them when he moved as its so long ago.   19. Hi all, Simple question. As per the title, is it illegal for the council to refuse to accept payment for council tax? The story is quite simple, our council tax account has been passed to the bailiffs and as such the council are refusing to accept payments (to the point where they even appear to have blocked me from using their online payment portal), and insist that payments can only be made to the bailiffs. I've no intention of paying the bailiffs anything as a number of years ago (10-12 years) they stole money from us intended for payment of council tax, later telling me it was used to pay their own fees. Long story short, we lost our home as the council eventually made me bankrupt. Our solicitor advised an FVA and the equity in the house was used to pay all their legal fees, effectively leaving us with nothing. We're now struggling again hence the question. The reason I ask is I remember reading somewhere, some time ago that there is an old law somewhere that states that it is illegal to refuse payment for a bill or debt. That's what i'm trying to find out. *** PLEASE DON'T GIVE ME ADVICE ON HOW TO DEAL WITH BAILIFFS, THAT'S NOT WHAT I'M ASKING*** Thanks
  20. Hello. I am 2 and a half years into a 4 year finance deal on my vehicle. It is all up to date at the moment. However I am changing job this month, but am going from self employed to full time employed and paid monthly. As I have no savings I will be going a whole month with no income so I am going to struggle to pay all my bills for this month. Before I start talking to the finance company about this to try and come up with an agreement (which I don't think they will be keen to do) what are the legalities of me missing one payment? I'm assuming they can't start repossession proceedings yet? I'm hoping they will agree to take just a small token payment this month then make up the shortfall over the next two or three but if they try to play hardball where do I stand? Thanks for any help.
  21. My partner has a llyods loan and has had 2 holiday payment breaks in the last year (contract stated 2 in 1 year) she is at the maximum but is finding it hard financially after having a baby. She ideally would like to put the loan on some kind of a hold until she goes back to work full time (around 6 months time) Is there anything that she can do? it would help massively as the loan repayments are around £400. If not she will just have to soilder on thanks guys
  22. I have been living in my current flat for approximately 5 years. Firstly with a partner and recently by myself. During this whole time I have had a pre payment meter taking debt every time I top up for a previous tenant. Through my own laziness and stupidity I didn't pursue the issue. I tried to at first but couldn't figure out where to start and about a year or so ago the 'debt' being taken off was a negligible amount (approximately 50p-£1 for every £10 I topped up). However, recently the rate that the debt is added seemed to have escalated to £2-£3 per £10 topped up. I should have pursued this much sooner I realise this, but I would really like them to stop charging me for a debt that has never been mine and to recover some or all of the money that I have paid towards this debt that is not and never has been mine. Is anyone able to advise who I should contact and how I should go about this?
  23. Hi everyone, any help would be highly appreciated Back in 2010 I arrived in the UK to study, me and my friends rented a flat in Brighton and I signed with TalkTalk for a broadband plan (1Year). The account was under my name and it was paying it from my personal bank account. End of 2011 I finished my studies and went back to my country, but before I do that I contacted Talktalk and told them that I am leaving and that my room mates will be paying from for this plan from now. (Kindly change the account holder to them and hereby I inform you that I am not longer responsible of this) "for sure there is no proof of this as it was a phone call" Time passed then in 2017 April I returned to the UK with my family to start my new job. Surprisingly I received a letter from Lowell demanding me to pay an outstanding amount of 240GBP for an old account related to TalkTalk. I ignored the letter as I sincerely forgot that I ever had a TalkTalk account! on the end of 2017 I relocated to the northern side of London the somehow they got my new address (I am guessing through the bank as I still use my old account since I was a student) and demanded me again for the same thing so I gave them a call and asked what is this about, they then explained that this account still under my name and it has an outstanding amount since Dec 2013. I asked what account was paying for all these payments since 2012 they explained that it was someone's else account (My room mate). I then explained that I left at the end of Sep 2011 and since then I was away, I have all necessary stamps of exits and entries on my account which validate that I was out of the UK for the past 7 years. They took all these notes from me and were very polite with me, then asked me to wait for a month or too for feedback. Today I received a letter saying that TalkTalk said the following: TalkTalk has advised us that they received change of ownership forms on 09/11/2011; however this could not be completed due to arrears on the account. They state that they received further card payments from a third party, but the name on the account was never changed Lowell then continues the letter saying that I need to pay this and that they will place this account on hold for 30 days for me to review in case they missed anything. Can anyone explain to me what is the best root to take next? As it is obviously not my responsibly to pay especially that i was not informed that the owner ship change did not happen? Bare in mind that my credit report has a note on it from TalkTalk since 2011 apparently which prevented me from taking any credit plan with any type of business in the UK since i got back and i am not quiet sure about the impact on my credit score after this issue is sorted.   24. Afternoon Everyone. I've been reading other peoples threads regarding Vanquis and have come up with good information but have decided to make my own thread to be able to keep track of this and to add to the information hopefully, I also have questions. This is my only debt apart from my student loan it is large and I am worried it will ruin my credit score, I would like to get a debt plan for something that I can afford and then maybe make them an offer when I can to have the debt wiped with no CCJ. I owe £2993 with a limit of £3000 as of yet I havent missed a payment since the account was opened in late 2014, I have up until 2 August 2018 to make a minimum payment of £151 but that will be dificult.. I would like to get the account frozen and then work out an affordable way to pay. One thing I have read on another thread about dealing with Vanquis that it is wise to pay for a Subject Access Request for all my statements, I think that would be a good idea because my account has always been paperless and the online ones only go back for 12 months.. I have also noticed that while browsing a couple of them that there are lots of charges every month like; Purchase Interest, Cash Interest (But I have never ever borrowed cash against my card), Promotional Purchase Interest, Cash Advance Fee (Again, Never taken cash) I have also seen PPI being discussed but I'm not sure whether that applies to me. What should my steps be to solve this mess, Learn from it and eventually move on? My printer is at the ready, Thanks in advance everyone, L.
  25. Hi, My mum sadly passed away in August in Hospital, aged only 52. I have taken on the responsibility of arranging her funeral. She left no will nor did she have any assets, at the time of her death she was claiming ESA and living in a hostel. I have filled in the post office form to close her account but I doubt very much that there was much if anything in there as I went to her accommodation after she passed and she had been counting coppers before she was taken to hospital. I have spoken to the DWP bereavement service this morning about help with funeral costs, they told me it is unlikely I will get any help as I have a working sister and mum had 3 siblings too. My sister hasn't spoken to my mum in 10 years after she left to live with our dad at 14, their relationship broke down after mums mental health and alcohol issues rendered her unable to care for my sister. The same goes for mums brother and sisters, they haven't spoken in many years, due to my mums issues and how difficult she was to maintain a relationship with. I have stood by her, supported and helped her as much as possible and remained in regular contact with her, going on days out and spending quality time together, I was with her the whole week leading to her passing and held her hand in her last moments. I am a lone parent, working 18 hours a week, I get a working and child tax credit and housing benefit reduction, so I believe because of that I am eligible to claim for help, I have asked them to send me the form to complete but is there really any point in me doing that now that they have said there are other adults who could pay? They wont! They also told me I would be responsible for any over-payment of benefit mum might of received, but if the way they see it is all close relatives should be responsible for the funeral, why not hold them all responsible for over-payments too? I have not gone all out on her funeral, no cars or masses of flowers or over priced coffin, just a basic graveside humanist ceremony in the same cemetery as her parents, although costs are slightly higher as she is being transported from the south of England to the north of England. Sorry, waffling. So my question is, should I bother applying for funeral expenses or just focus on getting the funds and making an arrangement with the funeral directors? Thank you.
