  1. Hi, I got slapped with pretty much the same PCN at the same car park. My wife was driving the car and she did pay the £2.50 after she arrived. However as we only got the PCN 22 days after the day she parked there the ticket is long gone. The date of the incident was the 6th of December and we got the PCN on the 28th of December. I have seen from the signs posted here that they say you don't need to display the ticket in the car but that you should keep it as a proof (who keeps their tickets?). The PCN claims we breached the 'contract' by parking without payment and as evidence they just show that the car entered and left the car park. That is only evidence that the car parked there, not that it wasn't paid for. As we don't have the ticket anymore we can't tell when the ticket was issued or whether the registration number was entered correctly (always a change of typing it wrong). In my opinion they would need to prove that you didn't pay. So they would need to show an audit trail of tickets issued during the period and list which tickets that were issued do not match any cars that entered the car park. If e.g. 1000 cars parked during the day and 1000 tickets were issued they can't really claim that someone did not pay. The Levenshtein distance (how many letters you need to change to go from one string to another, E.g. Hello to Hillo would be a distance of 1 as you have to change one letter) between the reg numbers entered on the ticket machine and the reg numbers of the ANPR system would show straight away if some reg number had a typo. If a type was the cause for this PCN then another question is if the system knows at any time which cars are in the car park, why does the parking ticket machine not reject numbers that are not in the car park? So what is the best way forward. I've read that you should not appeal. Why? I fully understand that they will reject the appeal as this is their business model but can't you use the appeal to put them on notice already? I am not a lawyer but I would request the following: -Proof that the parking charge was not payed -Ask them to reserve the CCTV footage (if they have) of the ticket machine for future use in the court of law as that would show my wife making the payment (making clear that you won't be bullied) -Provide a list of tickets issued during the period which do not match any of the numbers of the ANPR system and their Levenshtein to our registration number. -Audit trail of the ticket machines. Are there any gaps in the ticket issued? My wife has her father as a witness that she paid and there she helped an elderly couple at the ticket machine (but we don't know them). So what do you suggest we do? Wait until they write they are going to court? What would the worst case be, it goes to court and you have to pay. How much would that be? I know that that is what they bank on that people are scared of going to court and lose especially now that they won a few (or at least one) cases in court. PCN attached Signs (thanks to User999 for getting all those pictures) One of the signs is saying: "Please ensure you enter the full and correct vehicle registration number of the vehicle you've parked today. Failure to do so may result in the issue of a Parking Charge Notice (PCN)"

Hi, I received an email from my lease company in December, advising of a PCN with the reference number to login and view/appeal/pay etc. It was my son-in-law who had been driving and got stuck in a box junction. He logged on and paid the £65 fine. Then we received a letter from TFL that the PCN was going to be reissued to me as the lease company had provided my details. If the PCN had been paid then it would be reunded by CHEQUE. No cheque was ever received, and my son in law didn't notice the money be refunded into his account - it was a few days before Christmas. To be honest I forgot all about it as I assumed it was sorted. I didn't get a reissued PCN, but have now received a letter saying that the fine has increased to £195. I called them and was told I could submit a late appeal. I guess my position is that if we have made the effort to pay the initial fine within the time period, then that is sufficient to assume that it has been paid. And is there any challenge in that their letter stated that they would refund by cheque? The fact that they have to refund any payment must be some weird admin thing, to do with the party who the PCN has been issued to. Which seems daft as anyone can pay any fine, you don't need to enter any details. anyone have experience of this Thanks in advance.
  3. i started over a year ago with the company and i was told not entitled to holiday pay as casual and 0 hours, so got not holiday pay at all, recently had someone i know who use to work at a union and they asked about my job and i told them everything and they said no you're entitled to holiday pay they showed me how to work it out and turns out I'm owed £300, told my manager who informed wages, had half my payment. rest next week. But I'm wondering if i can get last years holiday pay owed to me as it works out at £100 owed? also When I started a few days later i received a message of someone who I had not heard of in a long time, asking if I had started working for them, I asked how they know, and they said they had a call from someone at the company asking about me! but yet no one knew i was working for this company that knew this person, (this person use to work for the company many years ago) I've mentioned it to my manager who told me to ignore it, I kind of have but it really plays on my mind wondering what else is said to this person as we do not communicate, or to anyone else. Since I raised my holiday entitlement Ive since been told that my Sunday shifts are voluntary and that should not be taken into account, (I mainly work Sundays as no other shifts during week, so no wages if I don't), Ive been told my hair needs to be different in how I put it up (never had issues before) been made to feel guilty if don't take overtime, not had an expenses traveling to other shops like i was told at start i would but then they took it away as they found out I drive, I've had £271 in expenses for parking alone and bus tickets, this would never have occurred as my contracted place is just around the corner.

Hi all, i am now working in the nhs as part of the theatre department and in doing so signed the usual contract agreeing to working on calls, late shifts and weekends etc, the problem is that some staff are not taking part in this arrangement because of various reasons ( my cats scared of the dark or little johnny wets the bed) sanctioned by the managers and therefore the remaining staff are having to work extra shifts to compensate. My question is, are we all being treated equally and do we have any basis for taking action against the management. Any help would be great. Cheers.
  5. Hello, We recently travelled to Goa India we booked a hotel on bookings.com pay on arrivel, i paid by credit card on arrivel at reception we where shown our room which was fine. We unpacked and decided to go to the pool/resturant area which was on the roof of the hotel, all the way up the staircase was rubbish open food cartons and plastic bags with used toilet paper in, at the pool a bin was overflowing with rubbish including on top a ripped open dirty nappy which birds had pulled apart, This was just 5 metres away from the resturant, the pool itself had no filter system and was a dirty looking colour. We complained to the reception and they said that they would report it to cleaning staff, we went out for the day it was still the same 8 hr later again a complaint was made, and the new receptionists said no report had been made, by midday the following day it was still the same. We demanded to see the hotel owner along with other guests, we were given his phone number he said he would come over in 1 hour he didnt come until 6pm the next day, he agreed to move us to another hotel 2 days later due to christmas busy time this was the only option, we had checked also and the area was full. We paid £900 for 13 night stay, 5 days and 4 nights were ruined due to this we could not use the pool, inclusive breakfast or our balcony seating area, all of which is what we book hotels for, it was like we were in room lock down, we asked the hotel owner for some compensation but he refused. The hotel we moved to was more suitable in the same price bracket. I explained this to my credit card company on return and they said i cant claim any part of the payment back, which i feel is wrong as 4 night 5 days where a nightmare living in a tip, even in room very noisy right through untill 5am, security took no action.   6. This was quite a while ago. I've been going though my 2005 statements due to a problem with bank and have realised that I paid at least £600 of c/tax within a 5-month period. I was a full-time student at the time. Were students exempt from c/tax at this time? If so, what are the chances of recovering the sums paid? Thanks
  7. Good afternoon, I am wondering if somebody can point me in the right direct. Last summer myself, my wife and our son (13 at the time) flew to Romania with Tarom (Heathrow to Bucharest). Our flight landed almost 6 hours late. On our return, I filed a claim for compensation for the three of us at 400 Euro’s per person. After 3 months, Tarom eventually replied to me with an apology and an offer of 450 Euro’s per person in vouchers. I refused this and insisted upon a cash alternative via bank transfer under Regulation EU261. Tarom agreed to compensate 400 Euro’s per person and asked for my bank details, which I have supplied. However, after another 3 weeks, they only paid 400 Euro’s. I have emailed them twice since to ask about the remaining 800 Euro’s. Today, I got a reply stating the following: “Under the Romanian Law (we are a Romanian Company) we can make the payment directly to the passenger. In order to make the payment for Mrs. XXXX and Mr. XXXX we need the following bank details of the passengers.” Is this information correct, or are they trying to delay payment further? I can’t imagine that an airline pays each member of a family separately e.g. a family package holiday. Our son does not have a bank account, so I can’t give them any bank details for him, although he is entitled to compensation too. Many thanks
  8. Hello, a CSH newbie here. Please can anyone offer me advice on how to progress this ... I've received a PCN (Parking Charge Notice) via Enterprise Rent-A-Car, informing me of an alleged offence committed at Calder Park, Wakefield, on 31st October 2018, whilst driving one of their hire cars. The contravention carried a £60 fine which Enterprise have automatically paid to VCS (Sheffield) and they've now passed the bill onto me together with a £25 Admin Fee. I was driving the car on company business and the resultant £85 has been taken directly from my salary. The thing is, I don't believe I've committed and offence but because of Enterprise's actions I feel that I have lost my right to appeal, please could you advise what I can do? I've written a polite letter to VCS to offer my version of events in an attempt to appeal the charge, but this was 3 weeks ago and I've had no reply. Thanks for any help. Stuart

  10. Hi I recently had a successful PPI claim with MBNA. I have received a 50% payout but as it was a joint loan, 50% is owed to my late wife. Initially, MBNA refused to pay me her share until I provided a Grant of Probate or Letters of Administration. After explaining I have neither, they eventually said they will accept documents from a Court or a Solicitor confirming that no Will, Letter of Administration or Grant of Probate was ever made. My wife had next to nothing in assets when she died so, as I understand it from the gov.uk website, I didn’t need to apply for Probate as, in the circumstances, I inherited everything. I can’t understand why MBNA will not just accept our marriage certificate and my wife’s death certificate as sufficient evidence and pay out. That was all the evidence I needed to provide at the time of my wife’s death when dealing with her bank accounts. (They were different banks, not MBNA). The amount owed is only around £400 so the cost of applying for Probate or Letters of Administration would make it all pointless. I assume the cost of obtaining documents from a solicitor confirming no Will, Letter of Administration or Grant of Probate was ever made would also be prohibitive. I was wondering is there any way I could fight this and get MBNA to pay out with just the marriage and death certificates as evidence. Any help or advice would be really appreciated. Maybe someone else has had a similar experience?
  11. Hi all, Just after some advise as this may be a bit different to other people cases. Today I received a Parking Eye "Parking Charge Notice". It's my car which my wife drove to take me to hospital, she paid using the Pay By Phone app, however she entered her cars registration by mistake. I worry she done this again the following day also! I've appealed and sent a copy of our proof (screenshot with incorrect registration on it) but now I'm wondering should I of come here first before quickly rushing into an appeal? 1 Date of the infringement - 13/09/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 27/09/2018 3 Date received - 01/10/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] NO 5 Is there any photographic evidence of the event? YES 6 Have you appealed? {y/n?] YES APPEAL - I have received a Parking Charge Notice for my car, which my wife was driving at the time taking me to hospital. We made payment using the Pay By Phone app, and once I received this letter have only realised that payment was made however it was made for our other car (*OTHER REG*) as my wife has often used her car to make payments as she has been to the hospital a lot recently (as I’m sure you can check by her registration). Unfortunately this has been a simple error and I attach proof that the payment was made and you'll be able to confirm this as her car *OTHER REG* did not enter the hospital car park on this day.   12. Hello everyone, this is the first time I have ever used a forum, but I hope that someone can advise me. I am a 19 year old photographer and I was commissioned to take the graduation photos of a Malaysian girl and her family. She was graduating from UCL and the job was from 9am to 1.30pm. The fee had been agreed in advance. I have been trying to get payment ever since then. My problem is that she graduated in Law and I do not know where to begin. It also turns out that she is from an extremely wealthy Malaysian family and has appeared in the hit film, Crazy Rich Asians. She is no longer replying to emails or texts. Is there anything I can do to get my payment? Thank you to anyone who replies.

Dear members, I received 3 x CCJs last year to do with Private parking firms but every time came across them well on time with help of my credit score agency and decided to pay up in full within 1 month of judgement date. Just checked for any judgements for peace of mind by paying up for a report via https://www.rtlproduction.com/search.aspx and report says "Nothing Registered" Question is - I've been offered a job which needs an external company to carry on pre employment checks and one of the questions on the form is "Have you ever had civil proceedings taken against you by creditors e.g CCJ or IVA?, if yes please provide details." What is the right thing to do? Should I say No based on report I just ran? Or should I say yes and put a note explaining why did I get it (all comms sent to wrong address and claimant won by default) and that its all paid up in full? How do these agency check such record? thanks
  14. Any advice on this issue. Apparently I have been receiving a pension pay out from my previous employers pension scheme since 2005 when I was 60 and they have now written to me saying that I have been overpaid by £28,050.93 however they will only be recovering the last 6 years total of £9,068.24. They have proved it was their error but I was completely ignorant of this until it came to light on investigation 3 months ago. Is there any redress I can have in this case as with the loss of the income of £130 per month then to come to a repayment plan would leave me with little to live on. Would appreciate some advice on the way forward. Many thanks
  15. Hi i recently made a PPI claim to Car Giant. First of all they said they could find no record of me taking out PPI. But i found the documentation so they had to admit i had it. I filled in the complaint form and received a letter within days. However they are saying they wont admit i was mis sold it as the manager in charge at the time has since left. But they will refund the full amount but will not pay the interest. The total amount i paid is about £1800.00 over ten years ago. Surely by offering me this they are admitting responsibility. And surely i should receive the interest on top. I would be grateful if anyone can advise me if i should dispute this.
  16. Good afternoon, I would like some advice on what to do once a speeding ticket has been paid but then a driver may have evidence that could get the ticket quashed. I have found out recently that our group fleet office has been submitting driver details for speeding tickets, bypassing my company process, and for which subsequently the drivers have been receiving the notices and paying the fines. Some of the tickets I have found out were for the stated offence of 'exceeding the speed limit for a goods vehicle' and for which the drivers have already paid the fines but I know we could have contested these as the vehicles are not goods vehicles, although the drivers apparently did not know any better and paid up. We have the vehicle V5s and photographic evidence of the vehicle interiors clearly showing the vehicles not to be goods vehicles, to whom could we approach to have the fines and points quashed, would it start with the NIP issuer?   17. My van was clamped outside my home early may. I went to the post office, set up a direct debit, then called the clampers and paid the £100 or so clamp fine, clamp was released later that day/eve. I thought that was it. Just received a letter from DVLA conmen asking me to pay fine just short of £200. I was under the impression that if you taxed it and paid the clampers that was it.. I am goinf to appeal it but just wonderd if you had any advice on what I should be saying, will they be softened up if I say I was hoping they would see light if I taxed it etc. Thanks.
  18. Hello everyone, My father is paying a very large amount of CSA debt, payments which cover my brother and I up until the age of 18. However, I know that for me - this is incorrect. My mother was neglectful/ treated me very badly in my childhood, which resulted in me leaving home to live in a hostel before my 17th birthday. After I left home, she refused to declare details of her income so that I could claim EMA (education maintenance allowance) whilst I was at college- whilst continuing to claim family allowance for me as if I was still at home, resulting in me having no income whatsoever. Then when I started university, she refused to get involved with any of the forms I needed to complete. In both situations, it had to be noted that I was estranged from my mother and father in order to be eligible for support and move forward. I understand that these payments are forwarded from CSA to my mother, but of course I dont agree she should get payment for me from when I was 16 to 18. I am not raising this issue to defend my father, as bottom line is that he did not maintain us. But does anyone have any idea how CSA might deal with the matter regarding myself if I were to inform them? Thank you all, Jo.
  19. Hello, Going through my credit file and I have on closed accounts with a UC marker, details of an old logbook loan that was paid off 4 years ago, no defaults, no late payments ever. I wonder why it is there. stupidly it was not the only one I ever took out but they were all paid off. Is it normal for these loans to appear on a credit file? Thanks
  20. I would like to get some advice after I haven't been paid by a company I worked with called Ascot Care. It happened during the new years time when I was booked to work as a carer and my client passed away. The company couldn't find me another placement and told me that I'm not going to be paid, even is they told me before in an official email message that I will be paid if the client goes to the hospital or pass away.   21. Hello all I banged off a ppi enquiry to every single company that I had ever borrowed from, in case, although I'm fairly sure I always declined any extra services. Egg/One Canada Square replied last to say that I did have ppi on a very old credit card back in the day. I complained and today got a letter saying that my complaint was upheld but there was nothing to refund as no premiums were ever applied, something like that. Does that sound sensible/likely? If I dig out some old statements will it show on them as a separate line? SAR? Thanks Micky

I recently paid a £1000 debt to student loans - as they sent me a default notice - and I panicked as didn’t want my CRF damaged again - ( having now a clear record ) so paid immediately by debit card....... I’ve just found out that they ( student loans ) should of not sent the default letter to me asking for immediate payment - as they would of known it was statute barred ? Do I have case ? Or because I paid up I am stuffed - so too speak ? Any info much appreciated ? Thanks
  23. The title sums it up in a nutshell. I pay monthly by standing order and have done so since moving into this house a year ago. I have received, over the last few months, two text messages and two letters asserting that my account is in arrears and that if I don't respond I will become liable for the whole years bill etc etc. My account is not in arrears. I have bank statements which show the sums being transferred to the council in question every month. I have emailed the head of revenue and benefits to tell him to check whatever error is causing this on his system and to point out how unacceptable it is to send people threatening letters in error. I attached copies of my bank statement showing the payments by way of proof. I can well imagine there are some people who would be intimidated or caused undue stress by the type of things they've sent. I copied in my councillor, who acknowledged the message. No response yet from the recipient. Today I have received a court summons for 23rd of May on account of my non-payment. Obviously I am not overly concerned, as I know I have paid and can prove I have paid. What I would like to know is how best to act now? I have let the councillor know what has happened and sought further advice from him . I am not against attending the court date if there is anything to be gained by that for me. The outcome I am seeking is an acknowledgment of the errors on the part of the council and a stop being put to the harassment via text message and letter which has now been going on for some months. Does anyone have some advice for how best to proceed?
  24. Hi, when the whole PPI claim thing started i didn't really think i could claim on this account, but here are the details. I had an Egg card 8 or more (not sure) years ago which started around £500 limit, i had PPI, and they kept raising the limit until about 6 months down the line i had a £3000+ limit, anyway i abused this and got to a point where i couldn't pay off even the minimum monthly payments, so charges and interest grew until the balance was £10k, i told them i couldn't pay this and reached an agreement for a one time payment of £3k to close the account. Would it be possible to claim PPI on this account? I don't know if i have any old statments on the account as i think i threw them when it closed.
  25. Hi, I have recently been to the small claims court to claim £200 from an individual who owed for services I supplied. The defendant failed to attend and after a hearing, I was given judgment with costs. After 14 days no payment has been received so I went to instruct the county court bailiffs but was told this costs £150. Now I thought this seems a lot especially if they are unsuccessful. I decided to call on the defendant and suggest he pay me to avoid adding bailiffs cost to his bill. His was not interested and said bailiffs or not he would not be paying. What if any are my options.
