  1. I'm livid - today we have received a £100!!!!! 'charge' for parking 'longer than the maximum period permitted' (which is 60mins) on the 9th Feb 2019. We went to see an evening performance at Theatre Deli and parked in the carpark directly outside the theatre, which is on a small retail park (it used to be a carpet shop). A theatre performance is obviously going to last more than an hour, and as there were no pay machines we presumed it was free to park (especially on an evening). The notice is dated 21.2.19, the envelope does not have a post mark. The PCN is from VCS Ltd who are members of IPC. Happy to provide more info if needed. Please help me sort this as quickly and easily as possible.

  3. My partners car was stationary in a car park on 06/01/2017. There is a fee payable of 50p for 1 hours parking. The driver of the car went to the machine, realised they didn't have change for it, and returned to the car. The car left. The Reg keeper wasn't driving. When they got back to the car, a plastic envelope with a piece of printed cardboard was inside with the name MyParkingCharge.co.uk on. It has a serial number on it and a date only, hand written. It has no offence date, time, day, location, penalty details, appeal details or registration number of the car. As far as I can see, reading the rules - PoFA 2012, this is an invalid NTD. The date on this card was 06/01/2017. On 19/01/2017 my partner as the Reg Keeper, has received a Notice to Keeper (NTK) letter from Excel Parking. This has all the day, date, time, location car registration and contravention details. The issue date of the NTK is 13/01/2017, but was only received on 19/01/2017. The NTK doesn't mention PoFA act. It states the appeal services is IAS, and Excel are a member of the International Parking Community - IPC. The NTK has no ANPR information or pictures of the car or contravention. I am composing an email to DVLA for the intentional abuse of the PoFA rules Excel and the DVLAs breach. As the NTD is flawed (in my opinion) approaching DVLA is improper and the issuing of the NTK within 28 days means the Reg Keeper is not liable, only the driver. Any thought for suggestion on how to proceed would be gratefully received. NOTE. There is no ANPR on this car Park.
  4. Hi Guys, posting for a friend who needs more than my advice to be reassured what to do, she is on the verge of paying these people! Windscreen ticket in a marked bay for council flats, marked bay was allocated to the resident who was in the car, google nosey neighbour doesn't show the flat's car park as it's gated. The driver was giving the resident a lift home with a baby and helped them into the flat and came out to a PCN, there doesn't seem to be a 'from' and 'to' parking time and the driver says she was only there long enough to drop the baby and shopping off and come out, so possibly over 10 minutes. I have scans of the NTD and NTK in a word document with pictures of the car in the bay and the signage which is too high to see from a car, but I cannot make them into a PDF as I do not have the software or the know how and my PC is on it's last legs so I can't download any new programs. Happy to PM the word doc to anyone willing to help, but it's not redacted either so I will trust you! I suggested doing an appeal that the driver was parked in a marked bay allocated to the resident with the resident's permission which trumps any agreement they may think they have.   6. Hello, I'm in need of help and advice please............. On Monday 14th January 2019 I received a parking charge notice from PCN notice to keeper NTK St Mary's Road Retail Park Car Park, Sheffield S2 4AL- DFS sofas, Ammount charge -£100 within 28 days or £60 if paid before 24.1.19 contravention date: 27.12.18 contravention reason: parked for longer than the maximum period permitted - 120 mins!! Total duration stay: 199 minutes I visited DFS to look at sofas, I presumed this was owned by DFS not a private company!! NTK are lying because I left the car park- drove to Ikea Sheffield and Next outlet over at Meadowhall, at least a 20 minute drive over there. Looked the whole way round Ikea- and got stuck in traffic and then Next outlet, i then called at centretainment to pick family members up and then returned back to the car park to show my family a sofa I'd seen in DFS I have contacted my online banking and have evidence via online chat with them the time of transaction I made at Ikea and also have printed a statement with the date I made the transaction. I'm so upset about it- firstly I presumed the car park was owned by DFS and didn't see a sign. I haven't done anything about this charge notice yet- can someone please advise?? Do I appeal if so what should I reply with? Do I ignore it? Many thanks in advance

Hi, I would like some advice please and wanted to find out what my options are as I feel this parking charge is unfair and from other threads I feel these enforcers are petty criminals preying on the venerable! I’ve been parking at the leisure centre for a couple of years I buy a book of parking tickets that my partner and me use when visiting. On this occasion I was in a rush and filled in the correct registration, correct date, but rubbed out the 10pm, not the 10am as I had meant to. Obviously, the car park is closed at 10pm, its an obvious mistake, but they have issued a ticket for invalid permit. After reading your advice I waited until the NTK arrived, which it did on time. There is no code associated with the offence. They also said that they recently contacted me, which is untrue. The only thing I have had is a fine on the windscreen. I am hoping that someone can advise on the best cause of action from here? For a windscreen ticket (Notice To Driver) please answer the following questions.... 1 The date of infringement? 14th October 2018 2 Have you yet appealed to the parking company yet? No have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] what date is on it. 16th November 2018 Did the NTK provide photographic evidence?   8. Hello I'm hoping you can help me. I received a NTK from NCP using ANPR for parking longer than paid for. Now the issue is that driver (not me) brought a ticket for 24hr parking costing £2.50 and i have a photo of this. The car park in question is protected by ANPR and the driver brought the ticket at 17:07 before leaving the car park 17:16. in my simple world there is nothing to worry about as we should win the appeal ? As i'm the keeper and not the driver who should appeal ? what would be in your minds would be the best approach ? 1 Date of the infringement - 25/10/18 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - date on letter is 05/11/18 3 Date received - i think i received either the 7th or 8th 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?   9. This NTK came to someone I know and quite frankly it's a joke! Date of parking: 08/07/2018 NTK date: 13/07/2018 NTK received (last week, I'll check the exact date) The vehicle was parked from 15:43 to 16:02, the driver went into the pub, spoke to the pub owner while drinking a coke and left. The car park is for the pub only, not shared iwth shops or anything, post code is RM6 6QT Google nosey neighbour link: https://goo.gl/maps/3bb2EhXYUJN2 The reason for the charge being issued is 'Your vehicle was not authorised to park' As the car was there for less than 20 minutes it's not an over stay, so I'm guessing the driver forgot to get a free ticket or register the reg number at the till. Until I see a photo of the car park signs I won't know. Anyway, any thoughts on this one? One thing I need to add is that the registered keeper moved house a week ago so the NTK was sent to the old address, I think they need to send at least one response to Euro CP to advise of the change of address and I guess at the same time deny any responsibility for the keeper as the vehicle was parked correctly (dependant on photo of sign)?

It appears to be UKCPS standard NTK for a stay beyond stipulated time limit.   11. Here's the chain of events, any advice appreciated! Thursday 23rd November 2017 - "An authorised driver" parked my wife's car in a restaurant car park in York, went in to the restaurant to ask if a payment could be made to park until Sunday 26th (Minster Baywatch didn't offer anything above a "3 hours + until 6am" option). £15 paid and a hand written receipt was issued, showing the registration number of the car, and confirming authorisation to park from 23rd to 26th. No other writing on the receipt that stated the receipt needed to be kept on display in the car. Friday 24th November - Parking Charge Notice issued by Minster Baywatch, reason stated that no valid parking ticket was being displayed. Sunday 26th November - Car removed from car park within the agreed time. Saturday 30th December - NTK received. We have made no contact so far with Minster Baywatch. The NTK shows photographs of the car confirming no ticket being displayed on the dashboard. My main question is, because the driver went directly to the restaurant and made an agreement with them, with nothing confirming that their receipt needed to be kept on display, does this in any way override any presumed contract with the parking operator? Any advice appreciated. I have redacted scans of the NTK and receipt from the restaurant, so far keep getting an error when I try to upload them , will continue to try and get them uploaded. Thanks!   12. Aplogies as an absolute newbie here, however I was asked to create a new thread. There is another recent thread (I can't post links, maybe someone else could as seems daft to recreate a whole heap of stuff). I am in the identical situation at the same location I have just received an identical letter from UKCPS, all details completely as the above mentioned thread (same paperwork). My wife was driving my car that day, obviously she didn't spot any signage etc. 28 minutes over a 4hr limit..... Disgusted that companies can request such 'fees', she is disabled (was parked in disabled bay, with badge on show) which has left me even more disgraced at these cowboys operate, with no extra time for disabled people.... Question is approach them & ask for 'understanding'? Dismiss? etc etc
  13. I received a Notice to Keeper in relation to a PCN from Minster Baywatch. I appealed stating I would not name the driver the fee covering the time the vehicle was there was paid in full (they state payment covering the full duration of the stay was not paid) and there is a witness to this. Obviously they refused this, I only found out about their refusal when I received a further notice demanding now £155 it was originally £60 then £100 and now £155. I called and was informed they emailed their response on 15th March. They absolutely did not no email was received at all and I requested a copy which they have sent in the form of a letter. Where can I go from here I am willing to go to court over it at the money was paid. The vehicle was parked for less than an hour and the fee paid covered 2 hours. They state “having thoroughly examined the payment records for the date and time in question we can find no payment having been made for your vehicle” but provide no evidence. “As the keeper of the vehicle you remain liable for the charge, under the Protection of Freedom Act 2012, we are therefore declining your appeal as the keeper” – Are they allowed to keep adding to the charge? Where do I stand with this I have never received a parking ticket and just don’t know what to do. It also states in the letter I can appeal to POPLA within 28 days but their failure to send the email means I’m out of time for this and they say “by law we are also required to inform you that Ombudsman Service provide an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA” – To me this makes no sense they’re saying I have a right in law but they’ll ignore the law? They also have put in a paragraph quoting a “landmark Court decision” and this feels a bit like a threat they might as well say don’t bother challenging us we’ll win! Can they do this as it’s kind of threatening in my opinion. Any advice would be greatly appreciated, if the £2.50 wasn’t paid then I wouldn’t argue but their fee was paid the machine gave an exit time of two hours later but it feels like I’m fighting a losing battle L One last thing the machine was one of those that did not give out a ticket to display, the registration needs to be entered and money paid. Stupidly no receipt was obtained.
  14. Hi Guys, Another case of NTK for over 3 hour stay at Bishop Centre Taplow from Euro Car parks. I received letter in the post to registered keeper with photo of my number plate at entering and leaving times. Unfortunately my partner did exceed the 3hr free parking time stay there. But done bit of shopping there which would be visible on the bank statement. I am preparing appeal to the ECP in hope they will cancel their invoice. Can you suggest any more legal wording I could add to the below draft? Dear Euro Car Parks As keeper of the vehicle, registration XXXX XXX, I have received your invoice number xxxxxx. The driver at the time tells me that they did substantial shopping at several shops in Bishop Centre and that they are therefore not liable to pay you any money. Please find attached redacted bank statement with charges from Tesco and TK Maxx confirming they were legitimate customers and to substantiate their length of stay on site. I kindly ask you to allow this appeal on above mentioned grounds. Should you decide to reject this appeal, please issue me with a valid POPLA code. At POPLA I shall be requesting breakdown of the genuine pre estimate of loss that you charge must represent. Since it was a free car park and not filled to 75% percent at the time there was no loss.   15. Hi all We have received two PCN's from a Euro Car Park - members of BPA demanding payment of £100 each for both mine and my husband's cars. The date issued is 17/12/2016. I cannot recall the full details of the incident so I am relying on their evidence to advise me - however it looks to be very lacking in detail with simply an images of my number plate twice with text underneath it alleging the time of entry and exit. Now this does not seem sufficient to me but you tell me.... Is there advise on the best route of action to take as this is the first letter from them i want to deal with the matter asap but do not want to pay. is there a thread on here that i might've missed that talks about what to do Many thanks Tam
  16. Hi all, Looking for some advice regarding a parking charge received in an NCP car park for having an expired ticket. I park there every weekday for work, I pay for 2 hours as I'm in the office usually for about an hour before heading out again, but on this day I was delayed leaving and returned 20 minutes after it had expired to find one of their lovely bogus charges. I received the ticket stuck to my windscreen, with the time of year and seemingly countless work and personal life issues I didn't get round to writing an appeal. The Notice to Keeper arrived in due course and I haven't responded to that either, most recently I received a Keeper Liability Notice stating that it is now too late to appeal and they will pass the matter to a debt collection agency who may take me to court if I don't pay up. Now I'm not worried about their scare tactics, but I've reached the point where I have room in my brain's limited attention span to deal with this What would be the best course of action at this point? I understand that I was at fault but they're asking for £100 which is ludicrous, and I know they cannot charge more than the amount of lost revenue for the car park owner. Should I write to them offering payment equivalent to 1 hour's parking to cover the lost revenue? Thanks in advance, Nick
  17. Hi all, I've been to one of my customers today who has received a NTK about overstaying in a car park by 27 mins, although a parking ticket had been bought. Details are as follows: Date of Infringment: 13th October 2016 Date on the NTK: 1st November 2016 Date Received: 3rd November 2016 Does NTK mention POFA 2012 ? No Any photographic evidence ? Not in the NTK, although it does state that they have photographic evidence Have you appealed and response to it ? No and No Who is the parking company ? Civil Enforcement Where exactly did the 'offence' take place ? Car Park at 163-165 Bromley Road, LONDON, SE6 2NZ Appeals Body ?   18. Please help! I am a student and voluntary Children's Worker, there is no way I can afford to fight this and lose... Frankly, I'm scared. I received a Notice to Keeper from CPMS Ltd on the 4th of December (apparently dated the 26th of November) demanding that I pay them £100 for parking without a permit on the 26th of October, or that I give them the details of whoever was driving at the time. The Driver is even worse off than I am, she's in no state to deal with this stress. Details of the event are: In the early hours of the 26th October, the Driver arrived at Halls of Residence in Manchester. Tried to obtain parking permit from reception, but as it was out of office hours it was closed. Security not authorised to handle money, so the practice is to leave a note in the book for when reception opens. Vehicles are then registered as being authorised, pending permit being written. Permit paid for and obtained from reception in the morning, however a PCN has already been placed on vehicle. Driver advised by security to just ignore it. Didn't think to tell me. --Fast forward to 4th December-- I, the Keeper of the vehicle, receive Notice to Keeper in the post. Panic! I have contacted the Halls Reception, but they said there is nothing they can do, it's nothing to do with them, go talk to CPMS. What do I do? My mother is seriously unwell at home, and having bailifs turn up on our doorstep when I'm not there would kill her... I'm sorry if this is in the wrong place, I just don't know what to do.

  20. I received a notice to keeper asking for £100, discounted to £60 if paid within 14days. £100 for 20mins in there! No clear signs seen, other than it was a private car park. It was dark also. Assumed it was an industrial estate and remained with the car the whole time. Naively assuming it'd be no trouble and would move on if asked. Planning to appeal on the grounds of unreasonable charge and will use the parking cowboys letter! Wish me luck!
  21. Hi All, Hoping you can assist... I have received a letter from Gemini Parking Solutions about a parking ticket that was issued on March 30th. I believe it is a notice to keeper because it references the POFA 2012 and mentions that they have requested my details from DVLA as the registered keeper. However, I have read that they are not allowed to do this earlier than 28 days after the PCN is issued. Which brings the first date that they can do this to April 29th. I sold my car (to We Buy Any Car, not sure if this is relevant) on the 3rd April. How did Gemini get my details, when from 3rd April WBAC would have been the registered keeper???
