Hi all, this morning I received a charge notice from CP Plus for staying too long at Donnington MOTO services. I have to say I have never been before and was concentrating on where to park so never even considered a time limit. Its not often I use services and assumed there would be plenty of time. I now know I was wrong. I stayed 2 and half hours according to the in and out time. It was about 3 weeks ago, so I cant honestly remember. From what ive read they have to send the letter within 14 days - which it isn't. so guessing I either choose to ignore or appeal on this fact? 1 Date of the infringement15/9/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/10/17 3 Date received 7/10/17 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No - not that I can see anyway 5 Is there any photographic evidence of the event? Photo and timestamp of car in (12.21pm) and car out (14.55pm), also showing reg plate 6 Have you appealed? {y/n?] post up you appeal] Have you had a response? [Y/N?] post it up Not done anything yet 7 Who is the parking company? CP Plus 8. Where exactly [carpark name and town] MOTO services Donington Park For either option, does it say which appeals body they operate under. 'operating in accordance with the British Parking Associations Code of Practice' Apologies if I have done anything wrong, a lot to take in. Any advice welcome as to my next step. Hi, First post, must say this seems to be a great website. Looking forward to the great advice from the community! A bit about myself, I suffer from a couple of common illness's that cause fatigue. I have subsequently changed my diet, job, leisure activities, sleeping pattern etc. One of the things I do that helps, is to offset my commuting so that I'm not traveling in rush hour, in an effort to reduce traveling time, this might mean that once I am past the busy sections on my route, I might catch up on a couple of hours sleep. This brings me to why I'm posting, as the title suggests, I exceeded the free parking period at MOTO Wetherby and have now been hit with a £100 fine, £60 if I pay before 14 days. I was driving back to Leyton in London where I live when I became too tired to drive and pulled over at the services area in MOTO Heston Services. I remember I was around 45 minutes from home at that time but I was just too tired to continue safely. I fell asleep almost straight away and woke up leaving the services area and overstaying by 32 minutes. I’m just an honest working guy and felt it was dangerous to continue driving. CP Plus 8. Where exactly? MOTO Heston East I'm looking at an appeals template and it has this as a possible argument in it: Your Civil Parking Notice constitutes an invoice for payment. Accordingly your invoiced charge must include an element of VAT. However, your civil parking notice does not state either a VAT registration number or an invoice reference number and so cannot constitute a lawfully valid demand for payment. Any success, with this approach?

Hi, I was driving back from London home to Somerset, and due to a long day pulled over to the service station to take a rest. I fell asleep in the car and stayed there for 3 hours 22 minutes. They have sent me a charge notice saying I was parked over and above the time allowed without payment and have sent an £80 charge notice for this. However, the notice has a photo of my car arriving, and my car leaving, but no photo of me actually being parked. Surely there is no actual evidence that I was ever parked in their car park, and that I could for all intents and purposes have been driving round the car park for 3 hours. Without an actual photo of me being parked on the land owned by MOTO, surely they cannot enforce this notice.

afternoon all, after a bit of advice. I have got a PCN and im thinking i may have to pay this one but as always, i like to get your advice before doing anything around parking tickets. I overstayed by an hour in the services at MOTO swansea west and ive been sent a NTK in the post. I hold my hands up, i overstayed. Reason being im a fireman and i was lift sharing with my mate as we only needed to drop some stuff off at the station, thought we'd be an hour tops and we ended up being longer because there was a call. I think if i appealed this one id be relying on the POFA and just chancing it. what is the expert advice? I think my defense would be shaky if this one went to court but i do despise paying these people so much money when they have incurred ZERO loss. It was an empty motorway service car park. This one: Dear Sir Ref ***** I am challenging this Parking Charge Notice I was not the driver of the vehicle and your Notice to Keeper fails to follow the statutory wording of the Protection of Freedoms Act Para 9 to pursue me as keeper. I also refer you to Para 4(5) of the Act that under no circumstances do I have any liability for your "£40 initial charge" or any other charges. Hi, New here, would appreciate a good advice! Received a 'CHARGE NOTICE' from something called CP PLUS limited. The letter states there are BPA member and the postal address is PO BOX 3573, Barnet, EN5 9QA They sent a photo of me going in and out the private car park (that's heston west services to do with costa, travelodge, etc.). They say I overstayed by 50 minutes. They provide a photo of the sign saying that parking charges apply after 2 hours, how to pay post 2 hours and that camera enforcement is in operation. Few questions: 1) Along with phone (03339390104) and address, they also provide a link to appeal: APPEALPCN.CO.UK This looks VERY dodgy, and besides it is an unsecure form. Is this legit at all? 2) I can't see their company website address anywhere, is that normal? Searching cp plus online doesn't give much info either. [problem]? 3) They demand £100 to be reduced to £60 if paid within 14 days. Is that a reasonable charge at all? Any advice? Many thanks

Hi guys and girls, haven't been on this amazing site for a while, but I'm hoping some knowledgeable bods here can help me! we've had an unwelcome charge notice issued by CP Plus. I was in the M1 Toddington service area having a chill out food/drink/rest break after a long motorway drive in the small hours of 21/10/14. I arrived there at 10:25am, and was clocked leaving at 14:02pm. A stay of just over 3 and a half hours. I felt groggy and needed a long break and a small nap to recharge before heading off. I had no idea to be honest that you only had 2 hours free. ...as I was there for 90 minutes over this, they want £100 as a 'parking charge'. They've kindly offered to reduce this to £50 if paid within 2 weeks. How kind. £50 or £100 for 90 minutes....are they serious!? I'm quite well read on the various ins and outs of these letters. I understand the whole Parking Charge Notice v Penalty Charge Notice issue, and the fact that these people have no rights at all as this is on private land, and not public land. what I have is an invoice, and they can't demand anything from me by law. I know the done thing a while back was to just ignore these, but I understand that doesn't really work now. So I have a few questions... 1) The letter was sent to my wife as she owns the car. I'm insured on the car, and I was driving the vehicle. She was at work. Do they need to prove it was me? Do I tell them to correspond with me, or just play along and leave it in my wife's name? 2) I know if I appeal, it will 99% be rejected. I get the impression this company are quite weak on following up and going to court as it loses them money, and I know they don't have a debt collecting arm to their business. So should I appeal, hope that they reject, offer me a chance to go to POPLA and then go from there? I think they have a set number of days to give me an appeal code/ref... ..and if they don't supply it, then they are dead and buried. Is this correct? 3) I was going to appeal on the following - The charge being completely inappropriate and disproportionate. ...its a free car park, they've not lost anything.. ...secondly by writing 'charge notice' on the letter I believe this breaks some kind of law by making it look like an official police/council demand etc and is unlawful... ..thirdly it says I agreed to their terms and conditions when I parked there. I didn't even see it! How can I agree to something I haven't seen??.. ..fourthly the car park was nowhere near full. How is me staying an extra 90 minutes costing them £50 or £100? I've not denied anyone a space or anything! Sorry if this is long winded. Any advice is much appreciated! MB

On the 17th August i parked at the service station just outside of Oxford that has Parking Eye .... though i didnt notice until after leaving about 4 hours later. It was about 3am when i parked as i was shattered and had a sleep. Now the car is registered in my mothers name, so these people sent a billl for 60GBP to her house which she stupidly paid. Now i am utterly livid that she would go behind my back on what is a civil case and we've had a huge fallout. So i am wondering as this company have billed the wrong person is there anything i can do for them to come after me and get the money my mother has paid back. I am willing to cut my nose off to spite my face as i hate what England has become where everyone is willing to ... everyone over at the drop of a hat. Maybe next time i will carry on driving whilst tired and run some one over im sure that'd be of benefit to them . .. i can honestly say at 3am i did not see a sign about this Parking Eye.
