  1. I overdid my stay in Lidle as I could not decide over a walllnut loaf or a graian loaf (honest). Have had a letter come in the post saying I owe £45 (£90 if not paid in 14 days). I understand a lot of these private car park firms have little legal legs to stand on, can I just tell them to shew or is there a small amount I can pay, I heard if there is an hourly rate they can legally only charge you per that hour that you stayed. Any help would be greatly appreciated. Just read this.... Dairrty old buggers aint they. http://forums.moneysavingexpert.com/showthread.php?t=4694729
  2. Hi, I have received a Civil Parking Charge Notice from Athena ANPR Ltd for exceeding the parking time limit in a Lidl car park in Barnsley. I registered my VRN in the store to validate my stay - I did not realise there was a one hour limit. There are signs around the car park but I did not park near one of them and I did not read them. The signs were not big enough to be read from a distance. How do I proceed with this?
  3. My husband has received a Civil Parking Charge Notice, it's dated 20th November but we received it today!! He was parked for 1:45:12, so 15 minutes and 12 seconds more than allowed. My issue is that we have recently bought an electric car and are lucky that in our local Lidl there is a charging point for 2 cars. Unfortunately there aren't any signs as to what it is and any time I go in I have to wait to park. I have had 2 people kindly telling me there are other spaces, when I point out that I can only use 2 they say 'oh, I wondered what that was'. My husband was parked for less than 90 minutes but in the car park for more. Can we appeal?
  4. Hi - I was caught by an ANPR overstaying by an hour and a half at Lidl, Hayes. I was a customer in the store that evening and have proof of payment of purchases that did take a long time (kids winter wear in the aisle of shame...) but did subsequently overstay beyond that. Details are below. Is it worth appealing to Lidl on this one or do I have to suck it up as it was such a substantial amount of time overstayed? Thank you very much 1 Date of the infringement 29.11 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 3.12 3 Date received ? 6.12 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] NO 5 Is there any photographic evidence of the event? YES - ANPR 6 Have you appealed? {y/n?] post up your appeal] NO Have you had a response? [Y/N?] 7 Who is the parking company? ATHENA 8. Where exactly Lidl, Hayes For either option, does it say which appeals body they operate under. Letter says IPC
  5. Hi all, After some advice after receiving a Civil Parking Charge notice for Lidl in Cambridge Street St Neots. 1 Date of the infringement 02/12/18 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 04/12/18 3 Date received 06/12/18 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No, not as far as I can see. 5 Is there any photographic evidence of the event? Yes 6 Have you appealed? {y/n?] post up your appeal] No, only recieved today Have you had a response? [Y/N?] post it up 7 Who is the parking company? Athena 8. Where exactly [carpark name and town] Lidl St Neots, Cambridge Street (there are 2 x Lidl's in St Neots) They operate under IPC. So, as above. I got into the car park at 10.46am on Sunday 2nd December and left at 12.29pm on the same day. Total stay of 1hr 42 mins. Free parking is limited to 1hr 30 mins. I went into Lidl to grab some breakfast before I went to the gym which is right next to Lidl and then went to the gym and then grabbed a bottle of water from Lidl after the gym. Not disputing that I was there that long, I honestly didn't realise I had been there that long. I have no receipts for Lidl. Any advice please would be appreciated.
  6. Hi guys, I received a PCN through the post yesterday 13/05/18 to a civil parking charge notice from Athena ANPR as I overstayed at a LIDL car park. The car park was free for 90 minutes. I overstayed by 50 minutes Entered park: 08//1 at 09.24 Exited park: 08/5/18 at 11:44 I received the PCN yesterday (13/5/18) I have now been charged £90 and told that I will only pay £45 I'd I pay within the next 14 days by this date (24/5/18). I have been sent a letter with photos of my vehicle to prove. I did shop at LIDL on the day, and have the till receipt with me. I'm not usually late but the day in question I overstayed with 50 minutes over of the allowed 90 minutes doing other errands. Any help and advice are greatly appreciated as to what I can do. Thank you, Lloyd
  7. After reading a lot of threads i want to defend this. I've already done the following. pop up on the MCOL website detailed on the claim form. . register as an individual note the long gateway number given then log in . select respond to a claim and select the start AOS box. . then using the details required from the claimform . defend all leave jurisdiction unticked. click thru to the end confirm and exit MCOL. . get a CPR 3114 request running to the solicitors type your name ONLY no need to sign anything. (will be posted to them on monday) Other details: Name of the Claimant ? - Euro parking services limited claimants Solicitors: Gladstone Solicitors Limited Date of issue – 9th Nov 2018 What is the claim for – (to note there is no registration on the letter either) The driver of the vehicle registration (the 'Vehicle') incurred the parking charge(s) on 26/08/2017 for breaching the terms of parking on the land at Lidl & travelodge The Defendant was driving the Vehicle and/or is the Keeper of the Vehicle. AND THE CLAIMANT CLAIMS £160 for Parking Charges / Damages and indemnity costs if applicable, together with interest of £14.25 pursuant to S69 of the County Courts Act 1984 at 8% pa, continuing to Judgement at £0.04 per day. What is the value of the claim? - £174.25 amount claimed, court fee £25.00, legal rep costs £50.00 Total amount £249.25 Has the claim been issued by the Private parking Company or was the PCN assigned and it is the Debt purchaser who has issued the claim ? Euro parking services Were you aware the account had been assigned – did you receive a Notice of Assignment? - Not sure what this is? Other things to note: - There is no pay and display at the car park. There is signage which states customer have "x" amount of time to park as a customer. (Going to check the time on the signage and take photo's) - I have receipt of the driver's purchase at the store - Dated 26/08/2017 with a time of 13:59 - The two photo's in the notice to keeper letter both showing the vehicle moving dated 26/08/2017 and time stamped 14:14 - I no longer own the vehicle - I tried contacting lidl but they basically told me to take it up with euro parking services. What's the best line of defence to take? -Check with the council whether they even have the planning permission? -Check the so called "contract" on the signage and use the receipt to counter the "breach"? -Provide the evidence that car was not parked as per the photos? Thanks in advance
  8. My daughter received a so called PCN from these jokers, she had apparently overstayed by 10 minutes. I helped her with the appeal letter and we sent it using my email. They've replied saying they can't continue correspondence as the name on the email is different from the name they have on file as registered keeper & they want proof of ID either Passport or Driving Licence. We've both replied saying that's not happening & my daughter asked whether they'd have requested ID from a posted letter appeal and her email could be unicorns&rainbows@blahblah and that wouldn't match the name either. I've requested they just judge the appeal and get on with it we'll then go to PATAS or London Tribunals if it goes against us and I feel alarmed at their harassment and it's distressing. Any further tips, its my first post so thanks in advance
  9. Hi all, I'm trying resolve this issue with PCN I have received recently from Athena ANPR Ltd for overstay at Lidl. The overstay was 14 min. 35 sec. Arrived at 09:43:43 and left 11:28:18 = duration 1:44:35 Shops opens from 10AM Sunday. Short story, it was Sunday just before 10AM and I saw ppl outside Lidl so I thought it might be open. Parked my car and there was just a queue in front of Lidl..., so went for a walk, as this was my first stay in Mablethorpe. Off course I did forget to take my swimming shorts with me, so spend bit longer in Lidl, looking for shorts. Few days later got this PCN. I think this isn't fair as if you look at the time the shop opens and the time I have left the parking is just within 90 minutes. Normally I don't spend this much time inside the shop. Do you think I have a chance to get this PCN canceled ? Just want anyone's thoughts before I do appeal. 1 Date of the infringement 01/07/2018 2 Date on the NTK 04/07/2018 3 Date received 07/07/2018 4 Is there any photographic evidence of the event? Yes. Driver and occupants not visible though. 6 Have you appealed? {y/n?] post up your appeal] No. Here's the question: do I have to appeal to Athena and Lidl ? and what would be the best way to appeal, by post or email ? Also is there a template how to appeal, this will be my first time. Do I have to write my story or just complain how unfair they threat the customers ? 7 Who is the parking company? Athena Parking 8. Where exactly [carpark name and town] LIDL Mablethorpe - High Street, Mablethorpe LN12 1EH Appeals Body says the IPC. The occupants of the vehicle did shop in LIDL on the said day. Thanks for any help
  10. Hi all I am trying to help my Aunt who has received one of these parking charges through the post. 1 Date of the infringement 18/06/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 20/06/2018 3 Date received 22/06/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Not that I can see 5 Is there any photographic evidence of the event? Yes. Driver and occupants not visible though. 6 Have you appealed? {y/n?] post up your appeal] Sent emails to LIDL Have you had a response? [Y/N?] Yes. LIDL are unwilling to cancel the charge and are now ignoring emails 7 Who is the parking company? Athena Parking 8. Where exactly [carpark name and town] LIDL Manchester - Ashworth Street, Denton M34 3LJ Appeals Body says the IPC. I have been reading a few threads on here and a few other places, and I was under the impression that emailing LIDL direct usually killed these things off ? I had had a few replys but they are unwilling to cancel it, and are now ignoring emails on the date in question my Aunt was an occupant in a vehicle that is registered in her name . She is partially disabled and walks with the aid of a stick. There was also a Blue badge on display if that matters. The charge is because the vehicle overstayed by 30 minutes. The occupants of the vehicle did shop in LIDL on the said day (No till receipt though unfortunately). I am thinking next course of action to write direct to LIDL head office ? Just want anyone's thoughts before I do. Thanks for any help Lee Here is a copy of the parking charge notice which I meant to post. http://i65.tinypic.com/rvjzi1.jpg http://i68.tinypic.com/f9nsib.jpg Pics are not displaying for some reason. I used tinypic for reference.
  11. Daughter (not the registered keeper) parked 25mins over the allowed time at Lidl Clapham Junction car park. Did some shopping and mostly browsing at Lidl Clapham but also went to other stores. Got sent Civil Parking Charge Notice. Was intending to pay within 14 days but forgot and now it is over 28 days. Any advice would be helpful Many thanks
  12. Hi i have recieved a PCN from athena anpr for going over the 90 min parking limit in lidl. I was 14 mins over. I have read previous threads and i am 50/50 on whether to ignore or pay. Please help
  13. Hi! My wife shopped at Lidl and where in and out for 54 minutes. car park says its "FREE" to park for 1 hour 30 minutes if you registered your vehicle. We have been shopping at this Lidl for years and we never have to scan anything for parking so she did not scan the receipt as she wasnt aware and its probably something new. so after a few days we got a Parking charge notice (PCN) with a heading saying that its a "CIVIL PARKING CHARGE NOTICE" and they are asking us to pay £90 (or £45 if paid within 14 days). I believe that my wife did no parking contravention nor parked there illegally. she was a paying customer and she was well within the allowed parking hours. should we appeal and give them our details or should we just ignore it like what other people have done. please give some advice. thanks
  14. Hi guys, I have got home today to a civil parking charge notice from athena ANPR as I overstayed at a LIDL car park. The car park was free for 90 minutes. I stayed 100 minutes and 8 seconds. I have now been charged £90 and told that I will only pay £45 I'd I pay within the next 14 days. I have been sent photos of my vehicle to prove, along with threats of debt collection or further legal proceedings if i don't pay. I did not shop at LIDL on the day, was being 'cheeky' I guess and just using their park for free. LIDL was only open for the first 10 minutes of my stay, after that the shop closed and, up on returning to my car, the car park was empty. I am not used to these kind of situations and have never been in trouble before. I am so tempted to pay just to satisfy my mind and family, who say it would be stupid to ignore it. I have good credit rating and would rather just pay this fine than ruin that. Does anybody have any advice as to what I can do? Thank you, Kelly
  15. This is a summary & later details are from other things I have read here. All correspondence with Lidl has been by email, excluding the first which was via their website, but I kept a copy. My house was badly flooded when we were on holiday, a major burst that probably ran for over three weeks. Relatives helping me used my car to take things to the dump, then drove into a Lidl I had suggested nearby to buy baking powder for cleaning & tea. (They also bought cakes, as the receipt was in the bag, but I don't know where it is now). The car is a coupe & is quite low (as standard) & hit a speed bump making "the exhaust sound funny". They bought what they went in for then found the car could not drive as the exhaust had partly fallen off & jammed under the car. There's pictures of this that have been sent to Lidl. They had tried to release it but couldn't then called me & I called my garage who are not far from that Lidl, but they could not go for hours so I called the breakdown company, who appeared later & released the exhaust, leaving the car drivable but without a back box. The staff in Lidl had already given them a long cardboard tray thing to put the exhaust in so the boot would not get dirty when they had been told what had happened. A letter arrived a week to the day later saying the car had overstayed ?90 mins? & owed £90. This was sent to me but was shoved in a brown envelope & the date put on it by my niece. About 2-3 weeks later when at the house I opened it, but left it there & its now part of many bundles or might have been binned, as even as the house was drying water/dampness would collect on the hall floor. The letter was not from Lidl but from a parking company & "as the car was registered to me" So I contacted Lidl telling them what had happened & sent the exhaust pictures & explained I can't find their parking company's letter & they told me to contact the parking company "with the reference number on the letter". I wrote to them explaining they had sent a standard reply & they said they would look into it. I then contacted my breakdown company & asked them to send confirmation the car had "broken down" & they also gave me the name of the breakdown company who had attended, so I could obtain their vehicles registration that must appear on the records Lidl have for that day. I then wrote again to Lidl telling them the letter was coming from the breakdown company & the registration of the breakdown truck. So today again an email appeared telling me... "You will have to contact Athena ANPR directly." But without an email address or contact details, or the reference number they have told me I need. So I'm feeling pretty harassed along the lines of I appear to be dealing with monkeys whose speed bump has trashed my exhaust & want me to pay £90 for the privilege. I'm in Scotland & use Lidl fairly often, having swapped from Waitrose when they became political during the Scottish independence campaign. But they've shot themselves in the foot on that one now. Looking through things over people have been asked & answering them. It happened mid January, & the letter arrived a week later to the day but was not opened until later. The date will be confirmed when the breakdown company's letter arrives. No appeal has been submitted as I don't have the letter or reference number & Lidl don't seem in a hurry to give me this. I'm guessing Lidl is trying to take it beyond an "appeal by" date. The letter did have pictures of the car going both in & out & said how long it had stayed. Other than that there is not much I can tell you. The carpark was Lidl Govan, under a 5 min drive from the dump. We are not staying back at the house yet & the date for moving back in is the start of March.
  16. Hello, My mother has just called me saying she has received a letter from Athena ANPR Ltd for overstaying 21 minutes at a Lidl store in Melton Mowbray. 17. Hi all, Received an NTK about a civil parking charge notice from Athena in the post today, I've done some reading on the forum so haven't contacted them and will not disclose who the driver is. Car was parked at LIDL for 50 mins but the driver did not register at the terminal for the 1.5 hrs free parking. The driver did a full shop with debit card (we have receipt as well). LIDL address is: LIDL Walthamstow 43-49 High Street, Walthamstow, London, E17 7LD (google says 7AD but notice and other sites say 7LD) What's the best course of action? Letter to LIDL CEO department? Anything else I should do also and any tips on the letter? (e.g. should I attach a photo of the receipt?) For tickets received through the post (Notice to Keeper) please answer the following questions. 1 Date of the infringement [/color]21/11/17 2 Date on the NTK 24/11/17 3 Date received 27/11/17 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?No 5 Is there any photographic evidence of the event? Yes, a picture of the car leaving and entering with date and times, license plate is clearly visible but driver is not 6 Have you appealed? No Have you had a response? N/A 7 Who is the parking company? Athena ANPR For either option, does it say which appeals body they operate under. There are two official bodies, the BPA and the IAS. If you are unsure, please check here IAS Will upload pics of sign shorty but doesn't say anything out of the ordinary really apart from register at terminal for 1.5 hrs free parking, 90 mins max stay, you will be charged if you breach any of the other terms of parking. 19. I don't have a Lidl within a reasonable distance, but there is an Aldi. Are these two stores similar in price and quality ? I would appreciate some comments from customers of these stores - Thank you
  20. Hi All, Lots of threads about this lot, and lots of information to go through.. ...seems each case should start a new thread: I need advise to my next steps. I think I may have made a mistake: NOTE: I do have a bank statement showing a payment on the given date. However, don't want to use this, as these things infuriate me that they can get away with this stuff.... I have scanned my letters and emails attached. As advised redacted info. Attached is: Letter 1 - First ATHENA invoice. EMAIL - Back to Athena, this is where I may have made a mistake as I make and "Appeal" Letter 2 - Mean words. ATHENA making assumption about ME being the driver.....what proof? Letter 3 - ATHENA being more mean. I now need to know what the best course of action is? Ignore them? Pay them? Send more letters? Cheers Richard docs1.pdf
  21. Hi Guys, Need your advice on this unusual problem. Sorry story is a bit long. I’ll spilt it by bullet point to make it easier to read: 1. 23 Dec 2016 – went to the store made small purchase requested £50 cashback. Was deep in my thoughts. Felt a bit awkward at the end of interaction with cashier who started behaving strangely by completely ignoring me and started chatting with colleague. After packing few purchased items I was waiting patiently not realising what for. Felt as something did not finish - no eye contact from cashier, no thanks / goodbye. I’ve felt a bit strange and waited for much longer that socially acceptable in such situation and then left the store without exchanging a word with cashier. 2. Few day later realised I did not had my cash. As I was not out of the house since visiting store I could not have spent it or lost somewhere. 3. Waited for store to open again and went to speak with manager on 27 Dec 16 to ask them for my cashback and checking CCTV to confirm it was not given. Duty manager said he cannot view CCTV but checked till for that day and there was no extra cash in the till. He also found small receipt with my signature that confirms I’ve received cash. Signature seemed to be mine but I do not remember signing it nor receiving cash. 4. I’ve got my receipt with cashback on it. I am guessing I was asked to sign small slip confirming I was given cash and then was given my store receipt. That triggered me into thinking I got what I needed and made to forget about my cash by cashier starting to completely ignoring me. 5. I’ve spoken to customer services and same manger again who were pointing at each other saying I need to request CCTV footage and pay for it and that only store manager / area manager can view CCTV. 6. 6 Jan 16 spoke to customer services who then spoke to store manager who then checked till records again stating no extra cash was reported on that day. 7. Managed to speak to store manager in person on 6 Jan 16. Did not get much was just fobbed off making it sound it was my fault and I should have checked cash in store and they conducted their investigation. This person was quite elusive did not wanted to talk. Said nothing I can do. Both managers felt a bit arrogant almost as if they were saying good luck with that! If you know what I mean. 8. 6 Jan 16 stated electronic communication with customer services sending all above information via web form. Starting message with I am making formal request for CCTV footage under Data Protection Act 1998 confirming I am happy to pay for it. Providing all relevant details timing till number etc. 9. 18 Jan 17 sent them all above information in registered letter. 10. Did not get any response for around 10 calendar days and called them again to chase up for reply. 11. Received reply on evening of 20 Jan 17 (Friday) stating they passed for investigation to area manager. Provided instructions for requesting CCTV and how payment should be made. Advised that I need to contact police if I felt there was theft. 12. 20 Jan 17 I replied via e-mail and asked to place hold on the footage to ensure it is not overwritten as I’ve read somewhere that their retention period is 30 days. 13. 21 Jan 17 (Saturday) send request for footage as per their instructions. 14. 26 Jan 17 received letter stating request is outside of system storage capacity. 15. Chased them up for finial outcome of area manager investigation knowing what they will say. 16. 16 Feb 2016 Received response stating CCTV has now been overwritten they conducted till review and no extra cash was found. Nothing else they can do and I can contact the police. My view on that is that they ignored my initial request under Data protection act sent to them on 6 Jan 17. Purposely delayed providing instruction for requesting footage and timed it so that I have 0% chances of making it successfully and that it reaches them before 30 days retention period to cover up for their employees. I’ve seem to exhausted my option to get this resolved with the company and looking for advice on taking this further. I feel up to taking them to small court claiming for postage, petrol cost for number of trips inconvenience and original cashback. Just wanted to get your views on chance for success and some help with small court procedures if will be going that way. Thanks for reading!
  22. Just received Civil Parking charge notice for exceeding allowed duration of stay by 40mins at Lidl. Did not enter car reg at terminal, do not have any shopping receipt either. Says amount due £90, discounted ot £45 if paid in 14 days. It has photos of car entering and leaving site with car reg, can't see driver in photo. PCN issued by Athena ANPR Ltd " the creditor". what do i do? no income, no savings. thanks
  23. Evening, Last wednesday iv received typical civil parking notice from Athena. 45 quid Iv overstayed 10 mins. Went into lidl to buy water and some biscuits, paid cash. threw out receipt. Afterwards went to the bank which is in opposite street. Came back to car and drew away. I don't usually shop at Lidl, so i wasnt aware of their policy regarding parking. After the incident, i went back to the same Lidl to take sign photos. What really surprised me that there's no mention 10 min rule. Besides isn't it clearly stated, that i can park for MAXIMUM STAY 90 mins per store. Really confused here. How to proceed ? Thank you for your help.
  24. As a gym member, we're allowed 2 1/2 hr free parking. On the day I took my daughter's car and input my car's reg on terminal. After gym session, I went to lidl for some shopping but paid via cash. I thought I'm still within 2 1/2hr time limit so didn't bother to extend on lid's terminal. 1) Should I declare that I'm the driver on the day? Then explain the situation. 2) As the fine is for exceeding the time limit of 01:30hrs, I'm thinking that gym membership parking allowance should cover despite the actual stay being 02:46. 3) the registered keeper (my daughter) is not in UK since Oct and won't be back until summer of this year. We can provide copy of passport and visa to prove it but really don't want to give passport details. Never had civil parking fine and not sure how best to proceed. Any help would be appreciated. Thanks.
  25. I have been called in by my boss today and presented with the attached....how is the best way to deal with this please ? My boss wants me to pay...
