  1. Hello all. Long time lurker here but first time poster. Please see completed form below: 1 The date of infringement? 06/07/2018 2 Have you yet appealed to the parking company yet? N have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] No what date is on it N/A Did the NTK provide photographic evidence? N/A 3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] 4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? 5 Who is the parking company? Indigo Park Solutions UK Ltd 6. where exactly [Carpark name and town] did you park? Tring Station Car Park, Tring. Hertfordshire The penalty notice was issued by Indigo Park Solutions UK Ltd on behalf of West Midland Trains for Breach Code 1 - Failing to display a valid ticket or voucher. At the top of the Penalty Notice, it notes that the car park is regulated by the terms and conditions of parking displayed at the car park in accordance with Rail Byelaw 14, and so on........ Please could someone advise the steps I need to take in order to not pay this please? From reading around this wonderful forum I can see that this appears to be unenforceable in a magistrates court (which I gather they would never do anyway due to not receiving any money from it) after 6 months, I would appreciate a few bullet points outlining what the steps are to get to 6 months and what type of correspondence I can expect please. I'm keen to take this on based on what I have read, however my wife isn't and is looking for some reassurance from the more knowledgeable folk on here. Thanks in advance!
  2. Hi. I had a problem with a PCN from Indigo a few years ago and received excellent advice from here to "sit tight". Was successful. Thanks. However, we now have another similar case and someone told me that recent case law has changed things, so I wanted to check that sitting tight is still the right course of action. My wife parked at a Southern Railway station car park recently and used the automated phone response service to pay for a day's parking. Unfortunately, the regstration number used on the automated system was incorrect - one letter was accidently missed off. There was no windscreen ticket, so I assume control was by CCTV. We have now received a PCN from the PCN Admin Centre (29 days after the event) acting on behalf of Indigo requesting payment of £100. It's a "penalty notice by post notice to owner" quoting byelaw 14. In the time between the incident and receiving the notice she has parked there twice more, so I assume we will receive more notices in respect of these dates. So, should we just sit tight? Would it be better to write to Indigo explaining what the mistake was? They could check their records and see that they did receive payment each time. Also, I don't think the registration number used actually exists. Thanks for your help.
  3. Hi everyone, love the website, long time lurker.. I received a lovely yellow penalty notice stuck to my window today. I have attached the 'ticket' in this post. From what I understand I should not do anything until i'm sent a notice to keeper, is that correct? And then from there I'm a bit unsure, so any guidance would be greatly appreciated!   4. On Dec 21st at a Kent railway station I parked in an area that has always to my knowledge been free to park (I have lived in the area all my life) Its residential and has diagonal bays. Upon my return I have a Penalty Notice stuck to the wind screen of my car. I have checked and signage is at best very difficult to see. I did some reading and am awaiting a letter from Indigo, to date 07/02/18 I have received nothing and am wondering what happens next. The vehicle ticketed is a company lease and is through my personal business. Any help would be appreciated.
  5. Hi there I'm being pursued by these people for some very unfair tickets. I know there is a lot on here about different approaches etc but I was interested in the 6 month rule, can someone please explain the law around that? Also, the tickets definitely say Penalty Notice not Parking Charge, does this mean it's official? Thanks in advance for all your help
  6. Hi All. I'd like to share my experience to date with this: On 13 Dec 2016 I parked at Battle rail station and paid using my mobile phone. I successfully paid but my phone would not reply to the 68680 SMS I was sent and had to reply to with my vehicle reg. When I returned I found a Penalty Notice quoting Rail Byelaw 14 for £100. My appeal with Indigo through their web based appeal system was rejected and I am now in the process of appealing through POPLA. I have been investigating why my phone would not reply to the 68680 SMS. I only had 7p credit on my phone and the 68680 SMS short code is classified as a premium rate number by O2, and is therefore excluded from my pre-paid phone bundle. The cost was more than 7p (I believe it to be 10p) so it would not send. The car park placard with payment instructions states that there is a 20p charge for using the service, which is added to the parking fee and is paid when you call the 0345 number. No where does it mention an additional fee for replying to the SMS. O2 have 68680 as operated by Mirada and listed as a premium rate gaming number. I have also spoken to OFCOM and they say because the charge is no more than 10p it is not classified as a premium rate number, and is therefore unregulated. This looks like an operator exploiting a loophole to me. The number is listed as premium rate, so is excluded from pre-paid packages, and because the charge is 10p, OFCOM say it is unregulated, therefore there is no need to display charges. If I had had more than 10p credit the SMS would have gone and I would most likely never have noticed the additional charge. To rub salt in the wound Indigo make a big play on their web site that there are no hidden charges. I have informed trading standards through the consumer advice phone line.
