  1. Feeling like I could do with some advice please. I have had 2 PPI's that HSBC have agreed to pay out on. I sent all the forms back on 16th Feb and was told that the offers were sent out to me that week. Nearly 7 weeks on and I have still had nothing in the post. I have been chasing weekly and have been promised calls back on 8 occasions. Can someone give me a direct email address of the head of complaints who deal with PPI at HSBC? With a husband who has been out of work for 8 months, this PPI payouts really will ease things for us and was hoping that they would have been in out account by the end of March. Any advice I'd be so very grateful for. Thanks in advance.
  2. I agreed to a Tomlin order back in 2012 with an agreed payment of £50 per month. My solicitor recommended we agree, having nuked a couple of other credit card debts for me. One of the terms was a voluntary charging order which never happened, I sold the house in 2015, never even considering the Tomlin Order. I have been paying the £50 pm since inception(2012) and not heard a peep from anyone until this week when RobWay, the DCA have been texting me to call them. Is there anything they can do, given I am in rented housing, to vary the Tomlin order? It does say subject to 6 monthly reviews which have never happened. I haven't replied to them and clearly writing to me at my old address won't get a response. I'm living a hassle free life now, rebuilt my credit rating etc but don't want to get a CCJ as I would lose my job!
  3. Hi! I bought a used car last month with 3 months warranty. The other day the head gasket was blown. The dealer said it will cost £320 to sort BUT wants me to put up £100 of the cost. Any advice welcome, why am I expected to pay?
  4. Rich was attacked and had his head stamped on by 2 kids. They threatened him on the bus the day before and he saw them the next day on the bus. He not thinking straight and took the bus ID off one of the kids and whilst doing so got him in a headlock. The Police said this was assault and theft. The kids chased him down and called friends to join in. They stamped on his head and punched and kicked him to the ground. He had grit in his head and he had a seizure. The police has said he needs to write a letter of apology to the kid he took the bus pass off. He was part of the group and was bragging about it on FB and the local paper picked up the story. These kids will have to do community service. A more detailed version is below. I don't feel he should write a letter of apology and I think these kids should have something on their record saying they hunted down a disabled man who couldn't walk and stamped on his head. Monday 26th at 6pm Richard phoned me at work to say he was threaten and is worried and didn't know what to do. He said 2 girls and 2 boys were there and they had kicked his sandwich and put their feet on his seat. There was one behind him and one in front of him. One of them stared at him and said he was going to cut him, "I will kill you" "I'll cut you from here to here" "I'm gonna stab you". They kicked his seat and were threatening. He said he stared back as he was worried they would attack him if he turned away. He said he had just come out of hospital and isn't well. He heard another passenger say leave him alone he isn't well. He said he told them it is on CCTV. But they didn't care. He got off the bus at Stanmer Villas which is a stop earlier than he normally gets off as he didn't want them following him to his 4 year old daughters school. I contacted the Bus company who advised me to contact the Police which I did. They call me back the next day crime reference 47170090324. They advised they would take a look at CCTV. Tuesday 27th. Richard was with me till 1pm at Portland Road Hove. I had to take my son to Water Babies so he left. I got a call from Richards wife to say Richard was missing and something had happened on the bus. I immediately drove to Hollingdean phoning the Police on the way. My girlfriend contacted the Bus company. I arrived at Surestart and heard kids laughing about an ambulance in Roedale Road and "it was kicking off". Then my girlfriend called me to say he had been found in Roedale Road. I drove down and saw Richard in an ambulance he was having a seizure and was unable to control his movements. Due to the Huntingtons Disease, stress exacerbates the condition. Richards movements are usually unstable but under stress he can't control his movements. Please speak to the officers who dealt with him and escorted us to the hospital. They will confirm this. Richard told me he had seen the boys who verbally assaulted him and tried to get off the bus. He saw one had a bus pass and made a grab for it for ID for the Police. He tried to run away and got to the Surestart Centre but accidentally went through a wrong door and ended up outside. He ran away but three of them saw him and chased him. He tried to barricade himself behind a gate in someones garden. But they caught him. He said he remembers being punched and kicked and they were laughing calling other people on their phones. Then he can't remember anything until the hospital. My Mum was attacked in a park as people thought she was drunk ( she had Huntingtons ) my other brother Andrew was attacked in BP Petrol Station, he also went back in after being attacked to get the Taxi drivers ID badge who attacked him so the Police could identify him. I would be logical and think that is a risk and you would get ID from CCTV but Huntingtons affects how you think. Huntingtons is a horrible disease. My brother is worried about picking up his daughter and doesn't want to be scared to walk around. He isn't allowed to drive and buses are the only way he can get around. He doesn't claim any benefits and you can speak with the ladies at the Surestart Centre and his daughters school - he is a nicest person ever. Prob repeating myself but here is more information. Since this the kid said he was attacked by Rich. The Police said Rich took his bus pass and got him in a head lock before running away. This is considered theft and assault. He was part of the group that attacked him on the Monday but wasn't the actual one that threatened him. I tried to explain he was trying to identify them as the Police and bus company weren't interested. The police said he needs to come to the custody centre and be questioned. I went to the custody centre and police station and begged them to speak with the officers when he was attacked as it put him in a seizure and this wouldn't end well. They wouldn't take any notice and so we went to the custody centre. He got so anxious he couldn't stand and it took another two police officers to help hold him still. The senior officer said get a wheelchair he has to come in even though he couldn't walk or sit and was all over the place. It took another 2 people to hold him in the wheelchair and try and wheel him into the police custody. He fell out in the hallway and the Sargent said this is a custody centre he can't do this here (have a seizure) he said get him home or to a hospital. The officer helping called an ambulance.
  5. HELP! I have claimed unfair dismissal following whistleblowing and have a 3 days hearing scheduled in September. Due to funds I didn't take on a solicitor, but I am very scared that I have bitten off more than I can chew and will ruin my case due to inexperience. I have had support previously from CAG but in honesty have never been in a position to make a donation, if anyone can help my I will make a donation of whatever I can afford. So the situation, i was dismissed, 5 days before my 2 years service for a completely unfounded, ridiculous allegation of gross misconduct. I was actually suspended immediately after a grievence hearing which I had raised regarding my bad treatment whilst I was signed off work following and assault in the workplace. I was dismissed in my absence as I was infit to attend the disaplinary meeting and they refused to reschedule it. I had prior to this made a disclosure, first an internal one through the correct internal channels, then to the licensing body because my concerns where dismissed which heightened my concerns and made things 100x worse. I know that they know it was me, and I have this in writing. As to I have emails in which HR and senior management discussed me and plans to dismiss me. I also have notes of meetings about me which were held incorrectly and which were unfair and literally just going through the motions. I appealed my dismissal on the grounds of whistleblowing and this was dismissed, although they waited until 3 days before the 3 months tribunal deadline to inform me of this. I am now in a position where I need to send information as to what remedy I am asking the tribunal to award, this needs to be recieved by 4pm Monday and in honesty I don't know what to write nor how to word it. Any help would be much appreciated!
  6. Well, I'm usually asleep by this time but totally stressed with a situation because of my incompetent husband. I received a NIP for a speeding offence in Oct 15, I am the registered keeper. As I wasn't the driver of the vehicle, I signed the form and dated it and gave it to my husband to fill in the details. At the time we were separated, so I left it at his and told him to deal with it. It's August now and god only knows the truth whats happened but one of his mates was called into court to fill in a statutory declaration because he wasn't driving the vehicle at the time. I've come to know now they're going to probably going to get in touch with me now for an explanation. I will tell them that my husband should have dealt with it, but will I be in trouble for this as I've never done anything wrong or been in trouble before So just to confirm, the original NIP was signed and dated by me but all other details were left to my husband to fill in.

  8. 4 months ago in my Citroen Berlingo multispace petrol 1.6 (2009) the temperature gauge shot to the top and car warned me to stop, I was in slow traffic and had to continue for 10 minutes as on a dual carriageway. In this time the dial would go back to normal and then a couple of minutes later would shoot to the top. I was by a kwik fit so took it there for advice and was told it sounded like the sensor. They rang at work to say cracked radiator and replaced for £300. Yesterday creeping in very slow traffic and temperature gauge shoots up, car overheated, radiator water very low. Took back to kwik fit who now say nothing to do with radiator but need a new head gasket. No oil in radiator water, no **** in oil. Car losing water and overheating. Is this a case of I have just been very unlucky???
  9. I am at my wits end with Hastings Direct. My 20 year old daughter was insured for her car with them. In December 2014 her insurance was up for renewal and I found a better cover with Endsleigh. I tried to contact Hastings on the numerous numbers without success but I was aware that the auto renewal would not take place because I had recently had a replacement debit card. The payment was not made and the first letter arrived saying to contact them with new payment detail. I eventually rang them with my daughter and told them that we did not want the insurance. As it had never been paid you would have thought this would be the end of the matter but she is now being harassed by Hasting Direct for a cancellation fee and some form of insurance period fee. They are demanding a £45 cancellation fee and a further £17.07. This is also supported with threats of referral to debt collection agency and an adverse effect on her credit rating. They have in fact tried to take this from my personal bank account! They failed yet again because they don't have the correct card detail. How do I get this very unprofessional company to desist from the totally unwarranted bullying and harassment of my daughter. The poor girl has been in tears thinking she has done something wrong! HASTING DIRECT.....THE INSURANCE WAS NOT RENEWED. THEREFORE HOW CAN YOU MAKE UNWARRANTED CLAIMS THAT IT WAS CANCELLED. YOU CANNOT CANCEL WHAT HAS NEVER BEEN PAID FOR. I have made a formal complaint to Hastings Direct which has been acknowledged. This morning I get a further letter entitled 'Outstanding Debt' FINAL WARNING. Utterly, utterly dreadful. Deaf and dumb. Do not have anything to do with this company if you value your sanity.

  11. My unenforceable journey is coming to the end! At last I have been to County Court to fight ccjs and high Court to fight HCE Bailiffs and only lost once on an un- regulated loan I have been checking through all of my creditors and dca accounts Most are now statute barred or coming up to being statute barred in the next couple of months Most of the dca do not know my current address. I am considering writing to each one in turn once I consider that it is SB notifying my current address so that they can't sneak in and get a ccj at my old address and informing them that the account is statute barred What does the team think about me doing this? Only me again
  12. Hello I have posted in the forum a few times over my issue with HSBC and as this is still going on I could do with some more help please. I agreed with HSBC that as they owed me more in a PPI claim more than I owed them for an outstanding loan that the PPI would repay the outstanding debt. I signed a form to this effect and returned a long while ago. Since then I have had a few debt collection agents call me to chase this debt and I told them politely about the agreement and the matter went away. However, I have been receiving letters from MKDP chasing the same debt. I told them by phone about the agreement and they have gone back to HSBC who stated that they never received the signed agreement re the PPI and so the debt is still outstanding. HSBC never contacted me again. I really dont want to pay this debt while HSBC owe me PPI monies which may still be accruing interest at 8% pa. I have taken a look at my credit file and the loan is still registered as unpaid but now as owed to MKDP and not HSBC. Can this be transferred between parties on credit files in this way? Should I go ahead and make a claim against HSBC for my PPI? Im really just looking for a steer on this matter please. Thanks
  13. First of all hello, just recently found the forum. Oh, I have been so so silly. I bought a caravan on HP in 2008 over 60 months, last year I sold the caravan and didn't get enough for it to pay off all the loan. I know now that I shouldn't have done this, that I could have let them take it back as I'd paid half the loan. I feel so stupid, but I really didn't know this, and I didn't realise I couldn't sell it on either. I've made such a big mistake. I have never defaulted on the loan payments, I'm still just about managing to pay everything I owe (there are other debts too) but it's tough as I'm a single widowed mum with two kids and I"m a full time student, so just about manage to meet payments by using my student loan etc too. If anyone has any advice how best to manage this and get myself out of this pickle I'd appreciate it. I'm a bit scared now I know I could be prosecuted for selling the caravan with outstanding hp, I have no idea where it is now.
  14. Hey everyone. Total noob here attempting to resolve some of our debts and looking for some advice.. . I've read some great success stories on here and some very valuable advise, which will no doubt help me towards being debt free so thanks for all the info that has been about. To start with I have the below debts I'd love to get rid of one way or another Barclays Overdraft - Wife's £1,500 Halifax Credit Card - Wife's £4,600 Virgin Credit Card - Mine £1,250 Natwest Overdraft - Mine £2,000 Natwest Loan - Mine £7,400 Natwest Credit Card - Mine £1,250 Total £18K I've also written down a budget planner and worked out how much I have left at the end of each month to pay the above creditors and im pretty much broke by the end of the month. .. well actually I am as i'm having to ask family/friends to help me get through the month. So i don't have any disposable income. The only thing is, I have never had a missed payment or defaulted or anything on any of my debts. T he problem is though I don't really have any money left and I can't ask family any more as they have leant me enough to pay off and close other debts so now im just left with these. I'm wondering which direction I can go.. I've been advised to go down the DMP route either via Stepchange/PayPlan or do my own DMP, which I don't mind. .. I'm even tempted to write to Virgin to see if they can write my debts off I just need some guidance on where to start and what I need to be doing... Any help much appreciated Thanks
  15. Hi All, Am trying to get opinions from members on the car issue am currently having. On 14th December 2013, I bought 2003 reg Peugeot 307 1.6L with 101,200 miles on the clock for £1,000 from a car dealer. I saw the car on Autotrader. It fitted what I wanted in terms of look and price. I test drove the car and was satisfied with the drive. I paid with my credit card and took car home. The car came with 3 months warranty for maximum repair worth £200 with Halfords. For me this was only an extra, as I would still have bought the car even if it didn't come with any warranty. On the 28th of December, on a very cold morning I started the car but it didn't start as smoothly as it used to. It then gave me Catalyst converter and anti-pollution fault. When it started it was misfiring, but everything returned to normal when the car was warm enough. I googled the issue and found it was a common issue with Peugeot cars. I had planned fixing the problem myself as soon as I had the time to do so. On 3rd January 2014, another cold morning, I started the car but it won't start. I called AA, and the rep examined the car and concluded that the head gasket was probably the issue and advised I take it back to the trader, as it had warranty on it. I decided not to take it to the trader, but to take it to Halfords who are the authorised auto centre for the dealer. The guys diagnosed the issue and called me to say it was bad news. They confirmed the head gasket was gone, and that it would cost me £900 to repair. They said that it wasn't worth the effort, seeing that I only just bought the car (done 336 miles as at now), and for only £1000, and advised I go back to the car dealer to let them aware. I have now written to the car dealer informing them of the incident, stating that under the Sale of Goods Act and in line with Reverse Burden of Proof, have asked them to either repair or replace the vehicle. The letter was sent today by Special Delivery. I believe the dealer was aware of the problem before the car was sold to me. They told me at the time of purchase that car only arrived as part ex. From my experience, before car traders P/X cars, they thoroughly examine cars to ascertain if any underlying issues exist, and based on that arrive at a figure they are willing to P/X the car for. Anyway, that's by the way. Considering the fact that it is still 3 weeks since car was purchased, I feel I have a case for the trader to repair or replace the car. I am not really interested in a refund unless it is absolutely the last resort. I just want the head gasket replaced. Any advise from members? Adojay
  16. Dear all, My first post here I will try and make this as simple as I can. Car in question is a 12 year old vehicle (rover 75) which are prone to head gasket failure the vehicle had done 99000 miles when we had our first failure in August of last year, the vehicle in otherwise excellent condition and maintained regardless of cost. The vehicle did hit high on the temp gauge and was stopped immediately, the vehicle was recovered by the AA to our local garage The garage: the garage in question is a local out of town garage that we have used for servicing and mot work since moving into the area 3 years ago. We had been happy with the work carried out and the cost but not always with their organisation skills or communication but on the whole a good service The garage, initially said they would look at the car within 48 hours, this didn't happen it took close to four days of me calling them to eventually be told it needed further investigation. I asked them to go ahead and strip the head to see what damage was done it then took a further two days to hear the result( I called them) the head was sent to be checked and skimmed and returned I asked that parts such as cambelt, water pump, thermostat etc were replaced at the same time Three to Four days later I was able to pick the car up after paying the almost agreed rice of £1924 (actually £60 higher than expected) The car ran fine up until just before Christmas when it get hot again, it cooled I checked water levels, all seemed OK the following Monday I took it into the garage for them to check (along with an MOT) I was told a small pipe from the radiator had perished and would need replacing (replaced) and I had a pin sized hole in my radiator but it was not urgent and I should keep an eye on the coolant levels.As this was on top of Christmas, and £364 MOT bill i was happy to hear the radiator was not urgent, 4 days later steam high temp gauge and a recovery back to the garage It took almost a week of constant calling before they could tell me they had looked at the vehicle but would need further investigation, I received several rather "scripted" reply's about how I had been told about my radiator and checking my levels, which I found rather suspect. I then started to visit the garage after work in search of the manager, but he always seemed to be out. I eventually caught up with him on a Saturday morning, where he told me it was indeed head gasket failure again but his work or parts were not at fault. He claims the vehicle would not have traveled 6000 miles if there was a problem with his work or parts. I am lucky enough to know a mechanic who works for a main dealer and has 20 years experience who has told me the reasons why it cannot be the fault of the radiator and that water under pressure was merely looking for a weak spot, how there was a possible issue with the block itself or any number of faulty parts, or dodgy work may have caused this. Still the garage owner is adamant that he is not at fault and I have left my vehicle in his yard for close to 6 weeks with no contact from him, after he agreed to find out the price for a recon engine. The garage contacted me this Saturday and asked what I was doing with the car, and I simply reminded them I was waiting on a price for another engine I know this is a lot of information but I needed to tell the full story, Something isn't right here and maybe i'm wrongly suspicious. Communication with the garage is difficult because they do not return calls or give vague answers and I feel i've gone as far as I can speaking direct to the garage. It is part of the autocare group, I have been in contact with a body they are affiliated with but they don't answer the phone! Any suggestions please

  18. I have tried emailing the boss but been completely ignored. Need advice on what way to proceed (this is my story copied from facebook but it's pretty much what has happened) since september I started getting calls from a 0845 number (I ignored at first) 1 night I happened to log on to my t-mobile account and noticed I had upgrade options. I clicked the no sim only as it was unlimited everything (no 4G) unsurprisingly a couple of days later the order refused to go through. Meanwhile, the 0845 calls on my phone increased (sometimes to 2/3 calls a day) eventually last thursday gave in and answered. She was very convincing on the phone promised me FREE cinema tickets and FREE EE films (I thought sounded too good to be true but OK) Imagine my surprise when I noticed I had a bill on saturday (and I hadn't even received the sim card yet) immediately phoned customer services and had a hassle with their call staff (couldn't understand them) but eventually billing was sorted to keep me happy. I done some digging though and I noticed that the promised FREE cinema tickets and the promised FREE EE films are not free at all (35P per ticket and per charge to rent a movie which I wasn't told about) immediately I emailed the CEO and still awaiting a response as I refuse to contact customer services again (oh and I was also promised my contract length would be cut) Guess what? Nothing has changed either. Forced to go on to 4G hounded to go on to 4G with false promises and still no sign of any contact to discuss this (and I did email the tmobile page and EE page on here as requested and still no response either)

  21. Hi everyone, I'm new to this forum but I'm desperate for some advice from anyone out there who can help me. Here goes !!! My daughter passed her test last June and in the first month got 3 pts for speeding SP50. I am getting a motability car on Friday and my daughter wants to have my current car Mazda 6 that is on finance and has 18 months left on it. The finance company won't let me change her on the V5 though say it's ok for her to drive if she's insured. Her insurance on her megane is due mid June but they have quoted her with the change of car £6500 yes that's right you did have to look twice £6.5k. Is there any cheaper option for her to drive my car for next 18 months, also how do I stand with cancelling my car insurance, does that tally ok with DVLA if I don't insure it myself. Please advise as I'm so confused Thanks Mum with a head ache lol

My VW golf 1.4 fsi went to the garage after the timing belt tensioner broke. we paid £1300 for a rebuild (head machined etc). 1 week later we had to pay £75 for 1 ignition coil. a couple of days after that another £75 for coild number 2. 4 litres of oil bought and used over 3 months, and the garage said nothing was wrong. 4 months after the original repair and the car broke down. Becuase the garage did the rebuild, i had the car recovered to the same garage. (although i did not want to). the problem was the timing was out and basically the same problem again. It was not the tensioner this time, and they investigated. They found one of the pistons has shattered and bits were in the oil sump, they sent the head to wherever they had it machined, and the result was, "you need a new engine". the company who machined the head, who say they dont accept liability, have asked for a quote for a replacemnt engine and fitting. (seems odd if its not their fault). I have made all the phone calls, the garage have NEVER rung me, I have found an engine and the garage have sent a letter to the company. Now the garage tell me they will make a decision, but it will take 7-14 days, ( i think its the insurance) but by then the engine will have gone, fsi are quite hard to get hold of. I just want my car back, or the trade in value, so i can get another. So the question is( sorry it took so long) how do i get this resolved asap.?
