  1. Hi, I had an agreement with MBNA where they would hold all interest, as long as I paid the debt off within 10 years. The amount owing was divided up in 120 months (10 years). However, in the mean time, they have decided to sell the debt, at the same time as our financial situation has changed. The monthly payments are now less. They write to inform me that I am in arrears. The DCA have said the following, is this right does anyone know?? The payment was set by MBNA, based upon, I assume a previous Income and Expenditure form at the point of being 'charged off' which means no further interest is applied to your account but it does mean that this is your 'normal monthly payment'. This can not be amended now as it was sold on this way. It is also less than the 5% normally applied to credit card accounts. And so, we are happy to accept your offer of payment but as it is does not meet your contractual payment the arrears will continue to accrue. We have a legal obligation to reflect accurate data to the Credit Reference Agencies, which also includes arrangements, missed payments and arrears and so your data entry at the credit reference agency will be updated with this information.
  2. Hi all. I originally had a debt with HFC bank on a credit card to the tune of £9838. My monthly payments were 172 and suddenly, Weightmans wrote to me threatening me with a CCJ if I did not consent to a voluntary legal charge. They refused to accept my £172. To cut a long story short, I did agree to the charge because at the time, I was under severe emotional stress - my Dad was dying from a terminal cancer, which Weightmans knew! I have just received a letter saying that I can get a 50% reduction on the debt! But: I cannot afford this right now even though there is a charge on my home. What I have noticed is that Weightman's client is now Phoenix Recoveries UK LImited S.a.r.l. Can I CCA Phoenix, or is it best to CCA Weightmans. The card was staken out in 1998. Also, if I DO CCA them, will they get frisky and threaten me with getting me to sell the house. I do have aletter from them saying it was not their intention to do this which is why I agreed to the charge - stupid, I know. Any advice greatly appreciated xxx

Hi to you all who have taken out loans with this company me also being one I feel we are all same unite here cos we are all similar cases loans done by the company mine has been too trauma to put on here its cost me dearly in my nerves etc I just want to say thank you for saying on here to each and everyone of you I know we all have experienced same things to do with this company, please hang on cos I believe there is now light at the end of the tunnel. BLESS YOU all and try relax , sometimes it just takes one more to move the mountain . I had to remember nothing is impossible is it, release is coming we have to remember its just a loan and yours and my views count , whither its 1 person 2 people 50 people 1,000 plus people with same view multiplication is coming or is not needed because sooner or later it just takes the right place, action, things, people to change things.
  4. I have read the stickys and I see that a lot has changed since last time I did this. ParkingEye have recorded me overstaying in a shopping estate car park and have issued me with an £85 fine (reduced in paid quickly). I am wondering if anyone has had success by providing evidence that they were genuinely in the shop for the time period shown, busily purchasing away! Essentially I was in costa and can show from my bank statements that I bought a lot of coffees whilst I was there working (oblivious as I was to the time restriction). Is this worth appealing about? My thinking is that the shop did not suffer a loss as a result of my breaching their contract? Or is that naive thinking.   5. Evening all, I ordered some equipment from Fitness Superstore, checked both items were in stock (it showed as such on the website but I checked anyway)and there is an email trail showing this. As I was having them install it I had to submit a form which I did and they acknowledged receipt. I had to hasten info on a delivery date but once they had been reminded of my order this was set for next Monday (11th Feb). Yesterday they informed me that the Monday delivery is only for one item and the other will be restocked 'sometime in March but they don't know when'. It could potentially be 7 weeks before it's available again and then there's the wait for installation. A kerbside delivery isn't an option for us with equipment of this size and weight. After some discussion I have today cancelled the whole order. I did use a credit card but I transferred the money to it on the day of the order so I am out of pocket over £3000. I want the refund sooner rather than later. The way this went I've lost all confidence in this company as they don't give a damn and I want my money back so I can go elsewhere. I can email an LBA first thing on Monday and I'd like to give close of business on Friday as a deadline - all they have to do is press buttons to refund my credit card and I know it can be done. Must I give them any longer? I see two weeks quoted on here quite often.
  6. Hello, I am looking for help and advice relating to this on-going dispute I have with the Nasty-west. (Edit) Long story so give you the short version. Reclaimed back bank charges before they put a legal stop to it. Tried to reclaim Advantage gold service charges -they denied it Reclaimed ppi on one loan.. They have never reviewed or addressed the three previous loans with ppi on them. I refused to repay the loan until the resolved the ppi- they didnt. Instead they told me to court and won over a technically and obtained a charging order on my house. I have contacted the ppi deparment on 2 occasions for redress to the previous loans with ppi. They don't even answer me. The CCJ they obtained for the loan is an accumulation of the loan, bank account, mis-sold ppi and mis-sold advantage gold service. So as far as I am concerned they are take money from me via shoesmiths that they actually sold fromme. Any help or advice greatly appreciated
  7. Good afternoon CAG, I have been working at my local nursery for 3 years. I started off as an apprentice and then qualified at level 3. Upon qualifying, I have worked for more than a year on their payroll, I am not and have never worked for an agency - I work with them directly. But the persistant problem is, they have never offered me a contract. It is also unfair that newly qualified practitioners got their contracts last month, and I have yet to see mine. Now they keep cutting my hours (cut more this morning) and they have held interviews for my position. I have no disciplinary records, I do my job correctly and I also finish any written work at home. What are my rights? Can they just dismiss me? Thanks

Hi all, i am now working in the nhs as part of the theatre department and in doing so signed the usual contract agreeing to working on calls, late shifts and weekends etc, the problem is that some staff are not taking part in this arrangement because of various reasons ( my cats scared of the dark or little johnny wets the bed) sanctioned by the managers and therefore the remaining staff are having to work extra shifts to compensate. My question is, are we all being treated equally and do we have any basis for taking action against the management. Any help would be great. Cheers.
  9. Hey CAG, Posting on behalf of a friend. In short she doesn't have a tv licence as doesn't watch live tv only netflix. However her young daughter downloaded BBC iplayer on her tablet and signed up and gave her mums post code etc and obviously must of said she had a TV licence. Fast forward a few weeks and my friend gets an email that says "Our records show you've used BBC iplayer on a number of occasions in recent weeks. As your no licence need status is now invalid you need to buy a TV licence" and gives her a link to buy. Does she need to buy one, her daughter being on early teens did not know her mum needed a TV licence. Anything she can do?
  10. I'm trying to find out if a business mobile contract is different for a Sole Trader (up to 10 employees) versus a limited company? I thought I'd read somewhere that a sole trader has similar rights to a consumer? Basically, it seems, companies have no automatic rights - it's assumed they have access to lawyers, I guess. I have been told because I have a business contract that consumer rights don't apply. Also that 36 month contracts are not banned for business customers? (Ofcom rules 24 month max).....and that a 14 day 'cooling off' period doesn't have to be offered to businesses??

Hello all To cut a long story short had some financial issues and was taken to court by moneybarn for a return of goods order which they achieved, just received the court order in the post after a week or so but i need to know where i go from here. I have attached a copy of the order if someone could explain to me what my next steps are and im also very concerned about the £493.00 in 14 days as i do not have that kind of money many thanks steve

  13. Hi I am on ESA and PIP. My savings have just gone over the £6000 threshold in the last couple of months. Is it best to phone DWP or should I write to them please? This is causing me great anxiety as I feel like I have done something wrong. I am very thrifty so hardly spend any money preferring to save it as it makes me feel safe to know it is in the bank. I am a very insecure person with lots of struggles with mental health searching for some sort of security. Please advise-thank you.

  16. Hi Guys I have received a letter of claim from Restons solicitors for a debt bought by Cabot financial. I have made a complaint to the financial ombudsman that the original creditor ‘ a credit card company ‘ refused to deal with several mistakes on my account over a year before Cabot bought the debt and simply told me to deal with the 3rd party debt collectors. The ombudsman said that as they were still the legal owners of the debt they had a duty to deal with me and not pass the buck to the debt collectors. The amount Cabot are claiming is for £1800 when the correct amount after deducting the disputed amount is £1150. My question now is, should I contact Restons who have sent me a letter of claim and say they will start proceedings on 18 05.2018 or Cabot or both and tell them its a disputed amount sold by the original owner of the debt and I have now made complaint to the FOS for which I have received relevant paperwork and a reference number. So would they like to put proceedings on hold whilst this matter is dealt with by the FOS as I see no point in starting court proceedings when they are trying to claim the wrong amount.I I don't dispute the lower figure. So far I have made no contact with either company.

Example Many years ago i worked on Blackpool Promenade A interesting place to work,could be 5am or ten pm all times of the day. Observing the goings on and meeting many interesting people.Such as the Snakeman,entertainers all sorts of people from many places. One of them was a multi millionaire. We became pretty friendly and i began working for him renovating and modernising a huge shop. I observed how he worked,he had the Midas touch everything he touched seemed to turn to gold. Well as you can imagine i thought to myself i want a piece of that,only natural. I was trusted after a while and the relationship became a little like Del and Rodney,Fools and Horses you can guess who was Rodney. I was standing next to him one day observing his empire on the prom and i said. Del how come everything you do turns to gold. well Rodney it is like this he replied. I have maybe ten ideas which i invest a thousand or two into. 8 might fail but the if the other two work it is happy jubbly. And some of his ideas swept the country. Right i said to myself,Rodney it is your turn now.The Mercedes will soon be here. So spent 20 quid on some necklaces,plastic miniature dolphins and some long grain rice. And the Finest architects pen i could find.and a huge magnifying glass. Stall was set up.Ladies and Gentlemen gather round which they did. I mean you can hardly fail on the prom. Your name on a Piece of rice put in this miniature Dolphin,filled with water which magnifies it,hung on a chain and around your neck it goes. So it just did not pay and i am at the moment on my 990th idea waiting for the beam of light to land on me and say Rodney you have succeeded.   18. I hope I'm posting this in right place. I hope some one can give me some advice. I work in a small hotel. I'm the Head Chef. We have 2 other chefs working in the kitchen. One of the chefs is known to be very lazy. Likes to take time off saying he is ill when isn't, spends more time playing on phone than working etc. Earlyer this week on the Tuesday I was working with him and he started going on about how he had just got a new xbox and the new call of duty game that had just come out. He started moaning that his friends were already much higher level than him and that he need to catch up. He had his days off Wednesday and Thursday and Friday morning we hear from him and he has apparently been to doctors and been signed off works for 2 weeks due to stress. He is not stressed, he is only 25, is not married and has no children. He has only just come back off holiday a week ago. I'm sure he has lied to Dr to get time off to play his new video game. He has been playing his new call of duty game for nearly 80 hours straight. And is still online playing at 3am. Would some one who is under that much stress that they can't work be able to play videos games non stop. I am really angry, I have young children and my youngest son is very poorly. He has hospital appointments next week and weeks after. I had booked days off for both weeks, over a month ago. So I could look after my other children whilst my wife takes our youngest to hospital. These hospital appointments are very important. And include Nurosurgery appointments and appointments at eye hospital. We have no family to ask for help, and no friends so my wife relies on me to help. A lot of the hospital appointments are over 3 hours away at specialist hospitals, and a lot they require that my youngest son is bought alone, so it's not possible for my wife to take are other children with her. We are going to have to cancel all appointments as I have now got to cover for this other chef and will have no days off next week or the week after. Its so wrong that he gets to sit at home playing stupid video games and still gets paid whilst I'm left having to pick up the pieces covering for him working my self in to the ground and it will effect my children as they will not see me, and expecially my youngest as he won't get to his hospital appointments. I also feel sorry for my boss as she is a old lady in her 80s and I feel he is taking advantage of her, he lies to her and she believes him. I don't like to see him walking all over her, he laughs at her behind her back. She ended up in a simular situation with a different employee many years ago and she did sack them but then end up being sued for apparent unfair dismissal. Although that situation sorted its self out she is afraid to do any thing or sack any one else. Is there any thing I can do about this chef, how can I get my boss to see what he really is like. I have physical evidence to back up my claims that he wanted time off to play call of duty. Is it worth me mentioning to my boss. Surely as Head chef I should have a say in who works in kitchen. I don't want some one lazy, I want some one hard working who I can trust and who is reliable. If my boss will listen what should be her first step to dealing with this so she doesn't end up in same situation as last time. Any advice would be much appreciated If you wondering why I'm awake posting this at 3.50am is because a neighbours parrot escaped and is sitting in a tree out side my window sqauking like crazy so cant sleep.   19. This happened on June 19th, I was caught abusing a loophole in the self checkout where I scanned cheaper items to put in heavier, more expensive items down. I had being doing this for a while quite often, but didn't take anything of high value, just food on my lunch breaks. When I was caught, they said they were on to me for the past couple months. I had visited the Tesco only 2 to 3 times a week and at odd times during lunch (could be from 12pm to 2pm) and not everytime I did this, sometimes paying for a bag of crisps, etc. The thing is, the security guard didn't even pull me into their office, he took me to the side and gotten my personal details and didn't even bother calling the police because what I took that day was such a low value. Told me I would receive a letter telling me what action they will take in 2 weeks or so. Just got down my details from my drivers license, paid for what I had taken on that occasion, didn't take a photo of me and said I'm banned from the store. Did not mention civil recovery action. He said it's likely the head office will review the CCTV footage of previous times I went in and will probably take it to the police. I immediately wrote a letter to the store manager and head office, showing deep remorse and apologised, in which the customer service manager replied with a letter thanking me, but not saying what actions the head office will take due to data privacy laws. Not heard anything from the store itself. I was expecting this to trigger a DWF letter to pressure fines on me, but it has almost been 3 months and haven't heard anything else, other than that one letter so it's making me so anxious and worried. If it's taking so long, is it likely the are building a case and the police are getting involved? Or were they pressuring me into not going in again and have just left it at that? Or should I expect a late DWF letter and nothing else? Does it take multiple months to see one of these letters? People have said they're letting me sweat it: it's too much time to sit through hours of CCTV to see what I had took of relatively low value and it would not be cost effective to involve the police, but still a possibility, or it could have even been forgotten about. I have been told it might be sitting in a pile with others, but a lot of people on this forum seem to have received DWF / RLP letters relatively quick. Someone else had even told me there won't be any complicated background police investigation and my punishment would be very minor if I was to receive one, but I am still unsure and very very worried about it still, I stress about it often. I had also been told waiting this long could have potentially harmed any chances of a case, since it would have been proceeded with sooner after the incident? Would they still hold onto CCTV from April to June?
  20. Hi I received a PCN from a Free! carpark some time ago.. 4 hours free then pay. I received no letters from UKCPM about a fine nor do i know what it was for . . I then get a letter from Gladstones saying Pay £160 else court action. I 'forgot about it'. Next i get a court letter which turned up at my address late , saying £273 to pay with response within 14 days else action will be taken. Ok this one i genuinely did forget about, i emailed them stating the letter was late and i forgot to take action due to work commitments and stress. Next thing i know i have a CCJ on my credit file and a letter from the courts saying they made a judgement. Luckily i had 30 days to pay the £273 and they will lift the CCJ so without haste i paid and the CCJ is now gone. two days ago i receive yet Another! Gladstone solicitors letter on behalf of UKCPM. new reference number so a new claim, this one as before £160 before court action. and again , no letters from UKCPM beforehand. Now, i know this will go to CCJ if i ignore it, but what can I do? the carpark is free for 4 hours ! i used it almost every day for the Gym. the carpark is poorly marked, paint very worn on disabled bays, no phone number to call to extend your stay. you have to display a ticket but half the time the machine was out of order however i still am aware of PCN's being issued for non ticket when the machine is not operational. I have had a problem with the Norfolk and Norwich hospital, in brief I had pains in my chest and couldn't breathe and pain in my left arm and went to the A&E on Tuesday the 8th may in the evening I was left for 6 hours and was told nothing was wrong to go home and take paracetamol, myself and my wife argued that I was in pain and couldn't breathe, I had a chest X-ray and a blood test and was still told nothing wrong so I went home, I had the same pain on Wednesday 9th and Thursday 10th but didn't bother going back to A&E, on Friday 11th in the morning I was at work and had worse pain in my chest and couldn't breathe, and arm was numb, we didn't want to go back to the A&E I went to the walk in centre at Rouen Rd, Norwich, they did an ecg and blood tests and told me something was wrong and wrote a letter with the results of the ecg to take to the A&E at Norfolk and Norwich hospital urgently, I went to A&E again and gave the letter in at reception I was seen straight away and after another ecg and more blood tests was still told nothing was wrong, again my wife argued and asked had they seen the letter from the walk in centre the junior Dr said he had not, when he looked at the letter and my ecg Results from the Walk in Centre his attitude was completely different he thanked us for arguing our case and telling him about the letter and I was rushed straight on the ward and operated on the next day, I had had a heart attack my arteries were blocked and severely damaged the main artery at the front of my heart, I had to have two balloon stents put in my chest my left arm is still numb and giving me lots of pain, my wife had to argue and fight to get me seen, I am obviously very angry about this. I had previous heart problems and told them in A&E on Tuesday the 8th May that in 2013 I had a heart attack and had to go in hospital and have two jump starts to get my heart back in rhythm, I was put on statins Avorvastatin, and blood pressure tablets (Perindopril, Bisoprolol, Amlopodine , for life, and have to be seen every three months no one took any notice, I said to the doctor that I am self employed I don't need a sick note or a claim I just want to feel better, He said sarcastically there's nothing wrong I know it's not what you want to hear but go home and take paracetamol
  22. hello all, i have a valid gas safety certificate until November the 3rd 2018. my landlord(local council) uses a heating company for the gas safety check,... they are being very overzealous and have been calling to do an 'ANNUAL' gas safety inspection since the beginning of August...this seems very strange as its 3 months early and they know it expires in November.?? I have came home and received calling cards when I have been out and on one occasion a calling card was left when i was on holiday...as it was August. today i received a letter from the council saying they are taking me to court to apply for a 'warrant to authorise entry'? I would like to know if i can attend the court hearing (to show the certificate) and also can they do this with a valid gas safety certificate in force? thanks, Sonia.
  23. Me again, So out of the blue SLL Capital have put a default on my credit file for a Mr Lender Loan from 2016 that i never repaid. Can they do that? The Mr Lender loan isn't on my credit file before this I will of course do a irresponsible lending complaint to Mr Lender, is it worth sending a prove it that i owe this debt to SLL Capital?
  24. I've copied the post I made in another website forum based on the information they gave on their site and the advice given on the forum as well. Up to this point I have only sent in my application to set aside the judgment, I also added at the end to stay the writ and complain about the bailiffs to requesting an investigation into their charges as well. I've no idea if I've done any of it correctly. I was out of time I think and had to have it in the post Friday or so I was lead to believe. I proved my insurance company claim was put in to deal with the case and they did not act within the time scale and gave me no Information or guidance on what to do whilst I was waiting for them to appoint a solicitor which is meant to be part of my insurance cover to get free legal advice regardless of if they are acting for me . Proof the ccj was entered before they even gave it to a solicitor and proof the bailiff arrived before the solicitors had even looked at the case. Proof I made a formal complaint once the ccj had been entered into that they had not dealt with it in a timely manner and not advised me what I need to do while waiting for them. Also Included all the proofs I didn't owe the money and that they owed me and why and how much. A copy of the bailiff paperwork showing the charges and everything. I think that was it. read the post I made on the other site below and tell me please did I do any of it wrong do I need to be filling in and submitting anything else. Do I have a case to request a charge back because they threatened to take my pets if I didn't and never gave me notice they were coming and charged me over the allowed fees. Are they really as bad as everywhere says and will I have to take everyone to small claims court to get my money back . Thanks Don't actually owe the debt. The creditor owes me money. I had legal insurance that was meant to cover this but they messed me about for so long a ccj was issued and the enforcement officer came before they had even said if they would take the case on and now have decided they won't. It was over the sale of a dog. The buyer just didn't want it after five months so sent it back and I said I'd try to sell it for them and get what I could and they said they would pay for me doing it for them he was with me six months and only sold for £1000 which they agreed to the sale price. got my friend an accountant to work out the costs properly for me and it worked out they owed me nearly £500 on top of the 1000 sale price. I said no. Can't send that cut it down to cost so they did which made it something like 250 they owed me still I sent that to the owner and said look my accounts work out what it cost me but have a look and give me a call and we'll have a chat about it and sort something out to suit us both. She never did her mother sent me a load of abusive messages and applied for a ccj straight away. I've got all the defence and have been doing all the paperwork and forms and proofs to apply to set aside the judgement doing it totally off Google help so far but now seriously worried after reading all about dcbl when they came I had not got notice that they had the writ and planed to come. They just arrived at my house stood at my gate and I wet myself thinking it was a police. All dressed in black what looked like a vest and body cam and all sorts. Then he told me who he was and what he was there for. Told him I knew nothing about it and weren't they meant to notify me first if they had got a writ and he said yes we sent a letter and I told him no I never got one or I would have dealt with it then . I asked if I could ring my solicitor who was a waste of time because she could not advise me because she had not decided if she could take the case based on my insurance cover yet. He then told me if I did not pay him there and then that they had a dog van on the way to take my dogs my pets to sell to pay the debt. Also it would then go up by about another 750 on top of the 2200 something. I logged In to my online banking to see what I had and I didnt have enough in my bank I even showed him. I asked if he could come back in a couple of hours and I could get the cash and he said no if he leaves he is leaving with the dogs to pay the debt. went back in the house and searched and managed to find some cash I forgot I'd hidden for emergency. paid in full and he went away happy. I've now found out from my searches learning how to set aside the judgment he over charged fees. Did not send me notice. Then threatened to take my pets which he's not allowed to do either dressed like police and never offered to make any arrangement to pay or to take other items he was only Interested in the dogs my Pomeranians. I actually joked and said I've got a puppy dog you you can have she's a little turd and rubbish guard dog and he said no only the little ones which I found odd he targeted them. He must have researched me first as all over my social media is my dogs and just my dogs. My dogs are my pets not a business I only breed to get more pups for me for breeding and showing and pet home any I don't keep. I'm going to ring my bank for a charge back in the morning but I've been on the forum and seen about all the Complaints about this lot and wondered if there was anyway my complaint and details could help. And also wondered if I should be apply to stay the writ as well or anything else as well and do they all just go to the county court or do I have to do two lots and send the set aside to county and the writ to high court.   25. Hi all, My partner and I moved into a private let on 31st August. It is a 2 bedroom lower cottage flat that was advertised as having a shower and double glazing, but had extensive pictures of each room within the house At our viewing, the gentleman from the estate agent told us the flat came with white goods, a garage that is in the driveway and garden shed. We took the property based on having the above promised amenities. When we met the estate agent to collect the keys, the guy only had 2 keys for the the house and that he wasn’t aware of keys for the garage. He told us to contact the office and they would sort it out for us. After the man had left, I noticed the disgusting condition of the washing machine. The seal was caked in mould. I cleaned it with antibacterial cleaner, used washing machine cleaner and have put it on empty washes of 90 degrees, but the mould spores will not go away. I suspect the door has been closed for months which has led to this. We contacted the estate agent to see if they could replace the seal or possibly fix the machine. We were told that the flat didn’t come with white goods, and that the machine was a “gift”. The inventory lists the cooker and fridge freezer, but not the washing machine. It does, however, include 6 pictures of the washing machine alone. I am annoyed as we were promised white goods, then told it doesn’t come with white goods, but lists all the other white goods in the inventory! We have tried to resolve the issue for nearly 3 weeks and have been told the best they can do is uplift the machine. We have also since been told that the garage doesn’t come with the property, but that the landlord is happy for us to use it. If we want to replace the locks, we will have to pay for it out of our own pocket. We have been trying to resolve this and have phoned them every day this week, only for them to promise to call us back and they never do. They are now treating it as a formal complaint that they will investigate within 15 working days. Are we right in saying we have been deceived in taking this property? The lady who told me the washing machine was a “gift” has admitted she she should have communicated this to us before we moved in.
