  1. Hi Guys, I hope all is well. I have been trying to regsiter for a gas supplier. I have called around all the big suppliers and was told that they didn't supply my property as there was no meter point reference number. Having done some research online I discovered I could all XOSERVE to find out my MPRN so I could regsiter for a gas supplier. XOSERVE have said that due to an admin error from the previous supplier to my flat that I was not registered on their system and to contact any of the energy suppliers and sign up with them which didn't help at all. I have gone back to all the big energy suppliers explaining the circumstances and non of them seem to understand and they have all said again they can't supply my propery because I dont have a MPRN!!! I would be very grateful if anybody who has dealt with this situation before could give me some advice on how I get a MPRN in order to sign up with an energy supplier? Recently, DWP paid me 7,000.00 backdated payments for sickness / ESA claims as a result of numerous complaints made about 3 work capability assessments, each of which having a medical report made by a nurse which omitted information. 2 of the work capability assessments were recorded. The oral recordings of the assessment differed from the medical notes made by the nurse, this has been shown on 2 occasions when comparing the oral recording with that of the medical report. Pointing this out to DWP - I was ignored for several years, complaints being answered but nothing being done in respect of the complaints. To have a 7 thousand pound payment years after may seem great - reality is that it is all used to pay debts to family who supported me during the time DWP refused to. My data request is for a copy of a report made by a Dr. [redacted] who conducted both investigations into my last 2 work capability assessments. This doctor could not find anything wrong with either of my work capability assessments between that of the actual recording and that of the written medical report. Whereas, other medical professionals have noted several elements whereby the assessments are unfit for purpose. DWP refused to give me this data surrounding the doctor's investigation previously despite my many reminders. Again, in my latest assessment, DWP are refusing to give me this data. The data request was late (it needed reminding). Not only was it late, it did not contain any of the information I had asked for. I had asked for specific information surrounding the 2 investigations made by Dr. [redacted], this should have been 10 pages at the very most. What resulted was at least 3,000 pages (some duplicates) of the entirety of my comlpaints with DWP... In addition to someone elses name and national insurance number (totally unrelated to me) in amongst the data. I wish for specific data surrounding the doctor's investigation. I have an N1 court claim form - are there any templates I can use to make a claim under GDPR forcing DWP to comply with my request? --- The request is for data to aid in other complaints and essentially show that the assessment is unfit for purpose and even when complaining about it, a Doctor answers complaint saying everything is fine - when it is not.

  4. Hello, I was completing a credit check after being refused to get a specific type of finance and to my horror I found out I had been issued a CCJ on the 2/10/18. After ringing Northampton they informed me that the CCJ was issued over a parking ticket issued on the 30/01/17 by JD parking. correspondence to do with this had been sent to a previous address, and even when I was living at this address at the time of the alleged incident I never received any letters about receiving a parking ticket. Now the location that this occurred was at my friends flat where he has a parking permit that was in my car at the time. I have received the evidence from JD parking's solicitors and there are a few reasons why I think their evidence is not credible, firstly the photo of the windscreen is not a full photo and has clearly been taken to omit the parking permit from the photo, the timestamps on the photos have also clearly been manipulated and added after they were taken - the timestamps state it is 22:45 yet in the photo you can tell it is the middle of the day, not that the time makes a difference to being allow to park there it just shows they are not credible. (if anyone wishes to see the photos I am more than happy to share them). I am on the electoral role and I pay council tax and many other utility bills so I feel like they have not even tried to find me in my absence of a reply and just let it all happen. I know I need to fill out a N244 form but I need help to make sure I complete all the sections correctly and that I have a strong chance of being awarded with it being set aside My hopes is that I can get the money for the N244 for back from either JD parking or their solicitor and also having their claim thrown out for being absolutely false. After reading the guide on this site I should also contact JD parking and ask for their consent to set aside? this seems bizarre because they are surely going to say no? I am looking to be applying for a mortgage in the next few years and fear that this will seriously affect my chances of being successful, so thank you for all and any help. This is a template letter I am going to email to JD Parking to get their consent to set aside the default judgement. "Dear JD Parking, Reference: Claim xxxxxxxxx JD Parking v xxxxxxxx Your Reference: parking ticket ref from POC I have recently become aware of a County Court Judgment in Default obtained by yourselves/your client on 2nd October 2018 for an alleged private parking charge from 30/01/2014 for Vehicle Registration xxxx xxx. I am writing to request JD Parking/your client consent to set-aside the Judgement. I am currently drafting my formal application to the court to request the judgement be set-aside pursuant to CPR 13.3 for the following reasons; 1) According to your Particulars of Claim in the case the alleged incident took place on 30/01/2017. At this time, DVLA records would show that the vehicle xxxx xxx, was registered at my current address, with myself as the registered keeper. 2) I have never received any communication from JD Parking and was entirely unaware of any Private Parking Charge being made against my vehicle until finding the CCJ registered against me when checking my credit file, and obtaining copies of the original claim and judgement document from the court. 3) After reviewing the evidence received from your solicitor it is clear that I should not have been issued with a private parking charge, I had a permit to park where I did but that was blatantly omitted from the photo taken of my car parked in the bay. The time stamps have also been manipulated and added on after the photos were taken, there is no seconds displayed and the time stamps state it to be 22:45 which is clearly wrong as it is broad day light outside, this proves your evidence is not credible enough to have served me with this private parking charge. According to publicly available information my circumstances are far from being unique. The industry’s persistent failure to use correct and current addresses results is an unnecessary burden for individuals and the justice system across the country. This is a topical issue: I note that the Justice Minister The Rt Hon Sir Oliver Heald QC MP announced on the 23rd December 2016 a consultation and information campaign to help protect consumers from debt claims. The consultation will look at ways to; better protect consumers who are sent mail to inaccurate addresses and verify addresses again before a claim is sent. The Minister added that In the digital age, we must ensure companies pursuing unpaid debts make every reasonable effort to contact individuals, rather than simply relying on a letter to an old address. I therefore request you/your client consents to set-aside the judgement and provides me with all documentation / information relating to the original parking charge so that I may consider my position. Had I received the original charge it is likely it would have been settled immediately. You will be aware that this application without consent will cost a £255 court fee. As it is your/your clients failure to take reasonable care that any letters and the subsequent court claim were issued to the correct address I will be asking the court to order you/your client pay the costs of the application along with any further costs allowed by the court. I look forward to hearing from you/your client within 7 days after which time I shall be submitting my application to the courts. Yours sincerely xxxxxxxxxxxxx"
  5. Hello everyone, this is the first time I have ever used a forum, but I hope that someone can advise me. I am a 19 year old photographer and I was commissioned to take the graduation photos of a Malaysian girl and her family. She was graduating from UCL and the job was from 9am to 1.30pm. The fee had been agreed in advance. I have been trying to get payment ever since then. My problem is that she graduated in Law and I do not know where to begin. It also turns out that she is from an extremely wealthy Malaysian family and has appeared in the hit film, Crazy Rich Asians. She is no longer replying to emails or texts. Is there anything I can do to get my payment? Thank you to anyone who replies.

  7. Hi I recently came in to possession of a photography light, through my works. It was broken so they let me have it. I assumed the repairers my company uses was overly priced without really knowing or trying them first. The problem occurred when I called upon another photographic retailer who also offers repairs. Again assuming it would be cheaper than where I work. Broken photography equipment is something I am familiar with and although my store does not actually fix anything we send it off to our sister company that completes our repairs and is quite well regarded in the industry. Part of our process involves us informing customers there is a charge for the estimate prior to the actual repair. This camera shop I took my light to, neglected to tell me there would be any estimate costs. Optimistically expecting a saving I was shocked to discover the repair was not only pricey but in addition almost 4 times as expensive to have my light inspected to get an estimate. As nothing was mentioned about the estimate cost initially and I have no paper contract. What would you say my consumer rights are?
  8. Good afternoon, I would like some advice on what to do once a speeding ticket has been paid but then a driver may have evidence that could get the ticket quashed. I have found out recently that our group fleet office has been submitting driver details for speeding tickets, bypassing my company process, and for which subsequently the drivers have been receiving the notices and paying the fines. Some of the tickets I have found out were for the stated offence of 'exceeding the speed limit for a goods vehicle' and for which the drivers have already paid the fines but I know we could have contested these as the vehicles are not goods vehicles, although the drivers apparently did not know any better and paid up. We have the vehicle V5s and photographic evidence of the vehicle interiors clearly showing the vehicles not to be goods vehicles, to whom could we approach to have the fines and points quashed, would it start with the NIP issuer?   9. Hi, I'm new to this forum and looking to get some advice on a dispute my parents are having. They paid (by cheque) to have new Soffits and Fascia’s fitted by a company called EnviroTherm based in Ilkeston, Derbyshire. https://www.envirothermgroup.com/ My parents received a phone call out of the blue from a salesman who had provided a quote for the work 2/3 years ago saying he had moved company (to EnviroTherm) and asking to visit them to provide a new quote as he felt his new company would be cheaper. His new company (EnviroTherm) were more expensive until he phoned his manager and knocked around £1,000 off the price bringing the total price down to £2,375. I know this is a sales tactic but unfortunately they fell for it. My parents paid a 50% deposit which was £1,187.50. The deposit was only refundable within 14 days but EnviroTherm contacted my parents after 14 days had passed demanding an extra £1,500 for scaffolding. My parents stated that they would not pay the extra money and if the work couldn't be carried out for the agreed price they wanted their money back. EnviroTherm initially argued that their request was after the 14 days but when my parents argued the fact that the agreed price had been changed after the 14 days EnviroTherm agreed to refund their deposit. The process of getting EnviroTherm to agree to refund the deposit took many phone calls to speak to the manager who was always in a meeting or out of the office. One day my mum was even advised in the morning that he was in a meeting and later that day that he wasn't in work that day. Eventually, after many phone calls and many false claims to have posted a cheque EnviroTherm did send a cheque to my parents last Wednesday (25th April) which they received the next day and paid into the bank on Friday. Today my parents have been advised that the cheque has been cancelled by the company. The company have answered my mum's phone call today and claimed they are looking into the situation. They asked for her bank details but she didn't give these as she doesn't trust the company and instead demanded a new cheque. She's currently waiting to hear back. We're not hopeful of getting this resolved as my research into the company has highlighted that it is owned by a Jason David Rowan or Lord Jason David Rowan who was the owner of EnergySave who featured on Rogue Traders for their pressurised selling similar to that used on my parents but also much worse as well as their racism. I'm looking for advice on what legal step to take? I've read about a letter before action, is that the next step to take? I feel that they need to put something in writing the company as most of her communication has been over the phone. Any help or advice would be gratefully received!
  10. Hello, Mods please move or delete this thread if in the wrong section? I took a company to court over 8 years ago, I won, but the company went into liquidation before paying. I understand that the fscs offer some for of help in these situations? But they do require a lot of paperwork , which I no longer have. Is there anyway I can request copies of paperwork from the court hearing? Does anyone know how I would go about it. Thanks
  11. My daughter is NOT self-employed but works for a company that requires her to meet clients within the region she works in. Her contract does not state that she had to have a car but she has been told that she must use her car to go meet clients. Fair enough. When she went to claim her fuel expenses they refused because they said she needs business insurance on her vehicle and once she produces a certificate to prove this they will then pay for the fuels at 45p per mile. W Why should she have to pay for business insurance, it is not her business. She has said she would be happy to get it insured for business and then claim it back from the company but they say they wont pay it. She likes the job and does not want to leave but as I say this was not written in her contract. Others within the company have forked out for business insurance just to get peace but my daughter is taking a stand on this. Where does she stand legally? Any help or advice is much appreciated.
  12. Good Evening, I leased a business and took over on the 9th April 2018 a Sandwich Shop and the Proprietor who we took over from had her Electricity under contract with Npower. The previous owner and I took a reading on the day we moved in and they moved out. The reading was 91738 and that was given to Npower on the 9th April 2018, I then kept trying to contact them for us to get prices from them so we could compare with other Electricity companies and see who we wanted to be in contact with. Npower said that they would get back to me on the 10th April 2018 and I heard nothing from them I went into contract with another company. The previous owner was on the tariff of 12.45 P/KW and 22.5055p a day. I have just received a bill for the period of 9th April 2018 to 7th May 2018 and Npower have charged me 29.030p p/kw and 63.79 per day Which is outrages I do not understand why it took them so long to get back to me and why they did not give me a price quote when I:mad2: spoke to them on the 10th April. I feel that they have taken advantage of my situation.
  13. Hello! This seemed to be the place to put this, though equally it could have gone in transport or benefits. I had a look through and couldn't find any similar threads. I have fibromyalgia and have been trying for the last two years to get a disabled bus pass. It's been complicated by the fact that I have never been in receipt of mobility in PIP, something I decided not to appeal the first time round as I just didn't have the strength. When they re-assessed me, I decided to take it to tribunal and have been waiting, and waiting, and waiting... In the meantime, I have been trying to get a bus pass. There was a form on their application form for a doctor to fill in and stamp to confirm disability, which I made a (non emergency) appointment to do, she filled it out, I sent it off with a photo and expected it to be that simple. The first time was rejected for no reason, and again I did not have the strength to continue to fight, but a year later I decided to try again. Now they say that I must attend an 'assessment' with one of their County Council 'independent mobility assessors' to see whether or not I qualify. Apparently evidence from my GP and specialists is worthless. I have several concerns about this and was wondering if anyone had experience of this? How long does it take? How do they assess you? Do they seem genuinely interested in finding out if you have an 'invisible' illness or just in finding a reason to turn you down? I have a bit of a dilemma, because I *could* just wait for the court date (whenever that is) when I am hoping I will finally be awarded mobility, and then I can provide that as evidence and not need to undertake this 'assessment'. But then again, that could be a while. Thanks for any advice or info on your own experiences. I appreciate it.

  15. Hi We started renting a beautiful home in December. We pay £1,800 a month for the house which is a hell of a lot of money. We have had a letter saying building works begin on a patch of land next to our garden next week and the foundations mean they will have to take down our fence and work in our garden! We both work from home which will be impossible with the noise. We also have a dog who will go berserk at the builders in the garden and she wont be able to go outside. We are absolutely gutted that our dream home has become such a nightmare and we will not be able to use the garden for over 2 months! Well, we can, but not privately! Any advice on if we can refuse to pay rent? or at least get a reduction? The landlord knew about this and did not tell us before we moved in. My other concern is that our garden will now be completely overlooked by the new house. Any advice please?

That's right, our lovely DWP and JCP who want you to get back in to employment but when it comes to the crunch are unwilling to help you when you need a little bit of help and this set you up to FAIL! As you know I am on UC, I lost £95.00pm when moved from ESA and HB so am struggling. I have been applying for work but getting nowhere my work coach (work coach LOL) says to me "try registering with agencies and seeing if they can help" ... OK, I email a few agencies and I geta reply from Hays and speak with them on the phone about my work history and background etc. They tell me that they may have a few openings and would like to meet me - fine, train fare to town return is £9.40. As I am on UC almost £10 means a lot of food shopping and it is an amount that I can hardly 'lose' at the moment given my financial circumstances. I email my 'work coach' and say I have arranged an appt with the agency and I would like to claim my fare back. Guess what? DWP WON'T PAY IT as it is not an actual interview just registration. So I say "if I want interviews I need to register so I am on their books" - the answer (like a robot) "No we cannot pay your fare" Fine, end of story, appointment cancelled - you want to know why I have not been doing as you say and seeing agencies? BECAUSE YOU (DWP) ARE NOT HELPING ME AT ALL WHEN I AM TRYING TO BE PROACTIVE FINDING WORK!!!! What part of I am on UC and struggle with rent/food do you not understand? Want me back in work and off UC then HELP ME WITH A LOUSY TRAIN FARE! Angry? Yeah, expected this? Yeah ... DWP ... no help at all, just keep cutting peoples money and offering no help at all.   22. hi all i took a contract out in sep 2016, couldnt use it, called to send back but they said i'd had it over 2 weeks so no. i never paid anything and forgot about it as they didnt take my compliant serious. they in november 2017 i they put a default on my file. just wondering if i have any recourse to get it took off or anything?   24. I'm finally starting to get my credit file looking better but I now feel I may need to start a DMP. I can probably just about pay bills + debts but I'm struggling and in Feb I *may* be going to uni so my income will reduce to about half. I pay the household bills through my bank account and my OH pays me his share. How would I work that into a DMP? Would I ignore his money and budget only my half of everything etc?
