  1. I recently had issues with my gearbox which i had to take at a garage to get repaired, and the work was completed on the 1st March 2017. Now I will add the work was paid for by RAC Warranty for the amount of £1400. My receipt however doesn't breakdown the work that had taken place however just says gearbox and labor costs (At the time i remember he said it was only a small part that needed replacing). I didn't mind too much as the costs were getting picked up by RAC and trusted the garage. I have now got another issue with the gearbox however the garage don't want to take any responsibility for it and said it was 6 months warranty or 6000 miles, whatever comes first. I then asked what exactly was done to the gearbox to repair it (ie. a breakdown of the work) and they said we don't have that information anymore. RAC Warranty said they will not pay for the repair of the same part again so soon after it has been repaired. I feel this is not right. Where do I stand with this and how can I get this sorted out now as I am now unable to use my car and it's used for commuting. Please ask if you need anymore information. Thanks Aron
  2. I have an A5 with an S-Tronic gearbox fault. The oil cooler has failed allowing engine coolant to flow through the gearbox, which has killed it. Diagnosed at my local Audi center last week, the car is a 12-Plate & Dealer service from New The cost of a replacement box is £12k with the car's value at about £14k The 3-year warranty expired in June 2015, however Audi still treat the car as "young", as it's less than 5 years old. Audi are saying they won't contribute towards the cost of this repair, I've raised it with Audi UK (callback tommorow.) I fully expect them to stick to their guns, I will then escalate to Audi HQ in Ingolstadt, Germany. Failing any joy with them, how do I stand, from a consumer-law point of view? I've been told that "reasonable use" with regards to a vehicle, correctly serviced at the Dealer, would be 5 years. The car is currently 4.5 years old. It also has only 28k miles on the clock, very low milage. My plan, if I cannot get it repaired by them, is to pursue a claim in the county court, but would like to know my chances of success. I've seen, in motoring forums, somebody turn an absolute "no" from the manufacturer, into a "yes", by pursuing them in the small claims court. Which I'm guessing, the manufacturer wouldn't want to go anywhere near, due to bad publicity? I feel like Audi should step-up & sort this issue, however it's going to be a battle.
  3. Bought a Mazda 6 diesel estate , 61 plate from V12 Sports & Classics, Leicester. The gear selection became 'notchy' within the 100 mile drive home. within the next 100 miles it got worse and occasionally crunched into 2nd gear. I contacted V12 and the car was returned to their 'preffered' garage and left for repair. I contacted their garage after 1 week and was told the gearbox had been removed and sent away to a specialist, they had reported that gears 1 to 4 needed replacing, the garage were waiting for V12 to authorise repair or replacement. A week later I was told the car was fixed, I went and collected the car on a Saturday, I was told a 2nd hand gearbox had been fitted. It was immediately apparent when I drove the car that the problem was not fixed, I pulled over and contacted V12 who repeatedly told me it had been fixed and there was nothing wrong with it despite me being sat in it telling them it was not fixed. It was decided that I should take it back to the garage. a mechanic took it for a drive with me in the passenger seat, he changed gear very carefully, pausing in neutral, letting the rpm drop to tick over on the gear changes before selecting the next gear, the box was still lumpy and he stated 'its not the smoothest of boxes'. He suggested I try it for a week? I took it back to V12 where there were no aftersales team available! A salesman took the car for a test drive again, he never drove it over 1500rpm, I pointed out that you do not drive cars this way, the gear change was still notchy at 1500rpm, however I suggested I drive the car. At 2500-3000 rpm the gear change could be felt through the car. The salesman acknowkledged the problem and said a member of the aftersales team would call me on Monday I left V12 and travelled the 100 miles home. I e-mailed a histopry of the problems to their customer services and requested all correspondence be in writing or e-mail from this point on as I felt I was being fobbed off. I had no correspondence from them. I sent a letter by e-mail and also recorded delivery formally rejecting the vehicle and telling them they could collect it anytime, I was no longer prepared to travel the 200 mile round trip. received an e-mail back stating it had been passed to their legal team, I have not heard anything since, what do i do next? Car was £6400, i can get another replacement gearbox fitted for £1000 quoted by a local garage. I have only done 1000 miles in the car and 400 of this was travelling too and from the sellers address. Any advice would be appreciated
  4. Hi, Please can anyone help me with this: I have just had the 3rd (yes third) gearbox installed in my car, this gearbox has now failed after less than 24 hours and 50 miles! The story: Purchased from main dealer an 18 month old car in September 2014 with 7500 miles on the clock and balance of 3 year manufacturers warranty Car: Make MG, Model MG6 (petrol) Gearbox number 1: This is the original gearbox: noticed by end of 2015 (approx 28000 mile total) that gearbox 'crunches' when changed from 3rd to 4th gear quickly (yes this is a standard manual gearbox). Went to dealer in March 2016 to complain about gearbox (and other warranty faults), they drove car and agreed with me about gearbox. Manufacturer agreed to replace gearbox and new gearbox arrived at end of April. I couldn't leave car with the dealer at this time as I was on standby to work abroad for a number of weeks. Gearbox number 2: Finally got gearbox replaced at beginning of June. New gearbox was worse! Not only does it crunch in 4th but it also whines (like an old mini) in 2nd. Car returned at beginning of July to look at again, dealer agrees it is not correct but "doesn't know what manufacturer will say as it's out of warranty". Told them "don't care fault occurred in warranty period an has not been resolved - actually made worse". Manufacturer eventually agrees to send an engineer from the factory to look at my car who came last week. Manufacturer has agreed that the new gearbox is faulty but they will only supply a replacement 'box if I don't complain about it crunching in 4th as this is a "characteristic of the car". This is not entirely true as I have driven one of the loan cars with same gearbox and it does not crunch however the other loan car did, however there is a lot on the internet about failing gearboxes, crunching, stiff changes etc etc. The gearbox obviously has an inherent design flaw. Gearbox number 3: The third gearbox was installed 15/16th of this month (i.e. picked up yesterday), this has failed within 24 hours and 50 miles, jammed in second - so car now unusable. This happened first thing this morning This morning: Called finance company: told them I wish to reject car for refund under sale of good act and consumer credit act, they said they will talk to the dealer and 'get back to me' and that their procedures can take 8 weeks). I have told them I'm not interested in their time scale, I now do not have a drivable car, asked them for an address where I can serve notice of intended court action. Told me that I need to provide burden of proof, I told them this has been fixed under warranty so I have no paper work (dealer has never given me paper work for warranty repairs) - the car is sitting immobile on my drive if they want to inspect. Called dealer: spoke to the MD, he says it's not acceptable, can they collect car and give me a loan car. I can't arrange collection today or tomorrow as am too busy at work. Thing is I don't want this fixed now, too many attempts at a fundamental fault, I have no confidence whatsoever now. What I would like help with: I would like to claim from the dealer and finance company as they are jointly and severable liable - under sale of good act and consumer credit act - refund and cancel loan agreement. The fault apparently can not be fixed, actually each gearbox is worse. This is a major fault. Could someone point me in the direction of a letter template, and how to handle the court claim - I need to move urgently with this, I am currently having to borrow my wife's car - I can not get to work otherwise.   6. I've lost fourth gear and had my gearbox bearings replaced a few months ago would that be under warranty just as in having the bearings replaced with Volkswagen caddy aa d now fourth gear is gone is that part and parcel of having the new bearings fitted or is it two separate things
  7. Do Renault have responsibility for repairing or replacing this gearbox, due to the limited mileage. This is a two careful owner, wheelchair accessible vehicle.
  8. Hi all - I'm in a bit of bind with my car so thought I'd ask your advice. Apologies if this isn't the right place to post this I haven't been here for a while! Basically a dealer had an ebay auction for a car and I won it. As the place was a 6 hour round trip I made the mistake of not viewing the car before hand. I also paid for it to be delivered so I didn't have to give up a precious weekend day with the kids to go and pick it up. It was delivered after a week, then the problems started... I noticed a crunch when putting the car into first gear. Being handy with a set of spanners decided I would replace everything possible to do with the clutch without removing the gearbox. Basically replacing the easy/minor bits (clutch master and slave cylinders) with genuine parts - to rule them out as being the cause of the problem. Unfortunately that didn't solve it and now by process of elimination it's looking like a major expense to fix it - most likely replacing the gearbox. As it was bought from a dealer over ebay do I have any options to return the car for a refund? Or have a shot myself in the foot by replacing parts (albeit with new genuine ones)? I paid for the car at the end of Feb, almost a calendar month ago. As an aside the car is covered in rust, far more than would be thought consistent with age. This wasn't mentioned either. The perils of buying anything unseen from ebay! Lesson learnt... if anyone can offer me some advice I'd really appreciate it. Thank you, Matt
  9. I bought a car from CARCRAFT 14 months ago- I have purchased a @DRIVE HAPPY " warranty and paid £1000 for this! Gear box is knackered in my 3 year old car - that I've owned 14 months! And guess what ... They are not paying out... And guess why .... Wear and tear! I was sold this warranty by being took into a back room by a woman - she told me that she had recently had lots of problems with her car and the warranty covered everything!!! She insisted this warranty was amazing best money could buy for " peace of mind!" I am now told that it doesn't cover the gearbox of my 3 year old car that I have had for 14 months ! Because ...... It's wear and tear...., they have a "fairs fair policy" does anyone think that this is fair ??? I have seen my MP today who has asked for documentation from CARCRAFT LIVERPOOL - went down guess what .. . They can't give it to me - I have to write in!!! I am a single mum with 21 month old twins. I have been without my car for 15 days now . They have told me that I can come and collect it but .. The engine is hanging out!! The gearbox is in bits !! And the suspension is not connected!! If I do wish to come and collect my car in bits then I will have to pay near £500 pound for the pleasure ... . Because they want paying this amount for taking out the gearbox to be inspected . . FOR THEIR WARRANTY COMPANY. And for the inspection to be done!!!! Alternatively .. I can give them £1300 to repair the gearbox and get my car back . I should have known better when the first car I bought from them broke down as I drove out the showroom on the east lancs road with my two babies then 6 months old but tiny having been 2 months premature ! I was stranded with the babies !! Then the next day changed it for this one!!! Now this one is not fit for purpose nor has it lasted a reasonable length of time . . As per statutory rights and sales of goods act 1979. Please think about this if you are considering buying from this company !!
  10. I took the car to the garage because it sounded rough. They kept it and looked at it and said it was the gearbox. Instead of taking 4 days as they said it would I didn't get it back for 4 weeks (I felt they were having problems with it). After driving it for a few of days I can feel the clutch peddle shuddering and making a slight noise and its hopped out of reverse gear twice. I looked at the invoice and it says at the bottom: Advisory: will need a new clutch and flywheel! Note: 1) the clutch was not shuddering or slipping out of gear before they changed the gearbox. There was nothing wrong with it. 2) they changed the clutch and flywheel 18 months ago so I wasn't surprised when they didn't say that needed changing too. 3) I know if the clutch and flywheel need changing as well as gearbox the garage should tell you this. 3) if Id have known it needed a clutch and flywheel as well as a gearbox I may very well have decided to scrap the car and use the £1000+ to get a new one. Before I go and see them and they start fobbing me off what are my rights on this?
  11. Hi, we really need help on what to do! I'll try and keep this story as brief as possible! We bought a second hand car this Monday 2nd June, the next day my husband took it to Kwik fit in goole East Yorkshire for a service to make sure we hadn't bought a wreak! "You've bought a good car there" said the mechanic! When my other half went to drive it away, it wouldn't start. The mechanics came out to see what the problem was! As it was nearly closing time my husband arranged to bring it back the next day for them to have another look at it. In the meantime I bought him 4 new alloys with tyres to replace the old ones. He took it back yesterday and had the new wheels fitted and they checked the vehicle over again but could find why sometimes it wouldn't start. After fitting the new alloys they found the tracking needed doing. After this was done hubby got in and drove it down the road to find it pulled badly to the left. He took it back and they did it again. After being tracked for the second time it was still pulling to the left but they said "the machine said it was perfect." Could there be something wrong with their tracking machine? After taking it back for the 3rd time they decide to put it on a machine where it literally shakes the car to death. My husband is an engineer and he thought at the time that they had left it on the machine for far too long. When it came off he drove it home and said there is something seriously wrong with the car. (We live approximately half a mile from KwikFit) so he took it back AGAIN, when they put it up on the ramp they found the prop shaft (I think that's the name) had a new crack in it, the manager then decided to take it on a test drive but my husband advised him not too as this car was now seriously sick. But against my hubbies advise he took it out, was gone over 10 minutes and when he pulled back into the garage there was a really loud noise and unbelievably the manager has now broken the gearbox. Hubby has gone completely nuts and demanded to see the area manager who was 3 hours drive away! I am utterly gob smacked how we have gone from a great runaround vehicle to a broken, probably un-repairable piece of scrap in 3 days! Where do we stand legally? If we don't get any joy from the area manager, what do we do next! Please help as we don't have another car to fall back on.
  12. Just after some advice, your help would be greatly appreciated. I bought a 2010 Audi A4 at the beginning of September 2013 and have only done 2600 miles in it. The car recently started making a loud noise so I took it to an independent VW/Audi specialist who have diagnosed it to be a gearbox problem. They stated the gearbox would need to be removed and then taken to a gearbox specialist who would strip it to pinpoint the exact fault. I asked them not to do any further work and then collected it. The next day I phoned up the car super market I bought it from, after several calls to the after sales guy I managed to get a conversation out of him. He was a bit cautious of admitting that the car would still be under some kind of warranty as it was bought less than six months ago and had done a very small amount of mileage. I did mention the sales of goods act to him which he did try to fob off as well. I explained to him that the car had been diagnosed with a gearbox problem from the garage I took it to and stated the gearbox would have to be removed/stripped for inspection. He suggested I called a local gear box specialist to find out if there was a common problem with these cars and what it would cost to remove/strip the gearbox to find the fault. He then told me to forward all this information by email to one of his seniors. He also mentioned that I would have to pay for the gearbox to be removed/stripped/inspected. So I called my local gearbox specialist who told me they wouldn't know what the fault was until they stripped the gearbox. They also gave me a price to do the work. I have forwarded all this information on by email to the trader on Friday and have had a reply by email the same day to acknowledge they have received it and they would get back to me once they have spoken to the relevant parties concerned. So I am now waiting for further communication from them which I hope will not take too long as I need a car to commute. For now I would greatly appreciate any advice in this matter, I am not sure if they will come back to me with an excuse or if they will just carry out the work to resolve the problem. I just want to be ready to give them a reply if it is the former so the advice would be very useful. I would also like to know what your take would be on me paying the costs for the initial work, that is to get the gearbox removed and stripped for inspection. This will set me back £350 + VAT before any repair work. Should I be paying for this or should the car super market be doing this? Also what is the chances getting a courtesy car from them so I can use it to get about? Thanks
  13. Hi Everyone, Just looking for a bit advice here. We have a 2008 (58) plate Vauxhall Zafira (purchased September last year from a car supermarket) and on the 13th (definitely unlucky for us!) we broke down 100 miles away from home. Not to worry, we had a warranty (or so we thought!) Our car got recovered to a garage where the problem was diagnosed as gearbox failure and the gearbox repair specialist sent his report to the warranty company (which stated that the 'pinion bearing failed and damaged 6th gear and gearbox housing'). The warranty company (the RAC) didn't seem to do anything until I called them who claimed they were waiting for contact details of the gearbox specialist (who had already sent them his report with his contact details on the top!). After I chased this up they eventually decided they were sending an assessor out 3 days later.) The assessor turned up, looked at the car and gearbox, and then the report came back... you guessed it 'wear and tear' and not covered. Now, not only do I expect a gearbox to last longer than 5 years and 79,000 miles, if you google M32 gearbox it will show you how common the boxes are to go - obviously a manufacturing default somewhere along the line, and nothing to do with wear and tear. Not only this I feel completely ripped off by the warranty company, as it appears that any possible problem would come back to wear and tear. I appealed the decision got what looks to be a standard letter back saying they could not overturn the decision. (I think it is a standard letter and the heading does not even get the vehicle's fault correct!). I have appealed this again I am just looking for some basic advice on where I stand with this, and if I have any chance with getting my money back for the repair (we had to have the repair carried out as I need vehicle and it had already been 4 weeks without the car!). The repair cost £1200-£1300. Thanks in advance. Ps. Having done alot of research I found another thread on here regarding requesting documents from vauxhall so I contacted vauxhall and requested the documents, they did originally ask me to take my car to a vauxhall garage however once I said the car was repaired now I just got an email back saying they would not release those documents to the public.
  14. Hi all, this is my second thread here and unfortunately things are getting no better with me and my 'new' 09 plate Focus. I reported last week that the car has developed a rattle which sounds like it's coming from the gearbox area. This happens when the car is at idle and outta gear, especially stood outside the car on the passenger side, it sounds like somethings rattling itself to bits! Anyway, long story short i had to visit the garage last night after work to point out the noise to one of their technicians. He came out saying that he couldn't hear anything, which soon changed into 'yes sir, i can hear that'. After an encounter on the forecourt with two technicians pondering over what the issue is, they mentioned the clutch release bearing or the DMF, but they would take another look today and get back to me. As promised the garage have called to say the car is ready for collections and that the Service Manager has seen the car and has said the metallic rattle coming from the flywheel/clutch/gearbox is normal, but when i asked where i stand if one of these fail after my initial three months warranty ran out the garage have gone silent. They promised me a call back but that was hours ago! A little twist to all of this though, is that i have just found an email from the dealer principle sent to me yesterday. This is in reply to my first complaint two weeks ago about the accelerator failing - i've emailed him back to say that issue has been resolved and explained what is now going on, asking the same question above regarding the warranty and what happens in regards to any failures after the warranty has expired - given that the problem was reported within the initial three month period! For all you lovely people out there though, any ideas where i would stand legally if the worst was to happen? Thanks Dean
  15. Hi guys, I'm hoping someone on here can help me, I have a nissan primastar van and the gearbox is on its way out. My question is what is a reasonable mileage to expect from a gearbox for a commercial vehicles gearbox. My 2008 van has done 70000 miles and has a full service history. I am aware of the sale of goods act and that it should be fit for reasonable use, however 70000miles for a commercial doesnt seem to be right. Does anybody know of any claims or law suits against any vehicle manufacturer concerning gearbox lifetimes that i can use as evidence to back up my claim to nissan, or any kind of promotional material claims a gearbox should last for xxx miles. So far nissan have been completely dismissive and rejected my claim. Thanks for your help, Tim
