  1. Hello everyone, I'll try and explain my issue as best as I can. After many years as a stay at home mum I finally found a job for a small company local to me. I started on January 26th 2015 and my trial period ended on April 26th 2015. On May 6th I was taken ill and ended up having an ECG scan and had emergency blood tests. I kept my employers in the loop and they seemed understanding. A few days later I was still quite unwell and told them I'd need a few more days. They understood and asked me to let them know. However on Friday 15th I received an email from the owner of the company saying that they were grateful for all I had done but after a performance review (done in my absence and without my knowledge) they were letting me go with immediate effect and they would pay me a week's notice. My question is: can they do that while I am off sick? Can they have a performance review without me present and then decide I hadn't met their "targets" which were never discussed with me previously in any shape or form?As I had worked past my trial period even though it was only a few days over, do I have any rights at all? It feels wrong that the first time I am in a difficult position they just fire me without giving me any other chance. Am I being naive? I appreciate any feedback.
  2. I'm really not sure if anyone can help me on this, but it is Ingeus related however there is a good side. So as some of you maybe aware I am with Ingeus and I am having problems, long story short my advisor put me forward for a pre-screening in a factory, I have worked there before, he didn't know this because the CV on their system is over 1 year old. He tried to inconvenience me by doing this. But he has done me a massive favour. I attended the pre-screening yesterday, which was run by Ingeus staff. NOT the company. I passed, Ingeus have put me forward and my real interview is with the company next Tuesday. Now I am worried, I worked there before, I got the same job through Ingeus, it's the same agency and same position. they "released me with immediate effect" after I turned up to work despite being ill and passed out. Now, my advisor advised me to lie, tell them that this was a short term illness. But it isn't. The reason it happened is because I have a very high metabolism amongst other things. I am hungry all the time, if I do not eat something I get ill, I can not control it. I got sick because like an idiot I signed off and had to survive with £50 for a fortnight without wages or any income therefore no food doing a job on my feet for 8 hours a day. I tried to fight it out. My doctor has said there is nothing they can do, my metabolism will slow down as I get older I have had many tests. After the fainting episode I got the all clear from my GP and went back to work the next day, the agency then sacked me by text at the end of my shift. But I loved this job! The people were amazing and the wages and free rail travel were not to be scoffed at either. I really want to go back, but I am just worried that I will be instantly dismissed at the interview on Tuesday, is there anything I can do to get back in the good books? Really not sure what to do... Help, advice, techniques, anything at all that will help me is appreciated!
  3. Hi All, Really hope i can get some good solid advice here. I work for a Electrical company & redundancy only applies to site operatives. Not Supervisors or office staff. 18 Months ago the company i work for put out a risk of redundancy to staff and cut the hours to the basic (38hr), Thankfully things picked up and everything returned to normal with only 1 lay off. After that scare i thought i try and start my own business while still working, was working nights so it made it possible to do so. Spoke to the MD of the company about my plan and he seemed fine. Requested to be kept on night work and have been on nights ever since which is a year now. Last week redundancy happened again but overtime is still being worked. Is this right? Contracted hours are 38 people are working 43 hours. I was called in the office explained the process again asked if i wanted a rep present etc.. and received a letter in the post confirming you will know by the following week. I had the call so returned to the office but this time no offer for a represntive when i turned up and then heavliy grilled and spoken to quite rudely about having my own company by the Managing directors wife and the consultant (Human Resourse). She asked me to resign or be suspended to further investigation (to see if im trading) due to having a company which now im told is against company policy/rules!! I explained that i had told the MD and not once did it seem a problem so cant see why all of a sudden it is? if it was why would he of kept me on night work for so long? The Company is Registered with J.I.B (Joint industry Board) which aparrently does state you are not allowed to do electrical work other than the company you work for. I never knew this until now but have spent money and a heap of time setting it up with a website paid advertising etc.. so really feel robbed by this. I feel they are doing it so they can fire me without have to pay redundancy. Can they do this to me? How can they prove im trading? nothing tax related has been filed to HMRC Should my suspension be full pay as nothing was said regareding it ? Sorry its long but tried to cover everything. Hope someone can help Thank you. EDIT: JUST TO ADD 6 PEOPLE HAVE BEEN MADE REDUNDANT THIS TIME
  4. First off I have got to say I like my job and don't want to be too difficult but it is likely that I may be fired and for financial reasons I need to delay this as long as poissible. Background is I was diagnosed with secondry cancer 2-3 yrs ago and on Thursday was told that it had spread to my brain. Going to have radiotherapy and am entitled to 3 my full pay then ssp. I was off sick for about 9 months at first and then returned to work and apart from 1 week last yr and a few odd days (and I do mean a few pos 6-10) have had no sick leave in the last 2 yrs. My company were excellent and have made slight adjustments to compensate me and I have no gripe with them. I am not in a union and have no insurance or pension. I would like to delay being fired due to illl health and if treatment is a success there is no reasons for me not to work but it could take a while especially as my job involves me driving. My OH works but I am the higher wage earner so it is possible that they could give up work and drive me initially. Really want to know what I can say/do to delay any attempts to fire me at the moment, I have told my employer that I may have to take some time off in a few weeks. OH gets x yrs salary if I die in service but I assume that's a company pension and will not cost them. Been employed 5yrs at this company Any help would be appreciated
  5. Hi all, I started a new job about 4/5 weeks ago but it isn't going well. Its very timed and speed focused and I just CANT get to the speed they want/need their employees to achieve. Other trainees are managing this. I can't see how I can improve myself anymore (it's a physical job and I get the feeling that my previous 5 year desk job hasn't aided me in moving to this kind of situation) so feel like dismissal is going to be inevitable. What I'd like to get an opinion of is whether I should quit or should I wait to be dismissed. I'm very tempted to 'just' quit as it's really stressing me out constantly worrying about time targets and if I'm getting it wrong, and why I'm so bad etc, and dreading the next day at work. Money isn't a (major) issue as my husbands wage is supporting us adequately at the moment, but I would be looking to go back on JSA(Contribution) and also need to consider how it would look on my CV in the future. Is it better to look like I took responsibility myself and quit a job before they had to fire me, or to let them fire me and let future employers know? Thanks in advance StageD

  7. Last night I forgot to set my alarm, with the result that this morning I was an hour late for work, arriving at 8 instead of 7. I've been late before, but not often: last time was a month ago, and the time before that was so long ago I forget exactly when, maybe in May... This shouldn't be a big deal: everybody's late sometimes, but my manager started giving me a dressing down this morning over it. I objected to this, because he himself is ALWAYS late EVERY morning. He has been over 5 hours late on one occasion (drunk the night before), and we had to cover for him. He regularly arrives every day between 7:15 and 7:30, sometimes later. I objected to being lectured at by someone who's consistently late far more often than I am, viewing it as unjust and hypocritical. Anyway, we had an argument about it, and then I thought it had blown over. He was civil to me the rest of the day, until this evening as I left, he informed me that I need not come back, and I will receive a cheque for remaining pay in the post. Now, this is where it gets tricky: both he and I are actually self-employed. We work for a company that only has 3 full-time employees, everyone else is contracted, and officially self-employed. We pay all our own tax, NI, etc. We submit weekly invoices, and get paid by cheque weekly. I've worked there for 3 years (strangely enough, 3 years exactly to the day). So, technically, he can't actually "fire" me, as he isn't the person who employs me. BUT.... he does control the shifts, and who works on what days. What he's actually done is re-arrange the shifts so I now have none, which amounts to the same thing: that I no longer have a job. Now, this isn't over being late: as I stated, it's not like it was a consistent problem. It's actually because I argued with him. This seems to me to be wholly unprofessional of him. My manager is ex-army, and suffers from Post Traumatic Stress Disorder. He can't handle stress very well, and regularly flies off the handle, and reacts badly to the slightest provocation. In any normal work environment, like an office, he wouldn't last 5 mins, but in our job (we're the only 3 or 4 people on site), he doesn't have to deal with many people, or the public, and we've learned to work around his moods. What he's done isn't about my work: it's personal, and extremely petty. He clearly didn't like me answering back, and has decided to "punish" me as if I were a naughty child (I'm actually older than him.) This is extremely unfair, as far as I am concerned, but where do I stand? Even though I'm technically not an employee, shouldn't there be at least a written warning? Having an argument with my manager, or being late, are not grounds for instant dismissal in any other job.... Ideally, I'd like my job back. Yes, my manager is a See You Next Tuesday, but I don't mind apologising, even eating a bit of humble pie if I have to, as the job is a good one, and is very convenient for me at this moment in time, being located only a 15 min walk from home. Any other job I get is likely to involve travel expenses. But if I am to approach my manager, and ask him to reconsider, I would prefer to have some bargaining power behind me. Should he prove unresponsive to an apology, I'd like to be able to take the matter to a tribunal: is this possible? Any advice welcome ...
  8. Hi everyone. I work for a corporate, about 6 years now. Twice I've been sent to college by company. Finished twice with the highest grade. I have good record at work with relation to overall performance (attendance, sick, always on time, never refused to do my job etc). On Friday I've been approach by manager asking me to do some more hours to which I replied "no thanks". Minute later my colleague ask me why I am not interested in doing extra hours to which I replied "I have work my ass off for this company for the last 5 years, spent my free time on getting educated, when I could be sitting down the pub with my mates and now they are not interested in doing anything for me, so I am not staying any f****** minute longer". What I did not know is that my manager was sneaking behind by back. So she approached my and ask to repeat what I said to which I replied it was a private conversation between good friends and has nothing to do with her. Obviously I've been asked to step into the office and had a chat with her about how unacceptable it is to say thing like that about company and that it is not true, that they invested many in me etc. I said then "investment is something you care about, something you may want to make sure company will benefit from in the future and that during all that time I've been doing my HND certificate not even once anyone of them have come down and ask me how I am doing, is everything OK, not even mention college ended in June and they did not even asked my for a proof of final grade. I also said that it is now time to get me into practical training before I loose what I learned at college, they know I am not after more money but simple chance to put in practice all my knowledge. I then said I believe my opinion is justified by their actions or lack of it and I have sound grounds to feel that way." She was a bit shocked and said it is all for now, but I know I am gonna have to take b*******g on Tuesday when big boss is back and I am worry they may try to crucify me. Can I start packing my staff on Monday guys? What Is the worst possible outcome out of this. I just want to add that we (employees) have been slowly stripped from all our privileges like bonuses etc and overall morale is at its lowest ever been i.e. no one is willing to do any OT etc. Thanks for any advice, cheers!
